This End-User License Agreement ("EULA") is a legal agreement between you (either an individual or a single entity) and the MGSsareware, author of this Software for the SOFTWARE PRODUCT identified above.
By installing, copying, or otherwise using the SOFTWARE PRODUCT, you agree to be bound by the terms of this EULA. If you do not agree to the terms of this EULA, do not install, use or distribute the SOFTWARE PRODUCT.

You should carefully read the following terms and conditions before using this software. Your use of this software indicates your acceptance of this license agreement and warranty.
1. LICENSE GRANT. MGShareware grants you a non-exclusive license to use the executable code version of the Product. This Agreement will also govern any software upgrades provided by MGShareware that replace and/or supplement the original SOFTWARE PRODUCT, unless such upgrades are accompanied by a separate license, in which case the terms of that license will govern.
2. TERMINATION. If you breach this Agreement your right to use the Product will terminate immediately and without notice, but all provisions of this Agreement except the License Grant (Paragraph 1) will survive termination and continue in effect. Upon termination, you must destroy all copies of the Product.
3. DISCLAIMER OF WARRANTY. THE PRODUCT IS PROVIDED "AS IS" WITH ALL FAULTS. TO THE EXTENT PERMITTED BY LAW, MGShareware AND MGShareware'S DISTRIBUTORS, LICENSORS HEREBY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES THAT THE PRODUCT IS FREE OF DEFECTS, MERCHANTABLE, FIT FOR A PARTICULAR PURPOSE AND NON-INFRINGING. YOU BEAR ENTIRE RISK AS TO SELECTING THE PRODUCT FOR YOUR PURPOSES AND AS TO THE QUALITY AND PERFORMANCE OF THE PRODUCT. THIS LIMITATION WILL APPLY NOTWITHSTANDING THE FAILURE OF ESSENTIAL PURPOSE OF ANY REMEDY. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF IMPLIED WARRANTIES, SO THIS DISCLAIMER MAY NOT APPLY TO YOU.
4. LIMITATION OF LIABILITY. EXCEPT AS REQUIRED BY LAW, MGShareware AND ITS DISTRIBUTORS, DIRECTORS, LICENSORS, CONTRIBUTORS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES ARISING OUT OF OR IN ANY WAY RELATING TO THIS AGREEMENT OR THE USE OF OR INABILITY TO USE THE PRODUCT, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, LOST PROFITS, LOSS OF DATA, AND COMPUTER FAILURE OR MALFUNCTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND REGARDLESS OF THE THEORY (CONTRACT, TORT OR OTHERWISE) UPON WHICH SUCH CLAIM IS BASED. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES, SO THIS EXCLUSION AND LIMITATION MAY NOT APPLY TO YOU.
5. DISTRIBUTION. The SOFTWARE PRODUCT may not be sold or be included in a product or package which intends to receive benefits through the inclusion of the SOFTWARE PRODUCT. The SOFTWARE PRODUCT may be included in any free or non-profit packages or products providing that it is distributed in its original binary form (setup package).
6. THIRD PARTY SOFTWARE. If SOFTWARE PRODUCT is bundled with or otherwise provided with any third party and you choose to use such third party software, then your use will be governed by the third party license agreement provided with such software. MGShareware is not responsible for any third party's software and shall have no liability for your use of third party software.
7. PRIVACY AND USE OF INFORMATION. MGShareware does not collect any personally identifiable information about you (such as your name, email address, etc.). The only information collected from you general preferences you may supply during the installation process (such as the time of day you install SOFTWARE PRODUCT), and your IP address, and none of that information is attributable to you specifically. Your IP address may be used to help diagnose problems with our server, and to identify unique installs and unistalls of SOFTWARE PRODUCT. Your IP address may also be used to help identify you and to gather broad demographic information that is anonymous in nature and is not associated with particular individuals. In addition, we may keep and share statistics on an anonymous, aggregated basis regarding the installation of SOFTWARE PRODUCT (such as the number of installations in a month). If you do not consent to the data collection and usage described above in this Agreement, you should cancel installation of SOFTWARE PRODUCT onto your computer.
Permission is granted to anyone to use FREEWARE EDITION of this software with no restrictions.
