  7.      END USER LICENCE AGREEMENT FOR
  8.      ROMANIAN ANTIVIRUS SHAREWARE VERSION

  10.      This End User License Agreement (hereinafter referred to as 
  11.      "AGREEMENT") is a legal agreement between you, the user, and
  12.      GeCAD srl for the computer program entitled Romanian
  13.      AntiVirus Shareware Version including any enclosed
  14.      documentation and/or accompanying items. This AGREEMENT
  15.      states the terms and conditions upon which GeCAD srl offers
  16.      to license Romanian AntiVirus.
  17.  
  18.      This AGREEMENT is binding upon you as well as anyone taking
  19.      any action with regard to your copy of Romanian AntiVirus at
  20.      your direction or not. This applies to any third party as
  21.      well.

  23.      You should carefully read the following terms and conditions
  24.      before using Romanian AntiVirus. Unless you have a different
  25.      license AGREEMENT signed by GeCAD srl your use of Romanian
  26.      AntiVirus indicates your acceptance of this license
  27.      AGREEMENT and warranty.
  28.  
  29.      By continuing the installation of Romanian AntiVirus,
  30.      running or copying it to a computer, you agree to be bound
  31.      by the terms and conditions of this AGREEMENT.

  34.      TERMS AND CONDITIONS

  36.      LICENCE

  38.      Romanian AntiVirus is licensed, not sold. Subject to the
  39.      terms and  conditions of this AGREEMENT, GeCAD srl grants
  40.      you the limited right to use one (1) copy of the enclosed
  41.      Romanian AntiVirus on any single computer. Solely for your
  42.      own back-up purposes, you may make one (1) copy of Romanian
  43.      AntiVirus in the same form as provided to you. You may not
  44.      copy any of the printed material (if any) for any reason.
  45.      You have no ownership or proprietary rights in or to
  46.      Romanian AntiVirus. You agree that Romanian AntiVirus will
  47.      not be used, in any manner, in violation of any applicable
  48.      law.

  51.      COPYRIGHT
  52.  
  53.      Romanian AntiVirus is owned and copyrighted by GeCAD srl and
  54.      is protected by international copyright laws and
  55.      international treaties. GeCAD srl reserves all the rights
  56.      regarding Romanian AntiVirus. GeCAD srl authorizes usage of
  57.      Romanian AntiVirus only in accordance with the terms and
  58.      conditions stated in this AGREEMENT. You may not remove any
  59.      copyright or proprietary notices from the Romanian
  60.      AntiVirus.

  63.      TRADEMARKS
  64.  
  65.      Romanian AntiVirus is a registered trademark of the GeCAD
  66.      srl. All other product names mentioned are acknowledged to
  67.      be the marks of their producing companies.

  69.  
  70.      GENERAL USAGE
  71.  
  72.      You may use the software for evaluation purposes only, for a
  73.      period of maximum 30 days. If you decide to keep the
  74.      software after the 30 days period, you must purchase a
  75.      registered copy. Neither you, anyone at your direction, nor
  76.      any third party, shall take the following actions with
  77.      regard to Romanian AntiVirus, or any portion thereof to
  78.      modify, change, decompile, recompile, disassemble, reverse
  79.      engineer, adapt, create derivative works, translate or
  80.      reproduce Romanian AntiVirus. In any event, you will notify
  81.      GeCAD srl of any information derived from reverse
  82.      engineering or such activities and the results thereof will
  83.      constitute confidential information of GeCAD srl which may
  84.      be used only in connection with Romanian AntiVirus. If you
  85.      seek interface information you should initially approach
  86.      GeCAD srl.

  89.      COMMERCIAL USAGE
  90.  
  91.      Any commercial use is prohibited. Under no circumstances
  92.      shall you, the end-user, be permitted, allowed or authorized
  93.      to commercially exploit Romanian AntiVirus, or any portion
  94.      thereof. Neither you, anyone at your direction nor any third
  95.      party shall take the following actions with regard to
  96.      Romanian AntiVirus, or any portion thereof to: sell, rent,
  97.      lend, lease, commercially exploit or use Romanian AntiVirus
  98.      for any commercial purpose.

  101.      UPDATES
  102.  
  103.      GeCAD srl reserves the right to update the contents of
  104.      Romanian AntiVirus and its associated files, documentation
  105.      and/or other elements, at its discretion from time to time,
  106.      without the consent of or any obligation to, any licensed
  107.      users or distributors. 
  108.  
  109.  
  110.      DISTRIBUTION
  111.  
  112.      The shareware package of the Romanian AntiVirus software may
  113.      be distributed freely. Disk Vendors, Computer Clubs, BBSs
  114.      and other vendors may charge a nominal fee for distribution
  115.      of the program. The recipient of Romanian AntiVirus must be
  116.      informed, in advance, that the fee paid to acquire Romanian
  117.      AntiVirus does not relieve the recipient from purchasing the
  118.      Licensed Version of Romanian AntiVirus if the recipient
  119.      continues to use Romanian AntiVirus.

  121.      The shareware package of the Romanian AntiVirus software may
  122.      not be sold or licensed. Neither may a fee be charged for
  123.      its use. Neither the software nor its documentation may be
  124.      amended or altered in any way.

  126.      Small additions to the package, such as the introductory or
  127.      installation batch files used by many shareware disk
  128.      vendors, are acceptable. Many BBSs add a small text file
  129.      (advertisement) to each archived file. Other BBSs add a
  130.      small message with their BBS name and phone number into the
  131.      compressed file, which will display when the file is
  132.      uncompressed. Either of these methods of mentioning your BBS
  133.      are acceptable and may be used, provided the program and
  134.      documentation is otherwise unmodified and complete.

