The followings terms are used within this document.
ProSoft Technologies - The owner of the software - fully ProSoft Technologies (UK).
Software - The software produced by ProSoft Technologies, for use by the client.
User - A single user of the Software.
PC - The personal computer this software is installed onto.
You - The company/client purchasing a license for use of this software.
Grant Of Use
The producer and developer of this software is ProSoft Technologies. Who hereby
grants you non-exclusive license to use this software. The following conditions apply on the use of the software ; You May Not : permit other individuals to use the software except under the terms listed, modify, translate, reverse engineer (except to the extent and for the express purposes authorised by the applicable law), decompile or create derivative works based on this software. You must also not : copy this software (except for a single archive purpose), rent, lease, transfer license or otherwise transfer rights to the software; or remove any proprietary notices or labels on the Software, whether set forth in text files or media. This software may not be distributed in any form without prior permission from ProSoft Technologies.
Titleship / Ownership
ProSoft Technologies is the sole owner of this software. Title, titleship, ownership rights and intellectual property rights of said software remains entirely with ProSoft Technologies and/or licensors and/or suppliers. The software is protected by copyright laws of the United Kingdom, and international copyright treaties.
Termination
This license will terminate automatically if you fail to comply with the terms and conditions described here in. On termination, you must inform ProSoft Technologies, remove the software from PC and/or Server machines and destroy all copies of the software and documentation.
Limited Warranty
By installing this software, you agree to all terms in this license agreement as well as any future terms which may be introduced by ProSoft Technologies without notice. All risk in using this software is held by the user, and ProSoft Technologies is in not way responsible for any direct or indirect damages for personal injury, loss of business profits, business interruption, loss of business information, (or any other pecuniary loss) arising out of use of or inability to use this Software, even if ProSoft Technologies is advised of the possibility of such damages.
No Other Warranties
To the maximum extent permitted by applicable laws, ProSoft Technologies disclaim all other representations, warranties, conditions or other terms, either express or implied, including, but not limited to implied warranties and/or conditions of merchantability and fitness for a particular purpose, with regard to the software, and accompanying written materials, and any accompanying hardware.
No Liability For Damages
To the maximum extent permitted by applicable law, in no event shall ProSoft Technologies and/or its suppliers be liable for any damages whatsoever including without limitation, direct or indirect damages for personal injury, loss of business profits, business interruption, loss of business information, (or any other pecuniary loss) arising out of use of or inability to use this Software, even if ProSoft Technologies is advised of the possibility of such damages.
Freeware Addition
This software is 'Free' and therefore not support by ProSoft Technologies in anyway. Technical, user or hardware support is not offered by ProSoft Technologies on the 'free' version of GamesBasic.
