  1. LICENSE AGREEMENT

  3. Please read the following terms and conditions before using 
  4. the SOFTWARE. Use of the SOFTWARE indicates you accept the 
  5. terms of this license agreement and warranty.
  6.  
  7. DEFINITIONS
  8.  
  9. The term "SOFTWARE" includes all software distributed with 
  10. this License including Zlurp!« and all documentation. 
  11. The "SOFTWARE" is licensed to you under the 
  12. terms specified in the License Grant below. Hatman, Inc. 
  13. ("HATMAN") owns all copyright, trade secret, patent, 
  14. trademarks and other proprietary rights in the SOFTWARE. 
  15.  
  16. LICENSE GRANT
  17.  
  18. Any number of copies of the SOFTWARE may be installed on 
  19. any number of computers at any time.
  20.  
  21. You are hereby licensed to make as many copies of the 
  22. SOFTWARE as you wish; give exact copies of the SOFTWARE 
  23. to anyone; and distribute the SOFTWARE in its unmodified 
  24. form via electronic means.
  25.  
  26. You are specifically prohibited from charging, or requesting
  27. donations, for any such copies, however made; and from
  28. distributing the software and/or documentation with other 
  29. products (commercial or otherwise) without prior written 
  30. permission.
  31.  
  32. GOVERNING LAW
  33.  
  34. This agreement shall be governed by the laws of the State of 
  35. Illinois.
  36.  
  37. DISCLAIMER OF WARRANTY
  38.  
  39. THIS SOFTWARE AND THE ACCOMPANYING FILES ARE SOLD "AS IS" AND
  40. WITHOUT WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY OR ANY
  41. OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED. NO WARRANTY OF 
  42. FITNESS FOR A PARTICULAR PURPOSE IS OFFERED.

  44. Good data processing practice dictates that any new program
  45. should be thoroughly tested by the user with non-critical data
  46. before relying on it.  The user must assume the entire risk of
  47. using the program.

  49. HATMAN does not warrant that the SOFTWARE will meet your 
  50. requirements or that operation of the SOFTWARE will be without 
  51. interruption, or that the SOFTWARE will be error-free, or that 
  52. defects in the SOFTWARE will be corrected.

  54. DISCLAIMER OF LIABILITY
  55.  
  56. IN NO EVENT SHALL HATMAN BE LIABLE TO YOU FOR ANY SPECIAL, 
  57. INCIDENTAL, CONSEQUENTIAL, INDIRECT OR SIMILAR DAMAGES INCLUDING 
  58. ANY LOSS OF PROFITS, OR LOSS OF SAVINGS, ARISING OUT OF YOUR USE 
  59. OR INABILITY TO USE THE SOFTWARE, EVEN IF HATMAN HAS KNOWLEDGE 
  60. OF THE POTENTIAL LOSS OR DAMAGE. Some states do not allow the 
  61. limitation or exclusion of liability for incidental or 
  62. consequential damages, so the above limitation may not apply to 
  63. you. HOWEVER, IN NO CASE SHALL HATMAN'S LIABILITY EXCEED THE 
  64. PURCHASE PRICE OF THE SOFTWARE.

  66. GENERAL
  67.  
  68. If any part of this agreement is found void and unenforceable, 
  69. it will not affect the validity of the balance of this LICENSE 
  70. AGREEMENT, which shall remain valid and enforceable according to 
  71. its terms. This LICENSE AGREEMENT may only be modified by a 
  72. license addendum which accompanies this license of an upgrade to 
  73. the SOFTWARE, or by a written document that has been signed by 
  74. both you and an officer of HATMAN. This license automatically 
  75. terminates if the licensee violates any of the terms of this 
  76. LICENSE AGREEMENT.
