  1. LICENSE AGREEMENT
  2. -----------------
  3. THIS IS AN EVALUATION COPY OF THE SOFTWARE. YOU MAY
  4. ONLY USE THE SOFTWARE FOR THIRTY DAYS. 
  5.  
  6. After thirty days, you must either buy the software 
  7. from McAfee Software, Inc. or remove it from your 
  8. computer and stop using it. If you are evaluating 
  9. the software for corporate use and need longer than 
  10. thirty days, please contact McAfee to arrange
  11. an extended evaluation.
  12.  
  13. THERE ARE NO WARRANTY RIGHTS GRANTED TO YOU REGARDING
  14. THE SOFTWARE.
  15.  
  16. YOUR RIGHT TO USE THIS SOFTWARE IS LIMITED. If you
  17. have already downloaded evaluation copies of this
  18. or prior versions of the software, you are not allowed
  19. to use this software, and you must immediately cease
  20. use of this copy and destroy it. To obtain full-use
  21. rights, you must register and pay for the product 
  22. with McAfee Software, Inc.  
  23.  
  24. NOTICE TO USERS: CAREFULLY READ THE FOLLOWING LEGAL 
  25. AGREEMENT. USE OF THE SOFTWARE PROVIDED WITH THIS 
  26. AGREEMENT (THE "SOFTWARE") CONSTITUTES YOUR ACCEPTANCE
  27. OF THESE TERMS. IF YOU DO NOT AGREE TO THE TERMS OF
  28. THIS AGREEMENT, PROMPTLY REMOVE THE SOFTWARE TOGETHER
  29. WITH ALL COPIES FROM YOUR COMPUTER. USER'S USE OF THIS
  30. SOFTWARE IS CONDITIONED UPON COMPLIANCE BY USER WITH
  31. THE TERMS OF THIS AGREEMENT. THE SOFTWARE MAY BE
  32. EVALUATED FOR THIRTY (30) DAYS ON A ROYALTY-FREE BASIS.
  33. CONTINUED USE AFTER EVALUATION IS CONDITIONED UPON PAYMENT.

  35. 1.  LICENSE GRANT. McAfee Software, Inc. ("McAFEE") and
  36.     its suppliers grant to you a non-exclusive, 
  37.     non-transferable right to use the SOFTWARE for thirty
  38.     (30) days for the purpose of your evaluation of the
  39.     SOFTWARE. This license to use the SOFTWARE is
  40.     conditioned upon your compliance with the terms of this
  41.     license agreement. You agree you will only copy the
  42.     SOFTWARE into any machine-readable or printed form as
  43.     necessary to use it in accordance with this license or
  44.     for backup purposes in support of your use of the
  45.     SOFTWARE. You may:
  46.  
  47.       (i) UPLOAD THIS SOFTWARE TO ANY ELECTRONIC BULLETIN
  48.           BOARD OR
  49.       (ii) DEMONSTRATE THE SOFTWARE AND ITS CAPABILITIES.  
  50.  
  51.     THE FOREGOING DOES NOT APPLY TO ANY SOFTWARE BUNDLED
  52.     WITH A McAFEE PRODUCT BUT NOT MANUFACTURED BY McAFEE.
  53.     YOU MAY NOT REPRODUCE OR DISTRIBUTE THE SOFTWARE FOR
  54.     RESALE OR OTHER COMMERCIAL PURPOSES, INCLUDING WITHOUT
  55.     LIMITATION THE BUNDLING OF THIS SOFTWARE WITH ANY
  56.     PRODUCT THAT IS OFFERED FOR SALE.
  57.  
  58.     This license is effective until the thirtieth (30th)
  59.     day following the date you installed the SOFTWARE.
  60.     At that time, you must cease use of the SOFTWARE and
  61.     remove it from your computer, unless you have paid
  62.     the current registration fee. You may terminate this 
  63.     agreement at any point by destroying the SOFTWARE 
  64.     together with all copies of the SOFTWARE. Also, McAFEE 
  65.     has the option to terminate if you fail to comply with
  66.     any term or condition of this agreement. You agree
  67.     upon such termination to destroy the SOFTWARE
  68.     together with all copies of the SOFTWARE.
  69.  
  70. 2.  COPYRIGHT. The SOFTWARE is protected by United States 
  71.     copyright law and international treaty provisions.
  72.     You acknowledge that no title to the intellectual
  73.     property in the SOFTWARE is transferred to you. You
  74.     further acknowledge that title and full ownership
  75.     rights to the SOFTWARE will remain the exclusive
  76.     property of McAFEE or its suppliers, and you will not
  77.     acquire any rights to the SOFTWARE except as expressly
  78.     set forth in this license. You agree that any copies
  79.     of the SOFTWARE will contain the same proprietary
  80.     notices which appear on and in the SOFTWARE.

