- Fine, but I have one point I want clarification on. You seem to think that
- this power will be exercised only in a beneficial fashion-much as it was, say,
- in pre-Roe abortion prosecutions, where in one Nebraska case, the jury refused
- to convict the woman despite her basically being caught red-handed because they\
- all knew someone she'd helped out.

- But it has disturbing implications. What about Southern juries that refused to
- convict Klansmen caught in the act, or anyone harassing blacks? They were
- clearly using jury nullification, yet the net result was a denial of justice.
- Or, to take a more recent example, the Rodney King jury? And on the other side
- of the racial coin, the all-black jury in New York that acquitted the black
- man who killed four cops and wounded six more? Jurors are all too human, you
- know.

- And even if they are, this opens the door wide for intimidation. Here in New
- York, the prosecution is required to make the names of the jurors known to
- the defense. Gotti was tried several times (admittedly, some of them with
- prosecution that left something to be desired) before he was finally convicted.

- dark side to this, and maybe sometimes it's for society's benefit.
