  4. NOTICE: THIS IS A CONTRACT.  BY INSTALLING AND USING THIS SOFTWARE,
  5. YOU ARE AGREEING TO BE BOUND BY ALL THE TERMS AND CONDITIONS OF THIS
  6. AGREEMENT.  PLEASE READ CAREFULLY BEFORE PROCEEDING.  IF YOU DO NOT
  7. AGREE TO THESE TERMS, PROMPTLY DESTROY ALL COPIES OF THE SOFTWARE IN
  8. YOUR POSSESSION.

  10. EVALUATION LICENSE
  11.  
  12. Vision7 Software grants you a non-exclusive license to use
  13. TrackFast(tm) tracking software ("the Software") free of charge 
  14. for a period of 30 days ("the Evaluation Period") for the purpose 
  15. of evaluating whether to purchase a license for continued use of 
  16. the Software.
  17.  
  18. If you use this software after the 30-day evaluation period a 
  19. registration fee of US$30 is required.  Registration is available 
  20. through PalmPilotGear HQ at http://www.pilotgear.com.  When payment is 
  21. received you  will be sent a registration code which can be 
  22. entered into the TrackFast registration form accessed from the
  23. About TrackFast menu item or the Evaluation Timeout screen. One 
  24. registered copy of TrackFast tracking software may only be used 
  25. by a single person on one Palm Computing(R) Platform device. The
  26. registration code is based on the Palm(tm) device user name, so a new
  27. registration code is required for each device.

  30. GRANT

  32. On payment of applicable license fees, Vision7 Software will
  33. grant to you a non-exclusive license to use the Software and
  34. Documentation as laid forth below.
  35.  
  36. SCOPE OF GRANT
  37.  
  38. You may:
  39.  - use the Software on any single computer or device;
  40.  - make as many copies of the software and documentation as you wish,
  41.    provided that any copy must contain all of the original Software's 
  42.    proprietary notices;
  43.  - give exact copies of the original evaluation version to anyone;
  44.    and distribute the evaluation version of the software and documentation 
  45.    in its unmodified form via electronic means.
  46.  
  47. You may not:
  48.  - permit other individuals to use the Software except under the
  49.    terms listed above;
  50.  - permit concurrent use of the registered version of the Software without
  51.    payment of the applicable license fees;
  52.  - modify, translate, reverse engineer, decompile, disassemble or
  53.    create derivative works based on the Software;
  54.  - copy the Software other than as specified above;
  55.  - rent, lease, grant a security interest in, or otherwise transfer
  56.    rights to the Software; or
  57.  - remove any proprietary notices or labels on the Software.

  59. DISTRIBUTION
  60.  
  61. Copies of the software may be distributed for evaluation purposes
  62. only in accordance with the following terms:
  63.  
  64. Distribution is permitted only for the whole software package
  65. without any modifications.  All accompanying files must be included.
  66. You are specifically prohibited from charging or requesting
  67. donations for any such copies without prior written permission.

  69. WARRANTY DISCLAIMER

  71. THE SOFTWARE IS PROVIDED "AS IS," AND WITHOUT ANY WARRANTY, EXPRESS
  72. OR IMPLIED, AS TO NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR
  73. ANY PARTICULAR PURPOSE.

  78. This agreement shall be interpreted, construed and governed in
  79. accordance with the laws of the State of Arizona, U.S.A.
