  13. IMPORTANT- PLEASE READ CAREFULLY: BY INSTALLING THE SOFTWARE (AS 
  14. DEFINED BELOW), COPYING THE SOFTWARE AND/OR CLICKING ON THE "ACCEPT" 
  15. BUTTON BELOW, YOU (EITHER ON BEHALF OF YOURSELF AS AN INDIVIDUAL OR 
  16. ON BEHALF OF AN ENTITY AS ITS AUTHORIZED REPRESENTATIVE) AGREE TO ALL 
  17. OF THE TERMS OF THIS END USER LICENSE AGREEMENT ("AGREEMENT") 
  18. REGARDING YOUR USE OF THE SOFTWARE.  IF YOU DO NOT AGREE WITH ALL OF 
  19. THE TERMS OF THIS AGREEMENT, CLICK ON THE "NO" BUTTON AND/OR DO NOT 
  20. INSTALL, COPY OR OTHERWISE USE THE SOFTWARE.

  24. 1. GRANT OF LICENSE: Subject to the terms below, ANONYMIZER, INC. 
  25. ("ANONYMIZER") hereby grants you a non-exclusive, non-transferable 
  26. license to install and to use the downloadable version of Anonymizer 
  27. Privacy Switch ("Software").

  31. Your license is free to you for the term of the Agreement and you 
  32. may: (i) install and use the Software on one or more computers for 
  33. your personal, internal use; and (ii) copy the Software for back-up 
  34. or archival purposes.

  38. This license does not imply any right to use or subscription to any 
  39. Anonymizer services or subscriptions.
  40.

  42.  
  43. Whether you are licensing the Software as an individual or on behalf 
  44. of an entity, you may not:
  45.  
  46. (i) reverse engineer, decompile, or disassemble the Software;
  47.  
  48. (ii) modify, or create derivative works based upon, the Software in 
  49. whole or in part;
  50.  
  51. (iii) distribute copies of the Software;
  52.  
  53. (iv) remove any proprietary notices or labels on the Software; or
  54.  
  55. (v) resell, lease, rent, transfer, sublicense, or otherwise transfer 
  56. rights to the Software.

  60. 2. TITLE: You acknowledge that no title to the intellectual property 
  61. in the Software is transferred to you. Title, ownership, rights, and 
  62. intellectual property rights in and to the Software shall remain in 
  63. ANONYMIZER. The Software is protected by copyright and patent laws of 
  64. the United States and international treaties.

  68. 3. UPDATES.  From time to time, ANONYMIZER may make available updates 
  69. to the software. You may download and install or otherwise use those 
  70. updates to the software that are released by ANONYMIZER within one 
  71. year of software registration date.  You must complete the product 
  72. registration form during software installation to be notified of 
  73. software updates.  All updates to the Software are governed by this 
  74. Agreement, unless other license terms are provided with the update.

  78. 4. DISCLAIMER OF WARRANTY: The Software is provided to you at no, or 
  79. minimal charge. YOU AGREE THAT ANONYMIZER HAS MADE NO EXPRESS 
  80. WARRANTIES, ORAL OR WRITTEN, TO YOU REGARDING THE PRODUCTS AND THAT 
  81. THE PRODUCTS ARE BEING PROVIDED TO YOU "AS IS" WITHOUT WARRANTY OF 
  82. ANY KIND. ANONYMIZER DISCLAIMS ANY AND ALL OTHER WARRANTIES, WHETHER 
  83. EXPRESSED, IMPLIED, OR STATUTORY, INCLUDING, BUT WITHOUT LIMITATION, 
  84. THE IMPLIED WARRANTIES OF NONINFRINGEMENT OF THIRD PARTY RIGHTS, 
  85. MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. ANONYMIZER 
  86. SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, COVER, 
  87. RELIANCE, OR CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, 
  88. LOSS OF ANTICIPATED PROFIT) ARISING FROM ANY CAUSE UNDER OR RELATED 
  89. TO THIS AGREEMENT.

  93. 5. LIMITATION OF LIABILITY: You must assume the entire risk of using 
  94. the program. IN NO EVENT SHALL ANONYMIZER BE LIABLE TO YOU FOR ANY 
  95. DAMAGES, INCLUDING ANY LOST PROFITS, LOST SAVINGS, OR OTHER 
  96. INCIDENTAL, INDIRECT OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING OUT 
  97. OF THE USE OF THE ANONYMIZER SOFTWARE, EVEN IF ANONYMIZER HAS BEEN 
  98. ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL 
  99. ANONYMIZER' LIABILITY FOR ANY CLAIM, WHETHER IN CONTRACT, TORT, OR 
  100. ANY OTHER THEORY OF LIABILITY, EXCEED THE LICENSE FEE PAID BY YOU, 
  101. PROVIDED, HOWEVER, IF THE RELEVANT PRODUCT WAS PROVIDED TO YOU AT NO 
  102. CHARGE YOU AGREE ANONYMIZER SHALL NOT BE LIABLE TO YOU FOR ANY 
  103. DAMAGES. THIS LIMITATION SHALL APPLY TO CLAIMS OF PERSONAL INJURY TO 
  104. THE EXTENT PERMITTED BY LAW.

  108. 6. TERMINATION: This Agreement shall terminate automatically if you 
  109. fail to comply with the limitations described in this Agreement, or 
  110. if you are licensing the Software on behalf of an entity and do not 
  111. elect to continue the license following the expiration of the 
  112. introductory period or you do not renew any one (1) year license with 
  113. ANONYMIZER. No notice shall be required from ANONYMIZER to effect 
  114. such termination. Upon termination, except for failure to renew, you 
  115. must uninstall and destroy all copies of the Software.

  119. 7. MISCELLANEOUS:

  123. Severability.

  125. In the event of invalidity of any provision of this Agreement, the 
  126. parties agree that such invalidity shall not affect the validity of 
  127. the remaining portions of this Agreement.

  131. Export.

  133. You agree that you will not export or re-export the Software outside 
  134. of the jurisdiction in which you obtained it without the appropriate 
  135. United States or foreign government licenses.

  139. Governing Law.

  141. This Agreement will be governed by the laws of the State of 
  142. California as they are applied to agreements between California 
  143. residents entered into and to be performed entirely within 
  144. California. The United Nations Convention on Contracts for the 
  145. International Sale of Goods is specifically disclaimed.

  149. Entire Agreement.

  151. You agree that this is the entire agreement between you and 
  152. ANONYMIZER, which supersedes any prior agreement, whether written or 
  153. oral, and all other communications between ANONYMIZER and you 
  154. relating to the subject matter of this Agreement.

  158. Reservation of rights.

  160. All rights not expressly granted in this Agreement are reserved by ANONYMIZER.
