  1.  
  2. BEFORE CONTINUING WITH THE INSTALLATION OF THE
  3. PROGRAM, YOU MUST READ, ACKNOWLEDGE AND ACCEPT THE
  4. TERMS AND CONDITIONS OF THE SOFTWARE LICENSE AGREEMENT
  5. WHICH FOLLOWS.  WHEN PROMPTED, PLEASE INDICATE WHETHER
  6. YOU ACCEPT OR DO NOT ACCEPT.  IF YOU DO NOT ACCEPT THE
  7. TERMS AND CONDITIONS OF THE SOFTWARE LICENSE, PROMPTLY
  8. RETURN THE MEDIA PACKAGE AND THE ACCOMPANYING ITEMS
  9. (INCLUDING WRITTEN MATERIALS AND BINDERS OR OTHER
  10. CONTAINERS) TO THE PLACE YOU OBTAINED THEM FOR A FULL
  11. REFUND.  
  12.  
  13. VERITAS SOFTWARE LICENSE
  14. 1.  GRANT OF LICENSE.  VERITAS Software Corporation
  15.     grants to you the right to use one copy of the 
  16.     enclosed VERITAS Software Corporation software 
  17.     program (the "SOFTWARE") on a single terminal 
  18.     connected to a single computer.  You may
  19.     not network the SOFTWARE or otherwise use it on
  20.     more than one computer at the same time.  
  21.  
  22. 2.  COPYRIGHT.  The SOFTWARE is owned by VERITAS 
  23.     Software Corporation or its suppliers and is 
  24.     protected by United States copyright laws and 
  25.     international treaty provisions.  You may either 
  26.     (a) make one copy of the SOFTWARE solely for 
  27.     backup or archival purposes, or (b) transfer the 
  28.     SOFTWARE to a single hard disk provided you keep 
  29.     the original solely for backup or archival 
  30.     purposes.  You may not otherwise copy the SOFTWARE, 
  31.     and you may not copy the written materials 
  32.     accompanying the SOFTWARE.  
  33.  
  34. 3.  OTHER RESTRICTIONS.  You may not rent or lease the
  35.     SOFTWARE, but you may transfer the SOFTWARE and
  36.     accompanying written materials on a permanent
  37.     basis provided you retain no copies and the
  38.     recipient agrees to the terms of this Agreement. 
  39.     You may not reverse engineer, decompile or
  40.     disassemble the SOFTWARE.  If the SOFTWARE is an
  41.     upgrade, any transfer must include the update and
  42.     all prior versions.  
  43.  
  44. 4.  DUAL MEDIA SOFTWARE.  If the SOFTWARE package
  45.     contains more than one form of media, such as a
  46.     3.5" diskette and a CD-ROM, then you may use only
  47.     the media appropriate for your single-user
  48.     computer.  You may not use the other media on
  49.     another computer or loan, rent, lease, or transfer
  50.     them to another except as part of the permanent
  51.     transfer (as provided above) of all SOFTWARE and
  52.     written materials.  
  53.  
  54. 5.  LIMITED WARRANTY AND REMEDY.  VERITAS Software 
  55.     Corporation warrants the physical media (e.g. 
  56.     diskette(s) or CD-ROM) and the physical 
  57.     documentation to be free of defects in materials 
  58.     and workmanship for a period of 90 days from the 
  59.     original purchase date.  If VERITAS Software 
  60.     Corporation receives notification within this 
  61.     warranty period of any such defects and such 
  62.     notification is determined to be correct, VERITAS 
  63.     Software Corporation will replace the media or 
  64.     documentation.  The foregoing is your sole and 
  65.     exclusive remedy for any breach of warranty by 
  66.     VERITAS Software Corporation.  This limited 
  67.     warranty is void if the damage or defect has 
  68.     resulted from accident, abuse or misapplication.  
  69.  
