  3. WINDOWS SOCKETS version 2 FOR WINDOWS 95 SOFTWARE DEVELOPMENT KIT
  4. END-USER LICENSE AGREEMENT FOR MICROSOFT SOFTWARE
  5.  
  6. IMPORTANT-READ CAREFULLY: This Microsoft End-User License Agreement ("EULA")
  7. is a legal agreement between you (either an individual or a single entity) 
  8. and Microsoft Corporation for the Microsoft software product identified above
  9. , which includes computer software and may include associated media, printed 
  10. materials and "online" or electronic documentation ("SOFTWARE PRODUCT"). 
  11. By installing, copying, or otherwise using the SOFTWARE PRODUCT, you agree to
  12. be bound by the terms of this EULA. If you do not agree to the terms of this 
  13. EULA, do not install or use the SOFTWARE PRODUCT; you may, however, return it
  14. to your place of purchase for a full refund.
  15.  
  16. SOFTWARE PRODUCT LICENSE
  17. The SOFTWARE PRODUCT is protected by copyright laws and international 
  18. copyright treaties, as well as other intellectual property laws and treaties.
  19. The SOFTWARE PRODUCT is licensed, not sold.
  20. 1.      GRANT OF LICENSE. This EULA grants you the following limited,non-exclusive
  21.         rights:
  22.  
  23.     Software Product. You may install and use and unlimited number of 
  24.         copies of the SOFTWARE PRODUCT to design, develop, and test software 
  25.         application products for use with Microsoft Windows 95 ("Application").
  26.     Sample Code. You may modify the sample source code located in the 
  27.         SOFTWARE PRODUCT's "samples" directories ("Sample Code") to design, 
  28.         develop, and test your Application. You may also reproduce and 
  29.         distribute the Sample Code in object code form along with any 
  30.         modifications you make to the Sample Code, provided that you comply 
  31.         with the Distribution Requirements described below. For purposes of 
  32.         this section, "modifications" shall mean enhancements to the 
  33.         functionality of the Sample Code
  34.  
  35.     Redistributable Code. Provided that you comply with the Distribution 
  36.         Requirements below, in addition to the rights granted above, you may 
  37.         reproduce and distribute the WS2SETUP.EXE file ("Redistributable Code").  
  38.     
  39.         Distribution Requirements. You may copy and redistribute the Sample 
  40.         Code and/or Redistributable Code (collectively "REDISTRIBUTABLE COMPONENTS")
  41.         as described above, provided that (a) you distribute the REDISTRIBUTABLE 
  42.         COMPONENTS only in conjunction with, and as a part of, your Application;
  43.         (b) your Application adds significant and primary functionality to 
  44.         the REDISTRIBUTABLE COMPONENTS; (c) the REDISTRIBUTABLE COMPONENTS 
  45.         only operate in conjunction with Microsoft Windows or Windows NT; 
  46.         (d) you do not permit further redistribution of the REDISTRIBUTABLE 
  47.         COMPONENTS by your end-user customers; (e) any distribution of Redistributable
  48.         Code is only in conjunction with your Application and includes each 
  49.         and every file contained therein distributed as a single set.  Files 
  50.         contained in WS2SETUP.EXE which are extracted as a result of 
  51.         executing WS2SETUP.EXE may not be individually reproduced or 
  52.         distributed.; (f) you do not use Microsoft's name, logo, or trademarks
  53.         to market your Application; (g) you include a valid copyright notice
  54.         on your Application; and (h) you agree to indemnify, hold harmless, 
  55.         and defend Microsoft from and against any claims or lawsuits, including
  56.         attorneys' fees, that arise or result from the use or distribution of 
  57.         your Application. Contact Microsoft for the applicable royalties due 
  58.         and other licensing terms for all other uses and/or distribution of 
  59.         the REDISTRIBUTABLE COMPONENTS.
  60.  
  61.     Microsoft reserves all rights not expressly granted to you. 
  62.  
  63. 2.    COPYRIGHT. All rights, title, and copyrights in and to the SOFTWARE 
  64.         PRODUCT (including, but not limited to, any images, photographs, 
  65.         animations, video, audio, music, text, and "applets" incorporated 
  66.         into the SOFTWARE PRODUCT) and any copies of the SOFTWARE PRODUCT are
  67.         owned by Microsoft or its suppliers. The SOFTWARE PRODUCT is protected
  68.         by copyright laws and international treaty provisions. Therefore, you 
  69.         must treat the SOFTWARE PRODUCT like any other copyrighted material, 
  70.         except that you may either (a) make one copy of the SOFTWARE PRODUCT 
  71.         solely for backup or archival purposes, or (b) install the SOFTWARE 
  72.         PRODUCT on a single computer, provided you keep the original solely 
  73.         for backup or archival purposes. You may not copy the printed 
  74.         materials accompanying the SOFTWARE PRODUCT. 
