READ THIS LICENSE AGREEMENT CAREFULLY BEFORE USING THE SOFTWARE. DragonWorks Software and Terry Lee Rasmussen grants a license to use this product; all ownership and copyrights remain the property of Terry Lee Rasmussen. By using the software, you agree to become bound by the terms of this agreement which includes a software license and a statement of warranty. If you do not accept or agree to the terms of this agreement, immediately cancel installation and/or delete any portions of the software from your computer.
Software License and Copyright
This software is copyrighted and all rights are reserved by Terry Lee Rasmussen. Unauthorized copying of any part of the software or of any accompanying written material is expressly forbidden. You may install this software onto one hard drive for the sole purpose of using the product in accordance with the terms of this agreement. This License Agreement will take effect at the date of acquirement of the software package and will be valid throughout your ownership of the program. You, the registered customer, purchased a non-transferable, non-exclusive, limited license to use this software. If you, the customer, violate any provisions of this agreement, your right to use this software and your license will automatically be terminated. Terry Lee Rasmussen is and shall remain the sole owner of the software, subject to customer's rights specified in this agreement. If any part of this agreement is found to be in violation of any law, state or federal, only the portion in violation will be invalidated, all other portions of this agreement will remain in effect. The validity, construction, and performance of this agreement is governed by the laws of the state of Wisconsin. Arbitration or suit with respect to this agreement may be brought ONLY in Eau Claire County, Wisconsin. You also agree that this agreement is the complete agreement between you and DragonWorks Software, and supersedes all prior negotiations, agreements, and understandings concerning its subject matter. The interpretation of this agreement may not be explained or supplemented by any course of dealing or performance, or by any usage or trade.
Registration
Registration and purchase of the application (if shareware) can be accomplished by contacting DragonWorks Software (http://www.Majordomo.net/dragonworks). Unregistered copies of the software may contain limitations as defined in the application-specific "readme.rtf" file. Acceptance of patrons for registration is determined solely by DragonWorks Software and any partners in the process of registration that DragonWorks Software hires or uses. Distribution of materials for registration (such as, but not limited to, registration numbers) are usually delivered by electronic mail, or, if that fails, by postal service. No other form of delivery is required by DragonWorks Software.
Customer Responsibilities
It is your duty and responsibility to maintain periodic backup copies of all data and programs used in conjunction with this software in order to prevent catastrophic loss to you. Upon termination of this license you must destroy all copies of this software and accompanying materials in your possession.
The customer assumes all risk associated with the use of this software. Do not use this software in any case where significant damage or injury to persons, property, or business may happen if an error occurs. You expressly assume all risk for such use.
Distribution of non-registered software is permissible, granted that the distribution takes the form of the original installation executable and contains no price/charge. Permission from DragonWorks Software to include the installation executable on media other than the internet (such as mass produced CD-ROMs) is not required as long as the media is distributed free of charge.
Permitted Uses
This software, if registered, may be used on one computer. Registered use of the software on any other subsequent computer requires a purchased copy per computer.
Prohibited Uses
You may not rent, sub-license or lease this software or documentation.
You may not alter, modify, or adapt this software or documentation, including, but not limited to, reverse engineering, translating, decompiling, disassembling or creating derivative works unless authorized to do so in writing from Terry Lee Rasmussen. Any such creation or work resulting from such activities that are not authorized shall be considered "warez".
Any distribution of "warez" is against the laws of the United States of America and the "No Electronic Theft" (NET) act of 1997. By having the software installed (or having it once been installed) on your system states that you are held liable by the laws of the United States and may be prosecuted under them. Violation of the "No Electronic Theft" act can result in fines of up to $250,000 (per violated application) and/or 5 years in prison.
You may only use the software for your own internal use, and cannot use the software in any manner for or by a third party unless specifically authorized in writing by Terry Lee Rasmussen.
Customers may not remove any designation marks from any material (including in electronic form) supplied by DragonWorks Software that identifies such material as belonging to or developed by DragonWorks Software.
Distribution of registered versions of the software or any registration related material, including but not limited to, registration numbers, is strictly forbidden.
Use of a registration number on more copies of an application than have been purchased is prohibited.
Term of Agreement
This License Agreement is effective until terminated. This License Agreement can only be terminated by Terry Lee Rasmussen.
Limited Warranty
DragonWorks Software and Terry Lee Rasmussen does not provide any warranty, express or implied, with respect to this software, documentation or media, including their quality, performance, merchantability, or fitness for a particular purpose. DragonWorks Software warrants that the functions contained in the software will meet the requirements as specified by DragonWorks Software; defects that may exist in the software may be corrected in a timely manner once DragonWorks Software has been notified of any errors. Corrections and the time period in which those corrections are implemented are entirely determined by DragonWorks Software. The warranty and remedies set forth above are exclusive and in lieu of all others, oral or written, expressed or implied. No oral or written information or advice given by DragonWorks Software, its dealers, distributors, agents, or employees shall create a warranty or in any way increase the scope of this warranty, and you may not rely on any such information or advice.
Because programs are inherently complex and may not be completely free of errors, although DragonWorks Software undertakes extensive testing, you are advised to verify the accurate performance of the software. Neither DragonWorks Software, Terry Lee Rasmussen, nor anyone else who has been involved in the creation, production, or delivery of this product shall be liable for any direct, indirect, consequential, or incidental damages (including damages for loss of business profits, business interruption, loss of business information, loss of data, and the like) arising out of the use of or inability to use this product, even if DragonWorks Software has been advised of the possibility of such damages. In no case shall the liability of DragonWorks Software and Terry Lee Rasmussen exceed the amount of the ORIGINAL purchase price of the application.
Some states do not allow limitations on the duration of an implied warranty, or exclusion or limitation of incidental or consequential damages, so the above limitations and exclusions may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
