  9. IMPORTANT-READ CAREFULLY: This End-User License 
  10. Agreement ("EULA") is a legal agreement between you 
  11. (either an individual or a single entity) and The 
  12. LSoft Technologies for the Active@ Boot Disk later 
  13. referred to as 'SOFTWARE'. By installing, copying, 
  14. or otherwise using the SOFTWARE you agree to be bound 
  15. by the terms of this EULA. If you do not agree to the 
  16. terms of this EULA, do not install or use the 
  17. SOFTWARE.

  19. LSoft Technologies may have patents, patent 
  20. applications, trademarks, copyrights, or other
  21. intellectual property rights covering subject matter 
  22. in this document. The furnishing of this document 
  23. does not give you any license to these patents, 
  24. trademarks, copyrights, or other intellectual 
  25. property.

  27. SOFTWARE LICENSE

  29. 1. The SOFTWARE is licensed, not sold. Copyright laws
  30. and international copyright treaties, as well as other
  31. intellectual property laws and treaties protect the 
  32. SOFTWARE.

  34. 2. GRANT OF LICENSE.
  35.  
  36. REGISTERED COPY.  After you have purchased the 
  37. license for SOFTWARE, and have received SOFTWARE 
  38. distribution package, you are licensed to copy the 
  39. SOFTWARE only into the number of CD-ROMs
  40. corresponding to the number of licenses purchased.  
  41. Under no other circumstances may the SOFTWARE be 
  42. operated at the same time on more than the number 
  43. of CD-ROMs for which you have paid a separate 
  44. license fee. You may not duplicate the 
  45. SOFTWARE in whole or in part, except that you may 
  46. make one copy of the SOFTWARE for backup or archival
  47. purposes. You may terminate this license at any time
  48. by destroying the original and all copies of the 
  49. SOFTWARE in whatever form.  You may permanently 
  50. transfer all of your rights under this EULA provided
  51. you transfer all copies of the SOFTWARE (including 
  52. copies of all prior versions if the SOFTWARE is an 
  53. upgrade) and retain none, and the recipient agrees 
  54. to the terms of this EULA.

  58. 3. RESTRICTIONS.  You may not reverse engineer, 
  59. decompile, or disassemble the SOFTWARE, except and 
  60. only to the extent that such activity is expressly
  61. permitted by applicable law notwithstanding this 
  62. limitation. You may not rent, lease, or lend the 
  63. SOFTWARE. You may permanently transfer all of your 
  64. rights under this EULA, provided the recipient 
  65. agrees to the terms of this EULA. You may not use the
  66. SOFTWARE to perform any unauthorized transfer of 
  67. information (e.g. transfer of files in violation of a
  68. copyright) or for any illegal purpose.

  71. 4. SUPPORT SERVICES. LSoft Technologies 
  72. may provide you with support services related to the
  73. SOFTWARE. Use of Support Services is governed by the
  74. LSoft Technologies polices and programs described in 
  75. the online documentation and web site, and/or other 
  76. LSoft Technologies-provided materials, as they may be 
  77. modified from time to time.
  78. Any supplemental software code provided to you as part
  79. of the Support Services shall be considered part of 
  80. the SOFTWARE and subject to the terms and conditions 
  81. of this EULA. With respect to technical information 
  82. you provide to LSoft Technologies as part 
  83. of the Support Services, LSoft Technologies may use such 
  84. information for its business purposes, including for 
  85. product support and development. LSoft Technologies will 
  86. not utilize such technical information in a form that 
  87. personally identifies you.

  89. 5. TERMINATION. Without prejudice to any other 
  90. rights, LSoft Technologies may terminate 
  91. this EULA if you fail to comply with the terms and 
  92. conditions of this EULA. In such event, you must 
  93. destroy all copies of the SOFTWARE.

  96. 6. COPYRIGHT. The SOFTWARE is protected by copyright
  97. law and international treaty provisions. You 
  98. acknowledge that no title to the intellectual 
  99. property in the SOFTWARE is transferred to you. 
  100. You further acknowledge that title and full ownership
  101. rights to the SOFTWARE will remain the exclusive 
  102. property of LSoft Technologies and you 
  103. will not acquire any rights to the SOFTWARE except as
  104. expressly set forth in this license. You agree that 
  105. any copies of the SOFTWARE will contain the same 
  106. proprietary notices which appear on and in the 
  107. SOFTWARE.

  109. 7. DISCLAIMER OF WARRANTY. LSoft Technologies
  110. expressly disclaims any warranty for the 
  111. SOFTWARE. THE SOFTWARE AND ANY RELATED DOCUMENTATION
  112. IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, 
  113. EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT 
  114. LIMITATION, THE IMPLIED WARRANTIES OR 
  115. MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE,
  116. OR NONINFRINGEMENT. THE ENTIRE RISK ARISING OUT OF
  117. USE OR PERFORMANCE OF THE SOFTWARE REMAINS WITH YOU.

  119. 8. LIMITATION OF LIABILITY. TO THE EXTENT PERMITTED BY
  120. APPLICABLE LAW, IN NO EVENT SHALL LSOFT TECHNOLOGIES
  121. OR ITS SUPPLIERS BE LIABLE TO YOU FOR ANY CONSEQUENTIAL,
  122. SPECIAL, INCIDENTAL, OR INDIRECT DAMAGES OF ANY KIND
  123. ARISING OUT OF THE DELIVERY, PERFORMANCE, OR USE OF
  124. THE SOFTWARE, EVEN IF LSOFT TECHNOLOGIES HAS BEEN
  125. ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY EVENT,
  126. LSOFT TECHNOLOGIES'S ENTIRE LIABILITY UNDER ANY 
  127. PROVOSION OF THIS EULA SHALL BE LIMITED EXCLUSIVELY 
  128. TO PRODUCT REPLACEMENT.