  136.      By granting you the right to distribute the shareware
  137.      package of the Romanian AntiVirus software, you do not
  138.      become the owner of this software in any form.

  141.      WARRANTY
  142.  
  143.      ROMANIAN ANTIVIRUS IS PROVIDED "AS-IS". NO WARRANTIES OF ANY
  144.      KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO,
  145.      IMPLIED WARRANTIES, OF MERCHANTABILITY OR FITNESS FOR ANY
  146.      PURPOSE WITH RESPECT TO THE SOFTWARE ARE MADE AS TO IT OR
  147.      ANY MEDIUM IT MAY BE ON. GECAD DOES NOT WARRANT THAT THE
  148.      OPERATION OF ROMANIAN ANTIVIRUS WILL BE ERROR FREE OR MEET
  149.      ANY REQUIREMENTS. THE WARRANTY SET FORTH ABOVE IS IN LIEU OF
  150.      ALL OTHER  WARRANTIES WHETHER ORAL OR WRITTEN. NO ONE BUT
  151.      AUTHOR IS AUTHORISED TO MAKE MODIFICATIONS OR ADDITIONS TO
  152.      THIS WARRANTY. 
  153.  
  154.      REMEDIES. GECAD WILL NOT BE LIABLE AND WILL PROVIDE NO
  155.      REMEDY FOR LOST DATA, LOST SAVINGS, LOST PROFITS, SPECIAL,
  156.      INCIDENTAL, CONSEQUENTIAL, PUNITIVE, INDIRECT OR ANY OTHER
  157.      DAMAGES ARISING FROM NEGLIGENCE, STRICT LIABILITY, BREACH OF
  158.      WARRANTY, BREACH OF CONTACT, EVEN AFTER NOTICE OF THE
  159.      POSSIBILITY OF SUCH DAMAGES OR FOR ANY CLAIM BY ANY OTHER
  160.      PARTY.

  163.      TRANSFER

  165.      Neither this AGREEMENT nor any part or portion of it shall
  166.      be assigned or sublicensed, except as described herein.

  169.      TERM
  170.  
  171.      This license and your right to use Romanian AntiVirus
  172.      terminates automatically if you violate any part of this
  173.      AGREEMENT without notice from GeCAD srl. You can also
  174.      terminate this license at any time. You agree upon
  175.      termination to destroy all copies of Romanian AntiVirus
  176.      immediately. Upon termination GeCAD srl may also enforce any
  177.      rights provided by law.

  179.  
  180.      INDEMNIFICATION
  181.  
  182.      You hereby agree to indemnify, hold harmless and defend
  183.      GeCAD, owners' family, relatives, licensees, sub-licensees,
  184.      distributors and lawyers against any and all damages,
  185.      losses, claims, courses of action, lawsuits, liabilities,
  186.      judgements and all expenses arising from, resulting to, or
  187.      in connection with a breach of this agreement by you and
  188.      arising from, relating to, or in connection with your use or
  189.      non-use of Romanian AntiVirus.

  191.  
  192.      RESTRICTED RIGHTS
  193.  
  194.      Romanian AntiVirus and any related documentation is provided
  195.      with restricted and limited rights. Use, duplication and
  196.      disclosure by U.S. Government is subject to restrictions as
  197.      set forth in the subdivision (b)(3)(ii) of the Rights in
  198.      Technical Data and Computer Software Clause at 252.227-7013.
  199.      If you are using this software outside the U.S. you agree to
  200.      be bound by the applicable law in your country. 
  201.  
  202.  
  203.      SURVIVAL
  204.  
  205.      Should any provision of this AGREEMENT be held to be void,
  206.      invalid, unenforceable or illegal by a court, the validity
  207.      and enforceability of the other provisions shall not be
  208.      affected thereby. If any provision is determined to be
  209.      unenforceable, you agree to a modification of such provision
  210.      to provide for enforcement of the provision's intent, to the
  211.      extent permitted by applicable law. Failure of a party to
  212.      enforce any provision of this AGREEMENT shall not constitute
  213.      or be construed as a waiver of such provision or the right
  214.      to enforce the provision.

  217.      The following provisions shall survive the expiration or
  218.      early termination of this AGREEMENT:

  221.      ENTIRE AGREEMENT
  222.  
  223.      This AGREEMENT constitutes the entire AGREEMENT between you,
  224.      and GeCAD srl and supersedes any prior written or oral
  225.      agreement concerning Romanian AntiVirus. GeCAD srl is not
  226.      bound by any action, statements, or any provisions made by
  227.      anyone else. No modification or change in this AGREEMENT
  228.      shall be valid or binding upon GeCAD srl unless in writing.

  230.  
  231.      BY USING ROMANIAN ANTIVIRUS YOU ACKNOWLEDGE THAT YOU HAVE
  232.      READ AND UNDERSTOOD THIS AGREEMENT AND YOU AGREE TO BE BOUND
  233.      BY THIS AGREEMENT'S TERMS AND CONDITIONS. YOU ALSO AGREE
  234.      THAT THIS AGREEMENT IS THE COMPLETE AND EXCLUSIVE STATEMENT
  235.      OF THE RIGHTS AND LIABILITIES OF THE PARTIES AND SUPERSEDES
  236.      ALL PROPOSALS OR PRIOR AGREEMENTS, ORAL OR WRITTEN AND ANY
  237.      OTHER COMMUNICATION BETWEEN THE PARTIES RELATING TO THE
  238.      SUBJECT MATTER OF THIS AGREEMENT.

  241.      If you do not agree with the terms and conditions of this
  242.      AGREEMENT or do not understand any of them you should
  243.      uninstall and destroy your copy of Romanian AntiVirus
  244.      immediately.