  75.  
  76. 3.    DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.
  77.  
  78.     Limitations on Reverse-Engineering, Decompilation, and Disassembly. 
  79.         You may not reverse- engineer, decompile, or disassemble the SOFTWARE
  80.         PRODUCT, except and only to the extent that such activity is expressly
  81.         permitted by applicable law notwithstanding this limitation.
  82.  
  83.     Rental. You may not rent, lease or lend the SOFTWARE PRODUCT.
  84.  
  85.     Software Transfer. You may permanently transfer all of your rights 
  86.         under this EULA, provided you retain no copies, you transfer all of 
  87.         the SOFTWARE PRODUCT (including all component parts, the media and 
  88.         printed materials, any upgrades, this EULA, and, if applicable, the 
  89.         Certificate of Authenticity), and the recipient agrees to the terms 
  90.         of this EULA. If the SOFTWARE PRODUCT is an upgrade, any transfer 
  91.         must include all prior versions of the SOFTWARE PRODUCT.
  92.  
  93.     Termination. Without prejudice to any other rights, Microsoft may 
  94.         terminate this EULA if you fail to comply with the terms and conditions
  95.         of this EULA. In such event, you must destroy all copies of the SOFTWARE
  96.         PRODUCT and all of its component parts. 
  97.  
  98. 4.    EXPORT RESTRICTIONS. You agree that neither you nor your customers 
  99.         intend to or will, directly or indirectly, export or transmit (a) the
  100.         SOFTWARE PRODUCT or related documentation and technical data, or 
  101.         (b) your Application as described in Section 1 of this EULA (or any 
  102.         part thereof), or process, or service that is the direct product of 
  103.         the SOFTWARE PRODUCT to any country to which such export or 
  104.         transmission is restricted by any applicable U.S. regulation or 
  105.         statute, without the prior written consent, if required, of the 
  106.         Bureau of Export Administration of the U.S. Department of Commerce, 
  107.         or such other governmental entity as may have jurisdiction over such 
  108.         export or transmission. 
  109.  
  110. 5.    U.S. GOVERNMENT RESTRICTED RIGHTS. The SOFTWARE PRODUCT and 
  111.         documentation are provided with RESTRICTED RIGHTS. Use, duplication, 
  112.         or disclosure by the Government is subject to restrictions as set 
  113.         forth in subparagraph (c)(1)(ii) of The Rights in Technical Data and 
  114.         Computer Software clause at DFARS 252.227-7013 or subparagraphs 
  115.         (c)(1) and (2) of the Commercial Computer Software - Restricted Rights
  116.         at 48 CFR 52.227-19, as applicable. Manufacturer is Microsoft 
  117.         Corporation/One Microsoft Way/Redmond, WA 98052-6399. 
  118.  
  119. MISCELLANEOUS
  120. This EULA is governed by the laws of the State of Washington. Should you have
  121. any questions concerning this EULA, or if you desire to contact Microsoft for
  122. any reason, please contact the Microsoft subsidiary serving your country, or 
  123. write: Microsoft Customer Sales and Service/One Microsoft Way/Redmond, WA 
  124. 98052-6399. 
  125.  
  126. NO WARRANTIES. To the maximum extent permitted by applicable law, Microsoft 
  127. expressly disclaims any warranty for the SOFTWARE PRODUCT. The SOFTWARE 
  128. PRODUCT and any related documentation are provided "as is" without warranty 
  129. of any kind, either express or implied, including, without limitation, the 
  130. implied warranties of merchantability or fitness for a particular purpose. 
  131. The entire risk arising out of use or performance of the SOFTWARE PRODUCT
  132. remains with you.
  133.  
  134. LIMITATION OF LIABILITY. Microsoft's entire liability and your exclusive 
  135. remedy under this EULA shall not exceed five dollars(US$5.00). 
  136.         
  137. NO LIABILITY FOR CONSEQUENTIAL DAMAGES. To the maximum extent permitted by
  138. applicable law, in no event shall Microsoft or its suppliers be liable for 
  139. any damages whatsoever (including, without limitation, damages for loss of 
  140. business profit, business interruption, loss of business information, or any
  141. other pecuniary loss) arising out of the use of, or inability to use, this 
  142. Microsoft product, even if Microsoft has been advised of the possibility of
  143. such damages. 
  144. Because some states/jurisdictions do not allow the exclusion or limitation of
  145. liability for consequential or incidental damages, the above limitation may 
  146. not apply to you. 
  147.