  70. 6.  NO OTHER WARRANTIES.  THE LIMITED WARRANTY ABOVE
  71.     IS EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES
  72.     FOR THE SOFTWARE AND DOCUMENTATION.  VERITAS 
  73.     SOFTWARE CORPORATION MAKES NO OTHER WARRANTIES, 
  74.     EXPRESS OR IMPLIED, AND EXPRESSLY DISCLAIMS ALL 
  75.     OTHER WARRANTIES, INCLUDING BUT NOT LIMITED TO 
  76.     IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS 
  77.     FOR A PARTICULAR PURPOSE, AND NONINFRINGEMENT FOR 
  78.     THE SOFTWARE AND DOCUMENTATION.  THE PROVISIONS 
  79.     ABOVE STATE VERITAS SOFTWARE CORPORATIONÆS ENTIRE 
  80.     RESPONSIBILITY AND YOUR SOLE AND EXLCUSIVE REMEDY 
  81.     WITH RESPECT TO ANY BREACH OF WARRANTY.  
  82.  
  83. 7.  LIMITED LIABILITY.  IN NO EVENT SHALL VERITAS 
  84.     SOFTWARE CORPORATION OR ITS SUPPLIERS BE LIABLE TO
  85.     YOU FOR ANY CONSEQUENTIAL, SPECIAL, INCIDENTAL, OR 
  86.     INDIRECT DAMAGES OF ANY KIND ARISING OUT OF THE 
  87.     LICENSE OF, USE OF, OR INABILITY TO USE ANY 
  88.     VERITAS SOFTWARE CORPORATION SOFTWARE, EVEN IF 
  89.     VERITAS SOFTWARE CORPORATION HAS BEEN ADVISED OF 
  90.     THE POSSIBILITY OF SUCH DAMAGES.  IN NO EVENT 
  91.     SHALL VERITAS SOFTWARE CORPORATIONÆS LIABILITY
  92.     EXCEED THE LICENSE FEE PAID BY YOU.  THIS
  93.     LIMITATION OF LIABILITY AND RISKS IS REFLECTED IN
  94.     THE PRICE OF THE SOFTWARE.  
  95.  
  96. 8.  SEVERABILITY.  If any provision of this Agreement
  97.     is ruled invalid, such invalidity shall not affect
  98.     the validity of the remaining portions of this
  99.     Agreement.  
  100.  
  101. 9.  TERM.  This license is effective until terminated.
  102.     You may terminate it at any time by destroying the
  103.     SOFTWARE together with all copies, modifications
  104.     and merged portions in any form.  It will also
  105.     terminate upon your failure to comply with any
  106.     term or condition of this Agreement.  In the event
  107.     of such termination, you agree to promptly destroy
  108.     the SOFTWARE together with all copies,
  109.     modifications and merged portions in any form.

  111. 10.  MISCELLANEOUS.  This is the entire Agreement
  112.      between you and VERITAS Software Corporation, and
  113.      supersedes any prior agreement, whether written 
  114.      or oral, relating to the subject matter of this 
  115.      Agreement.  The parties disclaim the application 
  116.      of the United Nations Convention on the 
  117.      International Sale of Goods.  This Agreement is 
  118.      governed by the laws of the State of California.
  119.      You may not export or re-export the SOFTWARE or 
  120.      documentation without the appropriate United 
  121.      States or foreign government licenses.  
  122.  
  123. U.S. GOVERNMENT RESTRICTED RIGHTS
  124. Regarding the sale to, or use, reproduction, release,
  125. modification, or disclosure of any SOFTWARE which is
  126. the subject of this Agreement, by any military or
  127. civilian agency of the United States Government,
  128. Licensee agrees that the use of the SOFTWARE and all
  129. related documentation is restricted in accordance with
  130. FAR 12.212 for civilian agencies and DFARS 227.7202
  131. for military agencies.  The use of this SOFTWARE by
  132. any Government agency is further restricted in
  133. accordance with the terms of this Agreement, or any
  134. modification hereof.  Licensee will affix the
  135. following legend to each SOFTWARE which is the subject
  136. of this Agreement:

  138. Use, duplication, reproduction, or transfer of this
  139. commercial SOFTWARE and accompanying documentation is
  140. restricted in accordance with FAR 12.212 and DFARS
  141. 227.7202 and by a license agreement.
