  24. Definitely.  Although it would get a little fuzzy if you had told her 
  25. previously that it would be fun, or that you wouldn't mind (i.e.- "it would be 
  26. wild to wake up and have you making love to me" etc. etc.).  HOWEVER, you were 
  27. asleep, and therefore incapable of consent.  No different than a woman too 
  28. drunk to protest sex.  But I wouldn't want to take it to the courts 8).

  30. However, the difficulty of prosecution does NOT make it not rape (of crucial 
  31. importance)!  oh well, just one woman's humble opinion.
