  7.     NetScanTools LICENSE AGREEMENT
  8.  
  9. THIS IS A LEGAL AGREEMENT BETWEEN YOU, THE LICENSEE, and
  10. Northwest Performance Software, Inc.
  11. BY USING THIS PROGRAM, YOU ARE AGREEING TO BECOME
  12. BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT
  13. AGREE TO THE TERMS OF THIS AGREEMENT, PROMPTLY UNINSTALL
  14. THIS PROGRAM AND, IF APPLICABLE, RETURN THE DISK PACKAGE
  15. AND THE ACCOMPANYING ITEMS (INCLUDING WRITTEN MATERIALS
  16. AND BINDERS AND PACKAGING) TO THE PLACE YOU OBTAINED
  17. THEM FOR A FULL REFUND.

  19. The following license agreement contains sections explicitly
  20. marked for TRIAL USE users and REGISTERED VERSION users.
  21. If you are evaluating this software, then the TRIAL USE
  22. sections apply to you. Users who have made their Registration
  23. Payment are additionally bound by the terms of the REGISTERED
  24. VERSION sections. ALL OTHER SECTIONS NOT EXPLICITLY MARKED
  25. APPLY TO ALL USERS.

  27. TRIAL USE LIMITATIONS--GRANT OF LICENSE.
  28. Northwest Performance Software, Inc. grants to
  29. you the right to use one copy of the enclosed software program,
  30. NetScanTools, (the "SOFTWARE") on a single computer for
  31. evaluation purposes during a Trial Usage Period not to exceed
  32. thirty (30) days. If you want to continue using this software
  33. after the Trial Usage Period, you MUST make a registration
  34. payment to Northwest Performance Software, Inc. or its authorized
  35. representatives. Using this software after the Trial Usage
  36. Period without registering the software is a violation of the
  37. terms of this limited license. The SOFTWARE is in "use" on a
  38. computer when it is loaded into temporary memory (i.e. RAM) or
  39. installed into permanent memory (e.g. hard disk, CD-ROM disk, or
  40. other storage device) of that computer. However, installation on
  41. a network server for the sole purpose of distribution to one or
  42. more other computer(s) shall not constitute "use" for which a
  43. separate license is required, provided you have a separate license
  44. for each computer to which the SOFTWARE is distributed.

  46. REGISTERED VERSION GRANT OF LICENSE.
  47. Northwest Performance Software, Inc. grants to you
  48. the right to use one copy of the enclosed software program,
  49. NetScanTools, (the "SOFTWARE") on a single computer.  The SOFTWARE
  50. is in "use" on a computer when it is loaded into temporary
  51. memory (i.e. RAM) or installed into permanent memory (e.g. hard disk,
  52. CD-ROM disk, or other storage device) of that computer.  However,
  53. installation on a network server for the sole purpose of distribution
  54. to one or more other computer(s) shall not constitute "use" for
  55. which a separate license is required, provided you have a separate
  56. license for each computer to which the SOFTWARE is distributed.
  57.  
  58. COPYRIGHT. The SOFTWARE is owned by Northwest Performance Software,
  59. Inc., a licensee of Kirk V. Thomas, and is protected by United States
  60. copyright laws and international treaty provisions. Therefore, you
  61. must treat the SOFTWARE like any other copyrighted material
  62. (e.g. a book or musical recording) except that you may either
  63. (a) make one copy of the SOFTWARE solely for backup or archival
  64. purposes, or (b) transfer the SOFTWARE to a single hard disk provided
  65. you keep the original solely for backup or archival purposes.  You
  66. may not copy the written materials accompanying the SOFTWARE.
  67. Registered versions SHALL NOT BE DISTRIBUTED.

  69. TRIAL USE COPYRIGHT ADDENDUM.
  70. "Unregistered" trial versions of the SOFTWARE may be uploaded
  71. to bulletin boards or to World Wide Web Software repositories or
  72. CDROM collections for the strict purpose of download and distribution
  73. to other users.
  74.  
  75. OTHER RESTRICTIONS.  You may not lease, rent or sub-license the
  76. SOFTWARE. You may transfer the SOFTWARE and accompanying written
  77. materials on a permanent basis provided you retain no copies and the
  78. recipient agrees to the terms of this Agreement.  You may not
  79. reverse engineer, decompile, or disassemble the SOFTWARE.

