  1. License Agreement

  3. IMPORTANT-READ CAREFULLY BEFORE INSTALLING THE SOFTWARE.

  5. Deep Software ("AUTHOR")
  6. Electronic End User License Agreement for Activity Monitor.
  7. Notice to user:
  8. This is a contract. By installing this software you accept
  9. all the terms and conditions of this agreement.

  11.  
  12. This  end  user  license  agreement accompanies the Activity
  13. Monitor product ("SOFTWARE"). The term "SOFTWARE" also shall
  14. include  any  upgrades,  modified versions or updates of the
  15. SOFTWARE  licensed  to  you  by  AUTHOR.  Please  read  this
  16. agreement carefully.
  17.  
  18. 1.  COPYRIGHT.  The  SOFTWARE  is licensed to you, not sold.
  19. Only  AUTHOR  owns  the SOFTWARE. All copyrights on Activity
  20. Monitor are exclusively owned by the AUTHOR.

  22. 2.  GRANT  OF  LICENSE.  The SOFTWARE is "in use" when it is
  23. loaded in temporary or permanent memory of the computer.
  24. a)  For  Full  version license. After you have purchased the
  25. license  for  SOFTWARE you are licensed to copy the SOFTWARE
  26. only   into   the   memory   of   the  number  of  computers
  27. corresponding  to  the  number  of  licenses  purchased. 
  28. b) For Evaluation version.
  29. i)  USE.  If you have acquired the Evaluation version of the
  30. SOFTWARE,  you  may  install and use the SOFTWARE solely for
  31. evaluation  and  test  purposes for the duration of the time
  32. period  set in the SOFTWARE. You may not attempt to increase
  33. the  functionality  of  the SOFTWARE in any manner or extend
  34. the time limiters of the Evaluation version.
  35. ii)  DISTRIBUTION  RIGHTS.  AUTHOR grants you a royalty-free
  36. license to copy and distribute the Evaluation version of the
  37. SOFTWARE   and   documentation   in   its   unmodified  form
  38. electronically  or  on  physical  media means, provided that
  39. you  comply  with  all  other  provisions of this Agreement.

  43. 3.  LIMITS  ON  USE.  You may not modify, translate, reverse
  44. engineer,  decompile,  disassemble  (except  to  the  extent
  45. applicable  laws specifically prohibit such restriction), or
  46. create derivative works based on the SOFTWARE.

  48. 4.  NO  OTHER WARRANTIES. This SOFTWARE is provided by nihil
  49. "as  is"  and  any express or implied warranties, including,
  50. but    not   limited   to,   the   implied   warranties   of
  51. merchantability  and  fitness  for  a particular purpose are
  52. disclaimed.  In no event shall the author or contributors be
  53. liable   for  any  direct,  indirect,  incidental,  special,
  54. exemplary,  or  consequential  damages  (including,  but not
  55. limited  to,  procurement  of  substitute goods or services;
  56. loss  of  use,  data,  or profits; or business interruption)
  57. however  caused  and  on any theory of liability, whether in
  58. contract, strict liability, or tort (including negligence or
  59. otherwise)  arising  in  any  way  out  of  the  use of this
  60. SOFTWARE, even if advised of the possibility of such damage.

  62. 5.  If  you  do not agree with the terms of this license you
  63. must  remove  SOFTWARE  files from all storage devices where
  64. you have installed it and cease to use SOFTWARE.
