  16. END-USER LICENSE AGREEMENT FOR THIS SOFTWARE :

  20. This End-User License Agreement ("EULA") is a legal agreement
  21. between you (either an individual or a single entity) and the
  22. mentioned author of this Software for the software product
  23. identified above, which includes computer software and may
  24. include associated media, printed materials, and "online"
  25. or electronic documentation ("SOFTWARE PRODUCT"). The
  26. SOFTWARE PRODUCT is limited in usage ("SHAREWARE VERSION") until
  27. you decide to license it ("REGISTERED VERSION").

  29. By installing, copying, or otherwise using the SHAREWARE VERSION
  30. and/or the REGISTERED VERSION, you agree to be bound by the terms 
  31. of this EULA. If you do not agree to the terms of this EULA, 
  32. do not install or use the SOFTWARE PRODUCT.

  34. SOFTWARE PRODUCT LICENSE
  35. The SOFTWARE PRODUCT is protected by copyright laws and international
  36. copyright treaties, as well as other intellectual property laws and
  37. treaties. The SOFTWARE PRODUCT can be licensed, not purchased.

  39. 1. GRANT OF LICENSE. This EULA grants you the following rights:
  40. Installation and Use. You may install and use an unlimited number of
  41. copies of the SHAREWARE VERSION and a single copy of the
  42. REGISTERED VERSION (upon licensing the SOFTWARE PRODUCT).

  44. Reproduction and Distribution. You may reproduce and distribute an
  45. unlimited number of copies of the SHAREWARE VERSION; provided that
  46. each copy shall be a true and complete copy, including all copyright
  47. and trademark notices, and shall be accompanied by a copy of this
  48. EULA. Copies of the SHAREWARE VERSION may be distributed as a
  49. standalone product or included with your own product.

  51. 2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.

  53. Limitations on Reverse Engineering, Decompilation, and Disassembly.
  54. You may not reverse engineer, decompile, or disassemble the SOFTWARE
  55. PRODUCT, except and only to the extent that such activity is expressly
  56. permitted by applicable law notwithstanding this limitation.

  58. Separation of Components.
  59. The REGISTERED VERSION is licensed as a single product. Its component
  60. parts may not be separated for use on more than one computer.
  61.  
  62. Software Transfer.
  63. You may permanently transfer all of your rights under this EULA,
  64. provided the recipient agrees to the terms of this EULA.
  65.  
  66. Termination.
  67. Without prejudice to any other rights, the Author of this Software
  68. may terminate this EULA if you fail to comply with the terms and
  69. conditions of this EULA. In such event, you must destroy all copies
  70. of the SOFTWARE PRODUCT and all of its component parts.

  72. 3. COPYRIGHT.
  73. All title and copyrights in and to the SOFTWARE PRODUCT
  74. (including but not limited to any images, photographs, animations,
  75. video, audio, music, text, and "applets" incorporated into the
  76. SOFTWARE PRODUCT), the accompanying printed materials, and any
  77. copies of the SOFTWARE PRODUCT are owned by the Author of this
  78. Software. The SOFTWARE PRODUCT is protected by copyright laws
  79. and international treaty provisions. Therefore, you must treat
  80. the SOFTWARE PRODUCT like any other copyrighted material except
  81. that you may install the SOFTWARE PRODUCT on a single computer
  82. provided you keep the original solely for backup or archival
  83. purposes.

  85. 4. U.S. GOVERNMENT RESTRICTED RIGHTS.
  86. The SOFTWARE PRODUCT and documentation are provided with
  87. RESTRICTED RIGHTS. Use, duplication, or disclosure by the
  88. Government is subject to restrictions as set forth in
  89. subparagraph (c)(1)(ii) of the Rights in Technical Data and
  90. Computer Software clause at DFARS 252.227-7013 or subparagraphs
  91. (c)(1) and (2) of the Commercial Computer Software-Restricted
  92. Rights at 48 CFR 52.227-19, as applicable. Manufacturer is

  99. If you acquired this product in the United States, this EULA is
  100. governed by the laws of the United States.

  103. local law may apply.

  110. LIMITED WARRANTY

  113. The Author of this Software expressly disclaims any warranty for
  114. the SOFTWARE PRODUCT. The SOFTWARE PRODUCT and any related
  115. documentation is provided "as is" without warranty of any kind,
  116. either express or implied, including, without limitation, the
  117. implied warranties or merchantability, fitness for a particular
  118. purpose, or noninfringement. The entire risk arising out of use
  119. or performance of the SOFTWARE PRODUCT remains with you.

  121. NO LIABILITY FOR DAMAGES.
  122. In no event shall the author of this Software be liable for any
  123. damages whatsoever (including, without limitation, damages for
  124. loss of business profits, business interruption, loss of business
  125. information, or any other pecuniary loss) arising out of the use
  126. of or inability to use this product, even if the Author of this
  127. Software has been advised of the possibility of such damages.
  128. Because some states/jurisdictions do not allow the exclusion
  129. or limitation of liability for consequential or incidental damages,
  130. the above limitation may not apply to you.
