  48. [1] DEFINITIONS: "Program" means Nebula Fighter and its related files,
  49. including this one.

  51. [2] OWNERSHIP:  Except to the extent expressly licensed, One Reality owns and
  52. reserves the exclusive right to distribute the Program, and to use the
  53. Trademarks in connection with it.  Its content, layout and format are the
  54. property of One Reality and Holodream Software to the extent permitted by law.

  56. [3] GRANT AND CONDITIONS:  One Reality grants a non-exclusive license
  57. to distribute the Program on IBM compatible media under the
  58. Trademarks subject to the following conditions:

  60.  [A] CONDITIONS FOR ALL DISTRIBUTION

  62.   [1] All of the Program's files, including this one, as
  63.         released by One Reality must be included without modification.
  64.      
  65.   [2] No copyright or trademark information may be removed.

  67.   [3] You must not [a] distribute any version of the Program
  68.         with unauthorized changes, such as additional or different
  69.         levels, or changed characters or mazes; or
  70.         [b] characterize such versions as an "add-on" or
  71.         "extension" of any One Reality product; or [c] distribute any
  72.         unauthorized third party utility designed to alter any
  73.         One Reality game, game level, game episode or saved game.

  75.  [B] ADDITIONAL CONDITIONS IF YOU CHARGE:  
  76.         If your distribution involves a disk or other physical medium, you
  77.         must also:

  79.   [1] Clearly market the Program as shareware, which requires
  80.         (among other things) using "try before you buy" or similar
  81.         words on packaging for the Program.
  82.  
  83.   [2] Include the "One Reality" logo on the front cover of the package.
  84.  
  85.   [3] Include the your name/company name, address and phone number on the
  86.       packaging and in any added documentation.  This can be
  87.       imprinted on the package or may be in the form of a label
  88.       affixed to the box, carton or folder.

  90.   [4] Any description of the Program included in a re-sellers
  91.       catalog, sales brochure, on special packaging or handouts,
  92.       must include "A One Reality Game", "Released by One Reality" or
  93.       "Published by One Reality" if the word count of the description
  94.       is more than 14 words in length.

  96.   [5] Distribute copies only after the programs on newly created
  97.       master diskettes have been thoroughly tested.  Always use
  98.       high quality media and duplication technology.
  99.  
  100.   [6] Try to sell only the most current version of the Program.

  102.   [7] You may add an installation routine if it does not interfere with the
  103.       proper operation or installation of the Program.  However, if you do add an
  104.       installation routine you must provide technical support or supply the users
  105.       with a way to get technical support for any problems that a user may have
  106.       during the installation process.  One Reality will not support any "add on
  107.       routines".

  109.   [8] Program updates, recommended descriptions and "screen
  110.       shots" will be provided upon request, and are available on
  111.       the One Reality world wide web page.

  113. [4] TERM:  Unless terminated for cause, your grants under this
  114. VENDOR.DOC terminate 30 days after you receive written notice,
  115. or such longer period as the notice may provide.  Following such
  116. termination, you may distribute the Program only until the
  117. earlier of 60 days after the termination date in the notice, or
  118. distribution of the copies you have in stock.  Sections [2],
  119. [5], and [6] survive termination.

  121. [5] LIMITED WARRANTY AND LIMITATION OF REMEDIES: If One Reality
  122. provides a physically defective copy of the Program, One Reality
  123. will replace it upon submission of the defective one.  Aside from
  124. this, the Program IS PROVIDED "AS-IS", AND NO WARRANTIES OF ANY
  125. KIND (INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS
  126. FOR A PARTICULAR PURPOSE), EXPRESS OR IMPLIED, ARE MADE AS TO IT
  127. OR ANY MEDIUM IT MAY BE ON.  OUR ENTIRE LIABILITY AND YOUR
  128. EXCLUSIVE REMEDY IS SUCH REPLACEMENT, AND UNDER NO CIRCUMSTANCES
  129. WILL WE PROVIDE ANY OTHER REMEDY FOR DIRECT, INDIRECT, SPECIAL,
  130. CONSEQUENTIAL, PUNITIVE, INCIDENTAL OR OTHER DAMAGES ARISING
  131. FROM IT, INCLUDING SUCH FROM NEGLIGENCE, STRICT LIABILITY, OR
  132. BREACH OF WARRANTY OR CONTRACT, EVEN AFTER NOTICE OF THE
  133. POSSIBILITY OF SUCH DAMAGES.

  135. [6] MISCELLANY

  137.  [A] Since we would be irreparably damaged if Section [3], [4]
  138. or [6][D] were not specifically enforced, we will be entitled
  139. without bond, other security or proof of damages, to appropriate
  140. equitable remedies with respect to breaches of such sections, in
  141. addition to such other remedies as we may have.

  143.  [B] You will hold us, our partners, contractors, employees and
  144. agents harmless from damage, loss and expense arising directly
  145. or indirectly from your acts and omissions in copying and
  146. distributing the Program, including from any installation
  147. routine that you may add.

  149.  [C] With respect to every matter arising under this, you
  150. consent to the exclusive jurisdiction and venue of the state and
  151. federal courts sitting in Rockwall, Texas, and to service by
  152. certified mail, return receipt requested, or as otherwise
  153. permitted by law.

  155.  [D] You will not modify, reverse compile, disassemble, or
  156. reverse engineer the Program, or use or disclose any
  157. confidential information that it contains.
