  2. Sambar Server End-user License Agreement
  3.  
  4. Sambar Technologies grants to the possessor of this copy (the Licensee) a 
  5. royalty-free, nonexclusive license to use, copy, and modify the binary code
  6. of the Sambar Server, the sample source code, and any related documentation
  7. (the Software) for academic, research and internal business purposes only 
  8. and subject to the following conditions:

  10. A. By using or copying the Software, Licensee agree to abide by the terms
  11. of this Agreement.
  12.  
  13. B. Title and copyright to the Software remain with Sambar Technologies and
  14. Licensee agrees to preserve the same.
  15.  
  16. C. Licensee acknowledges that the Software is still in the development
  17. stage and that it is being supplied "as is", without any accompanying 
  18. services from Sambar Technologies. SAMBAR TECHNOLOGIES MAKES NO 
  19. REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED. By way of example, 
  20. but not limitation, SAMBAR TECHNOLOGIES MAKES NO REPRESENTATIONS OR 
  21. WARRANTIES OF MERCHANTABILITY OR FITNESS FOR ANY PARTICULAR PURPOSE OR 
  22. THAT THE USE THE SOFTWARE WILL NOT INFRINGE ON ANY PATENTS OR OTHER RIGHTS. 
  23. Sambar Technologies shall not be held liable for any liability nor for 
  24. any direct, indirect or consequential damages with respect to any claim by
  25. Licensee or any third party with respect to this Agreement or any use
  26. of the Software.

  28. D. Licensee may NOT distribute the Software or any derivative work based
  29. on the Software to third parties unless the Sambar Server Commercial
  30. Distribution License is executed and associated license fees are paid
  31. to Sambar Technologies.

  33. E. Licensee may (i) use the software on any single computer; and (ii) use the
  34. software on a second computer as long as the first and second computers
  35. arenot used simultaneously.

  37. F. Licensee agrees to abide by all applicable laws of the United
  38. States, including, but not limited to, copyright and export control
  39. laws.
  40.  
  41. G. Sambar Technologies has the right to terminate this license immediately 
  42. by written or electronic notice upon Licensee's breach of, or non-compliance 
  43. with any of its terms. Licensee may be held legally responsible for any 
  44. copyright infringement that is caused or encouraged by licensee's failure to
  45. abide by the terms of this license.
