  1. AVG 6.0 Basic Free Edition License Agreement

  4. NOTICE:  THE FOLLOWING IS A LEGAL AGREEMENT. PLEASE READ
  5. IT CAREFULLY. INSTALLATION OR USE OF THE SOFTWARE PROVIDED WITH THIS AGREEMENT
  6. (THE "SOFTWARE") CONSTITUTES ACCEPTANCE OF THE TERMS OF THIS AGREEMENT. IF YOU
  7. DO NOT AGREE WITH ALL OF THE TERMS AND CONDITIONS OF THIS AGREEMENT, YOU MUST
  8. (i) IMMEDIATELY CEASE USING THE SOFTWARE, (ii) DESTROY ALL COPIES OF THE SAME,
  9. INCLUDING ANY COPIES STORED ON YOUR HARD DRIVE AND ANY ARCHIVAL COPIES, AND
  10. (iii) FOLLOW THE PROCEDURES ESTABLISHED BY THE MANUFACTER.

  12. LICENSE GRANT.  Grisoft, Inc. ("Grisoft") grants you a non-exclusive,
  13. non-transferable right and license to use the Software as follows:
  14.  
  15. 1. AVG Free Edition is a FREE product. There is no warranty and no technical
  16. support available unless you purchase a technical support agreement.
  17.  
  18. 2. You may install and use only one copy of the Software for single computer
  19. protection only and can only be downloaded, installed and used if you are based
  20. in one of the countries where it is permitted. The list of countries can be
  21. found at the end of this agreement.
  22.  
  23. 3. You may not use the Software on a network.
  24.  
  25. 4. If any user of a licensed copy of the Software is the primary user of more
  26. than one computer (such as an office and home computer), the Software may be
  27. installed and used on each such computer so long as the Software is 
  28. never used on more than one of the computers at the same time.
  29.  
  30. 5. You may make a reasonable number of back-up copies of the Software to be used
  31. only to replace an unusable copy of the Software.
  32.  
  33. COPYRIGHT.  The Software is proprietary to Grisoft and its licensors. Grisoft
  34. and its licensors retain all
  35. copyrights, trade secret rights, patents, trademarks and any other proprietary
  36. rights relating to the Software.
  37. Except as expressly provided in the License Grant above, you may not copy,
  38. reproduce, alter, modify, decompile,
  39. disassemble, reverse engineer, or create derivative works based on, the
  40. Software. All rights not expressly granted
  41. are reserved. Any copy of the Software which you are permitted to make under
  42. this Agreement must include all of the copyright and other notices appearing in
  43. the original copy of the Software.

  45. RESTRICTIONS ON TRANSFER.  This license is personal to you, and neither your
  46. rights hereunder nor any copy of
  47. the Software, may be sold, assigned, distributed, transferred or sublicensed to
  48. any other person, in any media (including electronic media), without the prior
  49. written consent of Grisoft. Any transfer in violation of this section will be
  50. null and void and will automatically terminate your right to use or possess the
  51. Software.

  53. UPDATED VERSIONS. The Software may be updated from time to time by Grisoft in
  54. its sole discretion. You may
  55.  obtain such updated versions of the Software from Grisoft on the terms agreed
  56. upon by Grisoft and you. Such
  57.  updated versions of the Software are expected to operate more accurately and
  58. effectively. You acknowledge that
  59.  you are responsible for downloading and installing such updated versions of the
  60. Software.
  61.  
  62. LIMITED WARRANTY. Grisoft warrants that, for sixty (60) days from the date of
  63. delivery of the Software
  64. to you, the Software will perform substantially in accordance with its
  65. applicable documentation. GRISOFT DOES NOT WARRANT THAT THE SOFTWARE WILL BE
  66. UNINTERRUPTED OR THAT THE SOFTWARE WILL BE ERROR-FREE.  THE ABOVE
  67. WARRANTY IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, WHETHER EXPRESSED OR
  68. IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND IMPLIED
  69. WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE. Some states do not allow
  70. limitations on an implied warranty, so the above limitations may not apply to
  71. you.  To the extent permissible, any implied warranties are limited to sixty
  72. (60) days from the day of delivery to you. This warranty gives you specific
  73. legal rights. You may have other rights which vary from state to state.
  74.  
  75. LIMITATION OF LIABILITY.  IN NO EVENT WILL GRISOFT OR ITS LICENSORS BE LIABLE TO
  76. YOU FOR ANY CONSEQUENTIAL,
  77. INCIDENTAL OR SPECIAL DAMAGES, INCLUDING ANY LOSS OF PROFITS, BUSINESS
  78. INTERRUPTION, OR LOSS OF DATA ARRISING OUT OF THE USE OR INABILITY TO USE THE
  79. SOFTWARE, EVEN IF GRISOFT OR ITS LICENSORS HAVE BEEN ADVISED OF THE POSSIBILITY
  80. OF SUCH DAMAGES. IN NO EVENT SHALL GRISOFT'S LIABILITY UNDER THIS AGREEMENT
  81. EXCEED THE AMOUNT OF THE LICENSE FEES ACTUALLY PAID BY YOU IN RESPECT OF THE
  82. COPY OF SOFTWARE GIVING RISE TO THE CLAIM. THE FOREGOING LIMITATION SHALL APPLY
  83. NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY. Some
  84. states do not allow the exclusion or limitation of incidental, consequential or
  85. special damages, so the above limitations may not apply to you.

  87. NOTICE TO U.S. GOVERNMENT END USERS. The Software and any accompanying
  88. documentation are provided with RESTRICTED RIGHTS. Use, duplication, or
  89. disclosure by the U.S. Government or its contractors is subject to restrictions
  90. as set forth in subparagraph (c)(1)(ii) of the Rights in Technical Data and
  91. Computer Software clause at DFARS 252.227-7013, or any successor regulation or
  92. as set forth in the particular department or agency regulations or rules which
  93. provide Grisoft or its licensors with protection equivalent to or greater than
  94. that clause.

  96. GOVERNING LAW AND GENERAL PROVISIONS.  This Agreement will be governed by the
  97. laws in force in the State of California, excluding the application of its
  98. conflicts of law principles. If any part of this Agreement is found void or
  99. unenforceable, it will not affect the validity of the balance of the Agreement,
  100. which shall remain valid and enforceable according to its terms. You agree that
  101. the Software will not be shipped, transferred or exported into any country or
  102. used in any manner prohibited by the United States Export Administration Act or
  103. any other export laws, restrictions or regulations.  This Agreement shall
  104. automatically terminate upon failure by you to comply with its terms. This
  105. Agreement may only be modified in writing signed by an authorized officer of
  106. Grisoft.

  112. The list below contains the countries where AVG Free Edition can be used. To be
  113. eligible to download, install and use AVG Free Edition  you must live in one of
  114. them. If your country is not on the list, you are not allowed to use AVG 6.0
  115. Free Edition - you may download AVG Trial version instead.
