Cogito End-User Agreement
PLEASE READ THE FOLLOWING CAREFULLY BEFORE USING THIS PRODUCT (INCLUDING THE SOFTWARE AND ACCOMPANYING WORKBOOK AND OTHER MATERIALS) (THE "PRODUCT"). BY USING THE PRODUCT, YOU ARE AGREEING TO ACCEPT THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT ACCEPT THOSE TERMS AND CONDITIONS, PLEASE RETURN THE PRODUCT (INCLUDING ANY COPIES) TO THE PLACE OF PURCHASE WITHIN 15 DAYS OF PURCHASE FOR A FULL REFUND.
LIMITATIONS ON USE
Cogito Learning Media, Inc. ("Cogito") licenses the Product to you only for use on a single computer with a single CPU. You may use the Product only on a stand-alone basis, such that the Product and the user interface and functions of the Product are accessible only to a person physically present at the location of the computer on which the Product is loaded. You may not lease the Product, display or perform the Product publicly, or allow the Product to be accessed remotely or transmitted through any network or communication link. You own the CD-ROM or other media on which the Product is recorded, but Cogito and its licensors retain all title to and ownership of the Product and reserve all rights not expressly granted to you.
You may not copy all or any portion of the Product, except as an essential step in the use of the Product as expressly authorized in the documentation included in the Product. You may transfer your license to the Product, provided that (a) you transfer all portions of the Product (including any copies), and (b) the transferee reads and agrees to be bound by the terms and conditions of this agreement. Except to the extent expressly permitted by the laws of the jurisdiction where you are located, you may not decompile, disassemble or otherwise reverse engineer the Product.
LIMITED WARRANTY
Cogito warrants that, for a period of 90 days after purchase by you (or such other period as may be expressly required by applicable law) ("Warranty Period"), (a) the Product will provide substantially the functionality described in the documentation included in the Product, if operated as specified in that documentation, and (b) the CD-ROM or other media on which the Product is recorded will be free from defects in materials and workmanship. Your sole remedy, and Cogito's sole obligation, for breach of the foregoing warranties is for Cogito to provide you with a replacement copy of the Product or, at Cogito's option, for Cogito to refund the amount paid for the Product.
EXCEPT FOR THE FOREGOING, THE PRODUCT IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Among other things, Cogito does not warrant that the functions contained in the Product will meet your requirements, or that operation of the Product or information contained in the Product will be error-free. This agreement gives you specific legal rights, and you may also have other rights which vary from state to state. Some states do not allow the exclusion of implied warranties, so the above exclusion may not apply to you. Any implied warranties will be limited to the Warranty Period, except that some states do not allow limitations on how long an implied warranty lasts, so this limitation may not apply to you.
LIMITATION OF LIABILITY
In no event will Cogito be liable for any indirect, incidental, special or consequential damages or for any lost profits, lost savings, lost revenues or lost data arising from or relating to the Product, even if Cogito has been advised of the possibility of such damages. In no event will Cogito's liability to you or any other person exceed the amount paid by you for the Product regardless of the form of the claim. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. Also, this limitation will not apply to liability for death or personal injury to the extent applicable law prohibits such limitation.
GENERAL
This agreement is governed by the laws of the State of California without reference to its choice-of-law rules. This agreement is the entire agreement between you and Cogito and supersedes any other understandings or agreements. If any provision of this agreement is deemed invalid or unenforceable by any court or government agency having jurisdiction, that particular provision will be deemed modified to the extent necessary to make the provision valid and enforceable, and the remaining provisions will remain in full force and effect. This product is made available in accordance with the accompanying license agreement, and use of the product is subject to the terms and conditions of that agreement. This product may not be used, and no copies of all or any portion of this product may be made, except as expressly authorized by that agreement.

Following are the instructions to install this Electronic Companion on any Macintosh. You need about 5Mb of free hard drive space for the installation.
(1) Insert the product CD-ROM.
(2) Double-click the Install icon
(3) Choose the Easy Install option if you have a 68K Macintosh with at least 8 Mb of RAM or a PowerPC with at least 12 Mb of RAM. If you want to run the product on the minimum platform configuration switch to Custom Install in the top left corner and select the Minimum Platform Install option.
(4) Restart your Computer
What did the installer add to your Computer?
The installer copies the Electronic Companion application, the Director_4.0 file, SimpleText, and this Installation Guide into a folder you specified or on your hard drive. The following files are copied if you did not already have them, or if you had older versions: Quicktime¬ 2.5 extension (System Folder:Extensions), Quicktime¬ Powerplug (System Folder:Extensions), ATM¬ 3.8.3 (System Folder:Control Panels), Neue Helvetica 2 (System Folder:Fonts), HelveNeuBol (System Folder:Fonts), HelveNeuBolItl (System Folder:Fonts).
Note: A SimpleText file called "Installer Log File" will itemize the exact actions of the installer. It will be saved on your hard drive.
