IMPORTANT--READ CAREFULLY: This Computer Game License Agreement ("Agreement") is a legal agreement between you and Ratbag Pty, Ltd. for the license of the Dirt Track Racing Australia(tm) Computer Game Demonstration Version ("Dirt Track Racing Australia"). Dirt Track Racing Australia is licensed to you under the terms of this Agreement; it is not sold. By installing, copying, playing or otherwise using Dirt Track Racing Australia, you agree to be bound by the terms of this Agreement. If you do not agree to the terms of this Agreement, do not install, copy, play or use Dirt Track Racing Australia, and promptly return all copies of Dirt Track Racing Australia to your place of purchase for a full refund.
LICENSE Dirt Track Racing Australia is protected by copyright laws and international copyright treaties, as well as other intellectual property laws and treaties. All title and copyrights in and to Dirt Track Racing Australia (including but not limited to any images, video, audio, music, and text incorporated into Dirt Track Racing Australia) and the accompanying user's manual are owned by Ratbag Pty, Ltd. Your license rights regarding the use of Dirt Track Racing Australia are described below unless otherwise indicated. All rights not expressly granted in this Agreement are reserved.
Limitations on Reverse Engineering, Decompilation, and Disassembly. You may not reverse engineer, decompile, or disassemble the object code for Dirt Track Racing Australia, except and only to the extent that such activity is expressly permitted by applicable law, notwithstanding this limitation.
Termination. Without prejudice to any other rights, Ratbag may terminate this Agreement if you fail to comply with its terms and conditions. In such event, you must destroy or return all copies of Dirt Track Racing Australia.
EXPORT RESTRICTIONS. You agree that you do not intend to and will not directly or indirectly, export or transmit Dirt Track Racing Australia or related documentation and technical data (or any part thereof) in any country to which such export or transmission is restricted by any applicable regulation or statute.
DISCLAIMER OF WARRANTY. THE SOFTWARE PRODUCT IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RATBAG AND ITS DISTRIBUTERS DISCLAIM ALL WARRANTIES, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE AND ANY WARRANTY AGAINST INFRINGEMENT, WITH REGARD TO DIRT TRACK RACING AUSTRALIA. THIS LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS. YOU MAY HAVE OTHERS, WHICH VARY FROM COUNTRY TO COUNTRY
CUSTOMER REMEDIES. RATBAG'S ENTIRE LIABILITY AND YOUR EXCLUSIVE REMEDY SHALL NOT EXCEED THE PRICE PAID FOR THE SOFTWARE PRODUCT.
NO LIABILITY FOR DAMAGES. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RATBAG OR ITS DISTRIBUTERS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE DIRT TRACK RACING AUSTRALIA, EVEN IF RATBAG HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
MISCELLANEOUS
If you acquired this product in the United States, this EULA is governed by the laws of the State of New York. If this product was acquired outside the United States, then local law may apply.
