  1. FREEWARE SINGLE USER LICENSE AGREEMENT
  2. --------------------------------------

  4. This is a user license agreement (the "AGREEMENT")
  5. between you (either individual or single entity) and
  6. 3Dize, Inc., for the freeware version of the software
  7. (the "SOFTWARE") accompanying this AGREEMENT.
  8. This agreement does NOT apply to non-freeware
  9. versions of the software.
  10.  
  11. The SOFTWARE is the property of 3Dize, Inc. and is
  12. protected by copyright laws and international copyright
  13. treaties.  The SOFTWARE is not sold, it is licensed.
  14.  
  15. By availing of any of the rights licensed to you in this
  16. AGREEMENT, you agree to be bound by and are becoming a
  17. party to this AGREEMENT.  If you do not agree to these
  18. terms and conditions, do not avail of the rights licensed
  19. to you in this AGREEMENT.
  20.  
  21. If you accept the terms and conditions of this AGREEMENT,
  22. you have certain non-exclusive rights and obligations as
  23. follows:

  25. YOU MAY do any of the following:
  26.  
  27. 1.    Install and use the SOFTWARE.
  28.  
  29. 2.    Make unlimited copies and distribute the SOFTWARE in
  30.     it's uninstalled, unmodified form, as downloaded from
  31.     3Dize.com.  Computer's Magazines are specifically
  32.     authorized to distribute the SOFTWARE (in it's
  33.     uninstalled, unmodified form, as downloaded from
  34.     3Dize.com) on any Cover Disk or CD-ROM.
  35.  
  36. 3.    Bundle the SOFTWARE with other products, and sell
  37.     the bundle, as long as you make it clear to the
  38.     customer that the SOFTWARE is available for free
  39.     from 3Dize.com.

  42. YOU MAY NOT do any of the following:
  43.  
  44. 1.    Remove the advertizement from files created by the
  45.     SOFTWARE unless you have obtained a full-version of
  46.     the software from 3Dize, Inc. or a duly authorized
  47.     representative of 3Dize, Inc..
  48.  
  49. 2.    Sublicense, rent, sell, or lease the SOFTWARE or
  50.     any portion of it.
  51.  
  52. 3.    Decompile, disassemble, reverse engineer or modify
  53.     the SOFTWARE or any portion of it.
  54.  
  55. 4.    Incorporate the SOFTWARE in other computer programs.
  56.  
  57. 5.    Defeat any intended reduction in or termination of
  58.     functionality of this free version of the SOFTWARE.
  59.  
  60.  
  61. All other rights with respect to the SOFTWARE are reserved.
  62. The SOFTWARE is:

  67. The Software is provided "AS IS", without a warranty of
  68. any kind.  ALL EXPRESS OR IMPLIED CONDITIONS,
  69. REPRESENTATIONS AND WARRANTIES, INCLUDING
  70. ANY IMPLIED WARRANTY OF MERCHANTABILITY,
  71. FITNESS FOR A PARTICULAR PURPOSE OR NON-
  72. INFRINGEMENT, ARE HEREBY EXCLUDED.  3DIZE,
  73. INC. AND IT'S LICENSORS SHALL NOT BE LIABLE
  74. FOR ANY DAMAGES SUFFERED BY LICENSEE AS A
  75. RESULT OF USING, MODIFYING OR DISTRIBUTING
  76. THE SOFTWARE OR ITS DERIVATIVES. IN NO
  77. EVENT WILL 3DIZE, INC. AND IT'S LICENSORS
  78. BE LIABLE FOR ANY LOST REVENUE, PROFIT OR
  79. DATA, OR FOR DIRECT, INDIRECT, SPECIAL,
  80. CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES,
  81. HOWEVER CAUSED AND REGARDLESS OF THE THEORY OF
  82. LIABILITY, ARISING OUT OF THE USE OF OR
  83. INABILITY TO USE SOFTWARE, EVEN IF 3DIZE, INC.
  84. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH
  85. DAMAGES.

  87. 3DIZE, INC. DOES NOT INDEMNIFY ANY PARTY TO
  88. THIS LICENSE.
  89.  
  90. IN ANY EVENT, THE MAXIMUM LIMIT OF 3DIZE, INC.'S
  91. LIABILITY UNDER THIS AGREEMENT IS $5.
  92.  
  93. 3Dize, Inc. is not bound by any provision of any purchase
  94. order, receipt, acceptance, confirmation, correspondence, or
  95. otherwise, unless 3Dize, Inc. is specifically agrees to the
  96. provision in writing.  If any provisions, or portions thereof,
  97. of this agreement are invalid under any applicable statute or
  98. rule of law, then that portion shall be deemed omitted in the
  99. applicable juristiction and the remaining portions of the
  100. agreement remain in force.  This agreement is governed by the
  101. laws of California.