  81. EXPORT CONTROLS. None of the SOFTWARE or underlying information or
  82. technology may be downloaded or otherwise exported or reexported
  83. (i) into (or to a national or resident of) Cuba, Iraq, Libya, North
  84. Korea, Iran, Syria or any other country to which the U.S. has
  85. embargoed goods; or (ii) to anyone on the U.S. Treasury Department's
  86. list of Specially Designated Nationals or the U.S. Commerce
  87. Department's Table of Deny Orders. By downloading or using the
  88. SOFTWARE, you are agreeing to the foregoing and you are representing
  89. and warranting that you are not located in, under the control of, or
  90. a national or resident of any such country or on any such list.
  91.  
  92. U.S. Government RESTRICTED RIGHTS. The SOFTWARE and documentation
  93. are provided with RESTRICTED RIGHTS. Use, duplication, or disclosure
  94. by the Government is subject to restrictions as set forth in
  95. subparagraph (c)(1)(ii) of The Rights in Technical Data and Computer
  96. Software clause at DFARS 252.227-7013 or subparagraphs (c)(1) and
  97. (2) of the Commercial Computer Software--Restricted Rights at
  98. 48 CFR 52.227-19, as applicable. Manufacturer is Northwest
  99. Performance Software, Inc./PO BOX 148/Maple Valley, WA 98038-0148.

  101. TRIAL USE LIMITATIONS--NO WARRANTIES.
  102. Northwest Performance Software, Inc. expressly disclaims any
  103. warranty for NetScanTools during the Trail Usage Period.
  104. NetScanTools and any related documentation is provided "as is"
  105. without warranty of any kind, either express or implied,
  106. including without limitation, the implied warranties or
  107. merchantability, fitness for a particular purpose, or
  108. infringement. The entire risk arising out of use or
  109. performance of NetScanTools remains with you.
  110.  
  111. REGISTERED VERSION LIMITED WARRANTY.
  112. Northwest Performance Software warrants that the registered version
  113. of the SOFTWARE is properly recorded on the disk media delivered
  114. to the end-user, if any. This warranty extends for sixty (60) days
  115. from the date of purchase. There is no warranty after the expiration
  116. of the warranty period.
  117.  
  118. REGISTERED VERSION CUSTOMER REMEDIES.
  119. Northwest Performance Software's entire liability
  120. and your exclusive remedy shall be, at Northwest Performance
  121. Software's option, either (a) return of the price paid, or (b) repair
  122. or replacement of the SOFTWARE that does not meet Northwest
  123. Performance Software's Limited Warranty and which is returned to
  124. Northwest Performance Software with a copy of your receipt. This
  125. Limited Warranty is void if failure of the SOFTWARE has resulted from
  126. accident, abuse, or misapplication. Any replacement SOFTWARE will be
  127. warranted for the remainder of the original warranty period or
  128. 30 days, whichever is longer. In no event shall Northwest
  129. Performance Software's liability exceed the purchase price of the
  130. SOFTWARE.

  132. NO OTHER WARRANTIES. To the maximum extent permitted by applicable
  133. law, Northwest Performance Software, Inc. disclaims all other
  134. warranties, either expressed or implied, including, but not limited
  135. to, implied warranties of merchantability, fitness for a particular
  136. purpose, title, and non-infringement, with regard to the SOFTWARE,
  137. the accompanying written materials, and any accompanying hardware.
  138. This limited warranty gives you specific legal rights. You may have
  139. others, which vary from state to state.
  140.  
  141. Northwest Performance Software does not warrant that the operation
  142. of the software will be error free.
  143.  
  144. NO LIABILITY FOR CONSEQUENTIAL DAMAGES. In no event shall the author,
  145. Kirk V. Thomas or Northwest Performance Software, Inc. or its
  146. suppliers be liable for any special, incidental, indirect, or
  147. consequential damages whatsoever (including, without limitation,
  148. damages for loss of business profits, business interruption, loss of
  149. business information, or any other pecuniary loss) arising out of the
  150. use of or inability to use the SOFTWARE, even if Northwest
  151. Performance Software/author has been advised of the possibility of
  152. such damages. Because some states/jurisdictions do not allow the
  153. exclusion or limitation of liability for consequential or incidental
  154. damages, the above limitation may not apply to you.

  156. This agreement is governed by the laws of the state of Washington.
