PLEASE READ THIS AGREEMENT CAREFULLY BEFORE ATTEMPTING TO USE OR INSTALL THE SMALLER ANIMALS (c) THUMBNAILER SOFTWARE.
This Agreement is a binding legal agreement between you and the creator of the Smaller Animals (c) ThumbNailer Software (hereinafter "Software"), Smaller Animals Software, Inc. (hereinafter "Smaller Animals Software"). The Software includes the computer software program, the associated media, any printed materials, and any online or electronic documentation. By installing, copying or otherwise using the Software, you agree to be bound by the terms of this agreement. If you do not agree with the terms and conditions of this agreement, Smaller Animals Software is unwilling authorize you to utilize this trial version of the Software. In this event, you should not use or copy the Software.
Trial Version
You are authorized to sample the Smaller Animals (c) Thumbnailer Software for thirty (30) days. The trial version is a feature-limited version of the program that may be used for evaluation purposes. After thirty (30) days, you will be required to license the program from Smaller Animals Software or remove the program from your computer(s). Using any methods to circumvent the time limit scheme or any other licensing schemes in the program shall constitute a violation of this agreement.
If you decide to license the program from Smaller Animals Software, an End User License Agreement containing various restrictions and limitations must be entered into and a license fee must be paid before Smaller Animals Software will agree to license the Software to you. If you do not agree to the terms and conditions of the End User License Agreement, Smaller Animals Software will not license the Software to you and it must be removed immediately.
OWNERSHIP OF SOFTWARE. Smaller Animals Software retains the copyright, title and ownership of the Software and all accompanying materials, whether written or electronic, regardless of the form or media in or on which the original and other copies may exist. You may make one (1) copy of the Software solely for backup purposes. You must reproduce and include the copyright notice on the backup copy.
LIMITATIONS ON REVERSE ENGINEERING AND INTEGRATION. You may not reverse engineer, decompile, or disassemble the Software, except as permitted by applicable law notwithstanding this limitation. In addition, the Software may not be integrated or combined for sale into any application or system without prior approval from Smaller Animals Software.
FIELD OF USE. Due to the inclusion of GIF/TIFF LZW capability (Licensed under U.S. Patent No. 4,558,302 and foreign counterparts), this Software may not be used for on-line image processing unless the Unisys Corporation specifically licenses the user for such use. On-line image processing is any use where images are created and/or processed for display or distribution over a computer network.
This License does not authorize or permit you to use any other product or perform and other method or activity involving the use of LZW unless you are separately licensed in writing by the Unisys Corporation.
WARNING. This program distributed "as-is." There are no guarantees that the Software will be suitable for any particular use. Users should verify that the operation of this program meets all requirements before using it in any mission-critical application. Good data processing procedure dictates that any program be thoroughly tested with non-critical data in non-critical situations before relying on it. You assume the entire risk of using the program. Any liability of the seller and/or Smaller Animals Software will be limited exclusively to product replacement or refund of the license fee.
USABILITY. This Software and accompanying documentation (including instructions for use) are provided "as is" without warranty of any kind, further, Smaller Animals Software does not warrant, guarantee, or make any representations regarding the use, or the results of use, of the software or documentation in terms of correctness, accuracy, reliability, currentness, or otherwise. The entire risk as to the results and performance of the software is assumed by you. If the software or written materials are defective, you, and not Smaller Animals Software or its dealers, distributors, agents, or employees, assume the entire cost of all necessary servicing, repair or correction.
OTHER WARRANTIES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMALLER ANIMALS SOFTWARE DISCLAIMS ALL OTHER WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTIBILITY AND FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT TO THE SOFTWARE, ANY ACCOMPANYING WRITTEN OR ELECTRONIC MATERIALS, AND ANY PHYSICAL MEDIA USED TO DELIVER THE SOFTWARE.
No oral or written information or advice given by Smaller Animals Software, its dealers, distributors, agents or employees shall create a warranty or in any way increase the scope of this warranty and you may not rely on any such information or advice. Should any other warranties be found to exist, such warranties shall be limited in duration to ninety (90) days following the date of delivery to you. In no event will Smaller Animals Software's liability for any damages to you or any other person exceed the amount paid for the license to use the Software. Note: Some states do not allow limitations on duration of an implied warranty, so the above limitations may not apply to you.
REMEDIES. In the case of defects in the Software or the physical media, your exclusive remedy and Smaller Animals Software's entire liability, if any, is limited to the license fee paid for the Software. In no event shall Smaller Animals Software, or anyone else who has been involved in the creation, production or delivery of this product , be liable for any damages whatsoever (including without limitation special, incidental, consequential or indirect damages for loss of business profits, business interruption, or any other pecuniary loss) arising out of the use or inability to use the software even if Smaller Animals Software has been advised of the possibility of such damages.
