  65. BootIt NG is an Excellent Boot and Partition manager with a powerful,
  66. sophisticated, and simple to use set of tools for partitioning, imaging,
  67. and booting your computer.  It combines the features of several
  68. standalone products costing hundreds of dollars more.

  70. The partitioning tools include fast non-destructive resizing,
  71. converting,creating, formatting, copying, moving, and deleting of
  72. partitions.

  109.       directory "bootit" or "bootitng".  The procedure for doing this

  112.       that you already have the necessary tools and knowledge to
  113.       perform this step.  If not, you should be able to obtain
  114.       directions for this from the same source from which you received

  154.   1.1. "Licensed program" means the object code version of BootIt Next
  155.        Generation and related program user documentation.  No rights to
  156.        the source code versions of the licensed program are granted by
  157.        this license.

  159.   1.2. "Object code" means any instruction or set of instructions in
  160.        machine executable form.
  161.  
  162.   1.3. "User documentation" means any standard manuals or other related
  163.        materials used for user instruction or reference in use of the
  164.        licensed program.

  166.   1.4. "Use" means copying of any portion of the licensed program from
  167.        a storage unit or media into the designated equipment and
  168.        execution of thelicensed program on the equipment.

  170. 2.   LICENSE GRANT

  172.   2.1. TeraByte Unlimited grants you a limited license to use this
  173.        software for evaluation purposes for a period not to exceed
  174.        thirty days.  If you continue using this software after the
  175.        thirty-day evaluation period, you MUST purchase a Full-Use
  176.        license.

  178.   2.2. Licensee shall not use, copy, rent, lease, sell, modify,
  179.        decompile, disassemble, otherwise reverse engineer, or transfer
  180.        the licensed program except as provided in this agreement.  Any

  205. 5.   U.S. GOVERNMENT RESTRICTED RIGHTS

  208.        following shall apply:  The Software and documentation licensed
  209.        in this agreement are "commercial items" and are deemed to be
  210.        "commercial computer software" and "commercial computer software
  211.        documentation." Consistent with the Federal Acquisition
  212.        Guidelines and related laws, any use, modification, reproduction,
  213.        release, display, or disclosure of such commercial software or
  214.        commercial software documentation by the US. Government shall be
  215.        governed solely by the terms of this Agreement and shall be
  216.        prohibited except to the extent expressly permitted by the
  217.        terms of this Agreement.

  219. 6.   GENERAL TERMS
  220.  
  221.   6.1. This agreement shall be interpreted and enforced in accordance
  222.        with and shall be governed by the laws of the State of Nevada.
  223.        Any action or proceeding brought by either party against the other
  224.        arising out of or related to this agreement shall be brought only
  225.        in a STATE or FEDERAL COURT of competent jurisdiction located in
  226.        Clark County, NV.  The parties hereby consent to in personam
  227.        jurisdiction of said courts.
  228.  
  229.   6.2. If any terms or provisions of this agreement shall be found
  230.        to be illegal or unenforceable then, notwithstanding, this
  231.        agreement shall remain in full force and effect and such term or
  232.        provision shall be deemed stricken.
  233.  
  234.   6.3. No amendment of this agreement shall be effective unless it is in
  235.        writing and signed by duly authorized representatives or both
  236.        parties.  No term or provision hereof shall be deemed waived and
  237.        no breach excused unless such waiver or consent shall be in
  238.        writing and signed by the party claimed to have waived or
  239.        consented.  Any consent by any party to orwaiver of a breach by
  240.        the other, whether express or implied, shall not constitute a
  241.        consent to, waiver of or excuse for any other, different or
  242.        subsequent breach.

  244. Limited Distribution License
  245.  
  246. INDIVIDUALS may distribute BootIt Next Generation to friends or
  247. associates, provided they charge no fees for this service, and they
  248. convey only a complete and unaltered copy of the original BOOTITNG.ZIP
  249. file.

  251. All other distribution is allowed only under the terms of the attached
  252. VENDINFO data record, which is hereby incorporated by reference. Any
  253. distribution satisfying all the distribution requirements expressed in
  254. that data record is hereby authorized. You may not distribute this
  255. product, modify it, or bundle it with other products except as
  256. specifically allowed therein. You may not use, copy, rent, lease, sell,
  257. modify, decompile, disassemble, otherwise reverse engineer, or transfer
  258. the licensed program except as provided in this agreement.  Any such
  259. unauthorized use shall result in immediate and automatic termination of
  260. this license.

  262. Permission to distribute the BootIt Next Generation package is not
  263. transferable, assignable, saleable, or franchisable.  Each vendor
  264. wishingto distribute the package must independently satisfy the terms of
  265. this limited distribution license.

  268. you in writing.  All rights not expressly granted here are reserved to
  269. TeraByte Unlimited.
