  1. EASTMAN KODAK COMPANY
  2. SOFTWARE LICENSE AGREEMENT
  3. Single-Disc Version LICENSE 
  4.  
  5. 1. Grant of License.
  6. Eastman Kodak Company (Kodak) grants you a license to use one copy 
  7. of the enclosed software program(s) (the Software) subject to the 
  8. license restrictions set forth below.
  9.  
  10. 2. Restrictions on Use. 
  11. You may use the Software only on one computer at a time. For each 
  12. additional computer on which the Software is running at the same time, 
  13. you will need an additional licensed copy of the Software.
  14.  
  15. 3. Transfer of the Software.
  16. You may permanently transfer the Software to another party if the other 
  17. party agrees to accept the terms and conditions of this license and you 
  18. retain no copies of the Software.
  19.  
  20. 4. Copyright.
  21. The Software is owned by Kodak or its suppliers and is protected by 
  22. copyright laws and international treaties. You may not copy the Software 
  23. other than as expressly provided in this license. You may not reverse 
  24. engineer, decompile, or disassemble the Software.
  25.  
  26. 5. Term.
  27. This license is effective until termination. You may terminate it at any 
  28. time by destroying the Software, together with all copies in any form. It 
  29. will also terminate if you fail to comply with any term or condition of 
  30. this Agreement. You agree upon such termination to destroy the Software 
  31. together with all copies in any form.
  32.  
  33. LIMITED WARRANTY
  34. For a period of 90 days after the date of delivery of the Software to 
  35. you, as evidenced by a copy of your purchase receipt, Kodak warrants the 
  36. Software will perform substantially in accordance with the accompanying 
  37. operating instructions, and, if this Software is provided on media 
  38. manufactured by Kodak, Kodak also warrants that the media on which the 
  39. Software is furnishedwill be free from defects in materials and 
  40. workmanship under normal use.
  41.  
  42. Kodak does not warrant that the functions contained in the Software will 
  43. meet your requirements or that the operation of the Software will be 
  44. uninterrupted or error free. You assume responsibility for operation of 
  45. the Software to achieve your intended results, and for the installation, 
  46. use, and results obtained from the Software.
  47.  
  48. Subject to any applicable legislation which prohibits the following 
  49. exclusions, KODAK MAKES NO OTHER WARRANTIES OF ANY KIND, EITHER EXPRESS 
  50. OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND 
  51. FITNESS FOR A PARTICULAR PURPOSE. Some states and countries, including 
  52. Australia, do not allow the exclusion of implied warranties, or have 
  53. legislation that imposes certain statutory warranties that cannot be 
  54. excluded, so the above exclusion may not apply to you. This warranty 
  55. gives you specific legal rights and you may also have other rights.

  57. LIMITATION OF REMEDIES
  58. Subject to any applicable legislation which prohibits the following 
  59. limitations, Kodak's entire liability and your exclusive remedy shall 
  60. be the repair or replacement of the Software or any media not meeting 
  61. Kodak's Limited Warranty that is returned to the publisher of this disc 
  62. with a copy of your receipt. This remedy is not available if failure 
  63. of the Software or media is the result of misuse, abuse, or a failure 
  64. to follow the operating instructions in the accompanying written materials.

  66. IN NO EVENT WILL KODAK OR ITS SUPPLIERS OR DEALERS BE LIABLE TO YOU FOR 
  67. ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING ANY LOST PROFITS, 
  68. LOST SAVINGS, OR OTHER DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE 
  69. THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 
  70. Some states and countries, including Australia, do not allow the limitation
  71. or exclusion of liability for incidental or consequential damages, or have 
  72. legislation which restricts the limitation or exclusion of liability, so 
  73. the above limitation may not apply to you.

  75. GENERAL
  76. If the Software was purchased in the United States, this Agreement is 
  77. governed by the laws of the State of New York. If purchased outside the 
  78. United States, this Agreement is governed by the laws of the country in 
  79. which it was purchased.If you have any questions, you should contact 
  80. the publisher of the disc on which this Software was distributed.

  82. U.S. GOVERNMENT RESTRICTED RIGHTS
  83. The Software and documentation are provided with RESTRICTED RIGHTS. 
  84. Use, duplication, or disclosure by the Government is subject to 
  85. restrictions as set forth in subdivision (b)(3)(ii) of The Rights in 
  86. Technical Data and Computer Software clause 252.227-7013. 
  87. Contractor/manufacturer is Eastman Kodak Company, 343 State Street, 
  88. Rochester, New York, 14650.

  90. EUROPEAN COMMUNITY PROVISIONS
  91. If this Software is used within a country of the European Community, 
  92. nothing in this Agreement shall be construed as restricting any rights 
  93. available under the European Community Software Directive, O.J. Eur. 
  94. Comm. (No. L. 122) 42 (1991).
