  29.  SOFTWARE LICENSE
  30.  
  31.  Non-licensed users are granted a limited license to use
  32.  TWinExplorer on a 30-day trial basis for the purpose of
  33.  determining whether TWinExplorer is suitable for their
  34.  needs.  The use of TWinExplorer, except for the initial
  35.  30-day trial, requires registration.  The use of
  36.  unlicensed copies of TWinExplorer, outside of the initial
  37.  30-day trial, by any person, business, corporation,
  38.  government agency or any other entity is strictly
  39.  prohibited.

  41.  A license for personal use that grants
  42.  the user the right to use TWinExplorer on one computer may be purchased.
  43.  A commercial license requires sufficient licensing
  44.  equal to the number of users, or the quantity
  45.  of workstations that access the software, whichever is
  46.  smaller.

  48.  No one may modify or patch the TWinExplorer executable files
  49.  in any way, including but not limited to decompiling,
  50.  disassembling, or otherwise reverse engineering the
  51.  programs.

  53.  A limited license is granted to copy and distribute
  54.  TWinExplorer only for the trial use of others, subject
  55.  to the above limitations, and also the following:
  56.  
  57.   1)    TWinExplorer and all of its release files must be
  58.         copied in unmodified form, complete with the file
  59.         containing this license information.

  61.   2)    No fee, charge, or other compensation may be requested
  62.         or accepted, except as authorized below:

  64.         A) Operators of electronic bulletin board systems
  65.            (sysops) may make TWinExplorer available for down-
  66.            loading only as long as the above conditions are
  67.            met.  An overall or time-dependent charge for the
  68.            use of the bulletin board system is permitted as
  69.            long as there is not a specific charge for the
  70.            download of TWinExplorer.

  72.         B) Vendors of user-supported or shareware software
  73.            approved by the ASP may distribute TWinExplorer,
  74.            subject to the above conditions, without specific
  75.            permission.

  77.         C) Non-profit user groups may distribute copies of
  78.            the TWinExplorer diskette to their members,
  79.            subject to the above conditions, without specific
  80.            permission.  Non-profit groups may collect a disk
  81.            duplication fee not to exceed five dollars.

  83.   LIMITED WARRANTY

  85.   PEPSOFTWARE DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR
  86.   IMPLIED, INCLUDING, BUT NOT LIMITED TO IMPLIED WARRANTIES
  87.   OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE,
  88.   WITH RESPECT TO THE PRODUCT.  SHOULD THE PROGRAM PROVE
  89.   DEFECTIVE, THE PURCHASER ASSUMES THE RISK OF PAYING THE
  90.   ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR 
  91.   CORRECTION AND ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES.
  92.   IN NO EVENT WILL PEPSOFTWARE BE LIABLE FOR ANY DAMAGES WHATSOEVER
  93.   (INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF
  94.   BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS
  95.   INFORMATION AND THE LIKE) ARISING OUT OF THE USE OR THE
  96.   INABILITY TO USE THIS PRODUCT EVEN IF PEPSOFTWARE
  97.   HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
