I used to hang out with a few magic dealers/creators, and the rule of thumb is.... *IF* you can figure out who did it first, you should give credit. but, usually the guy/gal that you attest credit to, stole the idea from somewhere else. Magicians and Magic dealers are famous for ripping off ideas adding a little twist and calling it their own. There is NO such thing as copy-rights in magic. Too hard to prove in court.
