  27. Swimming Elk Software warrants the physical diskette(s)
  28. provided with registered versions to be free of defects in 
  29. materials and workmanship for a period of ninety days
  30. from the date of registration. If Swimming Elk Software receives
  31. notification within the warranty period of defects in materials
  32. or workmanship, and such notification is determined by 
  33. Swimming Elk Software to be correct, Swimming Elk Software will 
  34. replace the defective diskette(s).

  36. The entire and exclusive liability and remedy for breach of this
  37. Limited Warranty shall be limited to replacement of defective
  38. diskette(s) and shall not include or extend to
  39. any claim for or right to recover any other damages, including
  40. but not limited to, loss of profit, data, or use of the software,
  41. or special, incidental, or consequential damages or other similar
  42. claims, even if Swimming Elk Software has been specifically advised
  43. of the possibility of such damages. In no event will Swimming Elk
  44. Software's liability for any damages to you or any other person
  45. ever exceed the lower of suggested list price or actual price
  46. paid for the license to use the software, regardless of any form
  47. of the claim.
