  1. BY CLICKING ON THE "ACCEPT" BUTTON OR BY EXECUTING THE
  2. APPLICATION, YOU ARE CONSENTING TO BE BOUND BY THIS 
  3. AGREEMENT.  IF YOU DO NOT AGREE TO ALL OF ITS TERMS , 
  4. CLICK THE "DO NOT ACCEPT" BUTTON AND THE INSTALLATION 
  5. WILL NOT CONTINUE.  YOU MAY RETURN THE PRODUCT TO 
  6. TERRAPIN INTERNET FOR A FULL REFUND.

  8. This Agreement has 3 parts.  Part I applies if you have 
  9. not purchased a license to the accompanying Software.  
  10. Part II applies if you have purchased a license to the 
  11. Software.  Part III applies to both of the above cases.  
  12.  
  13. This agreement will not apply should corporate or other
  14. printed licenses have been provided to you by Terrapin Internet
  15.  
  16.  
  17. PART I -- TERMS APPLICABLE WHEN LICENSE FEES NOT YET 
  18.           PAID.
  19.  
  20. SCOPE OF LICENSE
  21. ----------------
  22. Terrapin Internet grants you a license to use the software for
  23. evaluation purposes.  Evaluation purposes shall include
  24. activities which may reasonably be viewed as assisting
  25. you to determine whether to purchase a full license.
  26. Evaluation purposes shall specifically exclude use of
  27. the software to create permanent records or records 
  28. for general distribution and any activity which may lead
  29. to profit drectly or otherwise.
  30.  
  31. On completion of your evaluation, should you decide not
  32. to purchase a full license, you must remove the software
  33. and any files created with it from all computers on
  34. which it is loaded.
  35.  
  36. The period required for evaluation will normally be treated
  37. as 30 days.  If you require a longer period to evaluate
  38. the software then you should seek the written permission
  39. of Terrapin Internet.

  41.  
  42. COPIES AND REDISTRIBUTION
  43. -------------------------
  44. You may freely distribute the software to any third-
  45. party as long as the distribution media includes all
  46. software components and files included in the 
  47. distribution to yourself specifically including
  48. this license agreement.  You may NOT make any charge
  49. for the distribution, other than costs of preparing
  50. the distribution media.  
  51.  
  52. You may NOT pass off copyright of the software or any 
  53. component of distribution as belonging to any body other
  54. than Terrapin Internet.  You may NOT distribute any registration 
  55. documents, codes or printed material provided either for 
  56. consideration or ex-gratis by Terrapin Internet to yourself.

  58.  
  59. NO WARRANTY
  60. -----------
  61. The software is provided "AS IS" without warranty of any 
  62. kind, express or implied.  Without limitation Terrapin Internet
  63. do not provide any representation of the software's 
  64. fitness for purpose or merchantability.  
  65. Use of the software is entirely at your own risk.

  69. PART II -- TERMS APPLICABLE WHEN LICENSE FEES PAID
  70.  
  71. The following terms shall apply from the date that Terrapin Internet
  72. receives payment in full for the software.

  75. SCOPE OF LICENSE
  76. ----------------
  77. Terrapin Internet Grant you a license: either to use the 
  78. software on a single computer for your own personal use 
  79. and on a second computer as long as only one copy of the 
  80. software is used at any one time :or to place the software
  81. on a network as long as each person having access to the 
  82. software on the network has been granted a paid license by 
  83. Terrapin Internet.

  86. COPIES AND REDISTRIBUTION
  87. -------------------------
  88. You may copy the software for archival purposes.  However you
  89. may not make any copy intended for distrubution to
  90. any third party.  
  91.  
  92. No component of license paid software including software,
  93. files, registration codes, and documentation may be
  94. distributed to any third party without Terrapin Internet's prior
  95. written consent.
  96.  
  97. Restrictions on distribution DO NOT APPLY to files generated
  98. using licese paid software. 
  99.  
  100. This license may be permanently transfered to a third party along with 
  101. the original distribution media, registration codes and 
  102. printed material are as long as all copies of the software
  103. and related files are removed from your computers. 
  104.  
  105.  
  106. LIMITED WARRANTY
  107. ----------------
  108. Terrapin Internet warrants that for a period of 90 days that the
  109. software will substantially perform the functions
  110. described in the documentation accompanying the distributed
  111. Software.  This warranty shall run from the date that
  112. full payment for the software license is received by Terrapin Internet.  Terrapin Internet does not warrant that your use of the 
  113. Software will be uninterrupted or that the operation of the 
  114. Software will be error-free or secure. 
  115.  
  116. Any breach of this warranty will be remedied at Terrapin Internet's
  117. discretion :either (i) by replacement of the
  118. distribution media :or (ii) by Terrapin Internet advising how to 
  119. achieve substantially the same functionality through 
  120. a different procedure :or (iii)  to refund the license fee 
  121. paid for the Software.  No other remedy will be considered.
  122.  
  123. This warranty will not apply should the software have been
  124. been used in a manner not directed by the documentation or
  125. where problems experienced can be demonstrated as relating
  126. to improper functioning of hardware, operating software or
  127. any other component residing on you system.
  128.  
  129. To gain relief under this warranty you must inform Terrapin Internet
  130. of your problem with the Software during the applicable
  131. warranty period and provide evidence of the date you purchased
  132. a license to the Software.

  135. PART III -- TERMS APPYING TO BOTH CASES
  136.  
  137. SCOPE
  138. -----
  139. You are not licensed to:
  140.  
  141. - modify, translate, reverse engineer, decompile,
  142.   or disassemble the software
  143.  
  144. - rent, lease, or grant a security interest in, the software
  145.   other than by permanent transfer of the license as descibed
  146.   above
  147.  
  148.  
  149. COPYRIGHT
  150. ---------
  151. The software, documentation, images and all other components
  152. of distribution are owned by Terrapin Internet and are protected under
  153. UK copyright laws and international treatise.  Title and related 
  154. rights in the content accessed through the Software is the 
  155. property of the applicable content owner and may be 
  156. protected by applicable law.  This License gives you no 
  157. rights to such content.  
  158.  
  159. TERMINATION.
  160. -----------
  161. The license will terminate automatically if you fail to 
  162. fully comply with the terms.  On termination, you must 
  163. destroy all copies of the Software and Documentation.

  166. LIMITATION OF LIABILITY
  167. -----------------------
  168. Under no circumstances shall Terrapin Internet or its suppliers
  169. be liable to you or any other body for any damages whatsoever 
  170. including, without limitation, incidental, direct, indirect,
  171. special and consequential damages, damages for loss of business
  172. profits, business interruption, loss of business information, 
  173. or other commercial loss arising from the use of the Software 
  174. even if Terrapin Internet have been informed of the possibility of loss.
