  26.         JEWISH PEACE LOBBY PROTESTS LAST WEEK'S EXPULSION
  27.         OF 400 PALESTINIANS FROM THE OCCUPIED TERRITORIES
  28.  
  29.         The Washington-based Jewish Peace Lobby protests last
  30. week's expulsion of some 400 Palestinians from the West Bank
  31. and Gaza. According to Jewish Peace Lobby President Jerome
  32. Segal, while the Peace Lobby does share the outrage of
  33. Israelis at the recent murder of border policeman Sergeant
  34. Toledano, it strongly disagrees with the Israeli government's
  35. decision to retaliate by expelling the 400 Palestinians.
  36.  
  37.         The Jewish Peace Lobby raises three objections:
  38.  
  39.         From a moral point of view, guilt is a necessary
  40. precondition for punishment;  the 400 people expelled were not
  41. ascertained by any valid judicial inquiry to have been guilty
  42. of any connection with the killing. Second, rounding up and
  43. expelling 400 Palestinians from the territories is a
  44. violation of the 1949 Geneva Conventions against expulsion
  45. from occupied territories.  Third, on a pragmatic level,
  46. expulsions will not prevent Hamas from attempting similar
  47. actions and have undercut those Palestinians who are
  48. committed to the peace process.

  52.         The Jewish Peace Lobby shares the
  53. outrage of Israelis at the recent kidnapping and murder of
  54. Sergeant Toledano, and joins in the general condemnation of
  55. Hamas not only for this action, but for its determination to
  56. undercut efforts to achieve peace betwee n Israelis and
  57. Palestinians. Further, we affirm Israel's right to protect its
  58. citizens from this kind of attack.
  59.  
  60.         At the same time, we voice our opposition to the
  61. recent decision by the Israeli government to expel some 400
  62. Palestinians from the territories.
  63.  
  64.         Our opposition emerges from three perspectives: moral,
  65. legal and pragmatic.
  66.  
  67.         1. Moral: The 400 people expelled were not ascertained
  68. by any valid judicial inquiry to have been guilty of any
  69. connection with the killing. From a moral point of view, guilt
  70. is a necessary precondition for punishment.
  71.  
  72.         2. Legal: Whatever legal questions there may be about
  73. the status in international law of orders to expel an isolated
  74. individual who has committed a capital offense, there can be
  75. no doubt that the rounding up and expulsion of 400
  76. Palestinians from the ter ritories is a violation of the
  77. Geneva Convention against expulsions from occupied
  78. territories.

  80.         3. Pragmatic: From a pragmatic concern for the peace
  81. process, the expulsions also make no sense. They will not
  82. prevent Hamas from attempting similar actions; they have made
  83. heroes out those who carried out the action; and they have
  84. undercut those Palesti nians who are committed to the peace
  85. process.
  86.  
  87.         The longer the stalemate over the fate of the 400
  88. continues, the more thoroughly the Palestinian population will
  89. rally around Hamas.
  90.  
  91.         We urge the Israeli government to readmit the 400, and
  92. to bring to trial those that it believes are linked to the
  93. killing of Sergeant Toledano.