  82. 3.  REVERSE ENGINEERING. You agree that you will not
  83.     attempt to reverse compile, modify, translate, or
  84.     disassemble the SOFTWARE in whole or in part.
  85.  
  86. 4.  WARRANTY RIGHTS. As this is an evaluation copy,
  87.     McAFEE and its suppliers make NO WARRANTIES with respect
  88.     to the SOFTWARE. The SOFTWARE is distributed to you AS
  89.     IS, WHERE IS, AND WITH ALL FAULTS. In the event of
  90.     registration, McAFEE will grant you certain warranty
  91.     rights.

  93. 5.  NO OTHER WARRANTIES. McAFEE AND ITS SUPPLIERS DO NOT
  94.     WARRANT THAT THE SOFTWARE IS ERROR FREE. McAFEE AND ITS
  95.     SUPPLIERS DISCLAIM ALL WARRANTIES WITH RESPECT TO THE
  96.     SOFTWARE, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT
  97.     LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS
  98.     FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT OF 
  99.     THIRD-PARTY RIGHTS.

  101.     SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF
  102.     IMPLIED WARRANTIES OR LIMITATIONS ON HOW LONG AN
  103.     IMPLIED WARRANTY MAY LAST, OR THE EXCLUSION OR
  104.     LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES,
  105.     SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY
  106.     TO YOU. THIS LICENSE GIVES YOU SPECIFIC LEGAL RIGHTS.
  107.     YOU ALSO MAY HAVE OTHER RIGHTS THAT VARY FROM
  108.     JURISDICTION TO JURISDICTION.
  109.  
  110. 6.  SEVERABILITY. In the event of invalidity of any
  111.     provision of this license, the parties agree that
  112.     such invalidity shall not affect the validity of
  113.     the remaining portions of this license.
  114.  
  115. 7.  NO LIABILITY FOR CONSEQUENTIAL DAMAGES. IN NO EVENT
  116.     SHALL McAFEE OR ITS SUPPLIERS BE LIABLE TO YOU FOR
  117.     ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR INDIRECT
  118.     DAMAGES OF ANY KIND ARISING OUT OF THE DELIVERY,
  119.     PERFORMANCE, OR USE OF THE SOFTWARE, EVEN IF McAFEE HAS
  120.     BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN
  121.     NO EVENT WILL McAFEE'S LIABILITY FOR ANY CLAIM,
  122.     WHETHER IN CONTRACT, TORT, OR ANY OTHER THEORY OF
  123.     LIABILITY, EXCEED THE LICENSE FEE PAID BY YOU, IF ANY.
  124.  
  125. 8.  GOVERNING LAW. This license will be governed by the
  126.     internal laws of the State of California. The United
  127.     Nations Convention on Contracts for the International
  128.     Sale of Goods is specifically disclaimed.
  129.  
  130. 9.  ENTIRE AGREEMENT. This is the entire agreement between
  131.     you and McAFEE, which supersedes any prior agreement
  132.     or understanding, whether written or oral, relating
  133.     to the subject matter of this license.
  134.  
  135. U.S. GOVERNMENT RESTRICTED RIGHTS
  136. Any distribution or license of the SOFTWARE to the U. S.
  137. Government or its agencies or instrumentalities
  138. (the "GOVERNMENT") is made only with RESTRICTED RIGHTS.
  139. Use, duplication, or disclosure by the GOVERNMENT
  140. is subject to restriction as set forth in subparagraph
  141. (c) (1) (ii) of the Rights in Technical Data and Computer
  142. Software clause at DFAR 252.227-7013, or as set forth
  143. in the particular department or agency regulations or
  144. rules that provide McAFEE protection equivalent to or
  145. greater than the above-cited clause.
