  12. Electronic End User License Agreement
  13. for AcidFreecell

  15. Notice to user:
  16. This is a contract. By installing this software you accept all the
  17. terms and conditions of this agreement.
  18.  
  19. This Red Mercury, LLC ("Red Mercury") End User License Agreement
  20. accompanies the AcidFreecell product ("Software"). The term "Software"
  21. also shall include any upgrades, modified versions or updates of the
  22. Software licensed to you by Red Mercury. Please read this Agreement
  23. carefully. If you do not wish to accept this Agreement, you may not
  24. install the Software on a PalmPilot or compatible device, simulator,
  25. emulator, or otherwise execute the Software or make use of its content.
  26. Usage of this software implies consent to the terms of this Agreement.

  28. 1. Use of the Software
  29. You may install the Software on PalmPilot or compatible devices.
  30. You may make and distribute copies of the Software (not including
  31. copies for commercial distribution). Each copy that you distribute
  32. must contain this Agreement and the same copyright and other
  33. proprietary notices pertaining to this Software. You may transmit
  34. copies of the Software between PalmPilot or compatible devices.
  35. You may not distribute modified versions of this Software. You may
  36. offer unmodified versions of this Software for download. You may
  37. not charge a fee for the Software. You may not offer the Software
  38. for download from a page with advertising or other revenue generating
  39. mechanism without written permission from Red Mercury. If you purchase
  40. the Software, you are granted the right to use the Software on one
  41. PalmPilot or compatible device. If you do not purchase the Software,
  42. you may use the software during the Trial Period as enforced by
  43. the original and unmodified Software. You may not use the Software
  44. beyond the Trial Period without purchasing the Software. The Trial
  45. Period will be the shorter of 15 days or the period enforced by the
  46. Software.

  48. 2. Copyright. The Software is owned by Red Mercury
  49. and its structure, organization and code are the valuable trade secrets
  50. of Red Mercury. The Software also is protected by United States
  51. Copyright Law and International Treaty provisions. This Agreement
  52. does not grant you any intellectual property rights in the Software.

  54. 3. Restrictions. You agree not to modify, adapt, translate, reverse
  55. engineer, decompile, disassemble or otherwise attempt to discover the
  56. source code of the Software.

  58. 4. No Warranty. The Software is being delivered to you AS IS and
  59. Red Mercury makes no warranty as to its use or performance. RED MERCURY
  60. DOES NOT AND CANNOT WARRANT THE PERFORMANCE OR RESULTS YOU MAY OBTAIN
  61. BY USING THE SOFTWARE OR DOCUMENTATION. RED MERCURY MAKES NO WARRANTIES,
  62. EXPRESS OR IMPLIED, AS TO NONINFRINGEMENT OF THIRD PARTY RIGHTS,
  63. MERCHANTABILITY, OR FITNESS FOR ANY PARTICULAR PURPOSE. IN NO EVENT WILL
  64. RED MERCURY BE LIABLE TO YOU FOR ANY CONSEQUENTIAL, INCIDENTAL OR
  65. SPECIAL DAMAGES, INCLUDING ANY LOST PROFITS OR LOST SAVINGS, EVEN IF
  66. A RED MERCURY REPRESENTATIVE HAS BEEN ADVISED OF THE POSSIBILITY OF
  67. SUCH DAMAGES, OR FOR ANY CLAIM BY ANY THIRD PARTY. Some states or
  68. jurisdictions do not allow the exclusion or limitation of incidental,
  69. consequential or special damages, or the exclusion of implied
  70. warranties or limitations on how long an implied warranty may last, so
  71. the above limitations may not apply to you.

  73. 5. Governing Law and General Provisions. The Agreement will be governed
  74. by the laws of the State of Illinois, U.S.A. This Agreement will not
  75. be governed by the United Nations Convention on Contracts for the
  76. International Sale of Goods, the application of which is expressly
  77. excluded. If any part of this Agreement is found void and unenforceable,
  78. it will not affect the validity of the balance of the Agreement, which
  79. shall remain valid and enforceable according to its terms. You agree
  80. that the Software will not be transferred or exported into any country
  81. or used in any manner prohibited by the United States Export
  82. Administration Act or any other export laws, restrictions or regulations.
  83. This Agreement shall automatically terminate upon failure by you to
  84. comply with its terms. This Agreement may only be modified in writing
  85. signed by an authorized officer of Red Mercury.
