  1. END-USER LICENSE AGREEMENT FOR ASCIT BV - ThunderStore[r]
  2. applying for "SOFTWARE PRODUCT" containing  ThunderGuard -
  3. ThunderCrypt - ThunderSafe - ThunderLock - ThunderVPN -
  4. ThunderNet - ThunderWall - ThunderTrack - ThunderSec.

  6. IMPORTANT-READ CAREFULLY:
  7. This End-User License Agreement ("EULA") is a legal
  8. agreement between you (either an individual or a single
  9. entity) ASCIT BV and it's global ThunderStore Partners
  10. ("Thunderstore Partner") where you acquired the
  11. ThunderStore software product(s) identified above
  12. ("SOFTWARE PRODUCT" or "SOFTWARE").   The SOFTWARE PRODUCT
  13. includes computer software, the associated media, any
  14. printed materials, and any "online" or electronic
  15. version/documentation.  By installing, copying or otherwise
  16. using the SOFTWARE PRODUCT, you agree to be bound by the
  17. terms of this EULA.  If you do not agree to the terms of
  18. this EULA, ASCIT BV and it's ThunderStore Partners are
  19. unwilling to license the SOFTWARE PRODUCT to you.  In such
  20. event, you may not use or copy the SOFTWARE PRODUCT, and
  21. you should promptly contact Your ThunderStore Partner for
  22. instructions on return of the unused product(s) for a refund.

  25. SOFTWARE PRODUCT LICENSE
  26. The SOFTWARE PRODUCT is protected by copyright laws and
  27. international copyright treaties, as well as other
  28. intellectual property laws and treaties.  The SOFTWARE
  29. PRODUCT is licensed, not sold.
  30.  
  31. 1. GRANT OF LICENSE.
  32. This EULA grants you the following rights:
  33.  
  34.   * Software.  You may install and use one copy of the
  35.   SOFTWARE PRODUCT on your computer.
  36.  
  37.   * Network Services.  If the SOFTWARE PRODUCT includes
  38.   functionality that enables your computer to act as a
  39.   network server, any number of computers or workstations may
  40.   access or otherwise utilize the basic network services of
  41.   that server.  The basic network services are more fully
  42.   described in the printed materials accompanying the
  43.   SOFTWARE PRODUCT.

  45.   * Storage/Network Use.  You may also store or install a
  46.   copy of the computer software portion of the SOFTWARE
  47.   PRODUCT on the computer to allow your other computers to
  48.   use the SOFTWARE PRODUCT over an internal network, and
  49.   distribute the SOFTWARE PRODUCT to your other computers
  50.   over an internal network.  However, you must acquire and
  51.   dedicate a CORPORATE License for the SOFTWARE PRODUCT for
  52.   each computer on which the SOFTWARE PRODUCT is used or to
  53.   which it is distributed.  A Corporate license for the
  54.   SOFTWARE PRODUCT may not be shared or used concurrently on
  55.   different computers.

  57.   * Operating System Choice.  you are licensed to use one of
  58.   the available operating system choices provided.  As part
  59.   of the setup process for the SOFTWARE you will be given a
  60.   one-time option to choose either Windows 95 or an Alternate
  61.   OS.  Upon selection, the operating system choice selected
  62.   by you will be used by the SOFTWARE set up on the computer.

  65. 2. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.

  67.   * Limitations on Reverse Engineering, Decompilation and
  68.   Disassembly.  You may not reverse engineer, decompile, or
  69.   disassemble the SOFTWARE PRODUCT, except and only to the
  70.   extent that such activity is expressly permitted by
  71.   applicable law notwithstanding this limitation.

  73.   * Separation of Components.  The SOFTWARE PRODUCT is
  74.   licensed as a single product.  Its component parts may not
  75.   be separated for use on more than one computer.
  76.  
  77.   * Rental.  You may not rent or lease the SOFTWARE PRODUCT.

  79.   * Software Transfer.  You may permanently transfer all of
  80.   your rights under this EULA only as part of a sale or
  81.   transfer of the computer, provided you retain no copies,
  82.   you transfer all of the SOFTWARE PRODUCT (including all
  83.   component parts, the media and printed materials, any
  84.   upgrades, this EULA and, if applicable, the Certificate(s)
  85.   of Authenticity), AND the recipient agrees to the terms of
  86.   this EULA.  If the SOFTWARE PRODUCT is an upgrade, any
  87.   transfer must include all prior versions of the SOFTWARE
  88.   PRODUCT.

  90.   * Termination.  Without prejudice to any other rights,
  91.   ASCIT may terminate this EULA if you fail to comply with
  92.   the terms and conditions of this EULA.  In such event, you
  93.   must destroy all copies of the SOFTWARE PRODUCT and all of
  94.   its component parts.

  97. 3. UPGRADES.
  98. If the SOFTWARE PRODUCT is an upgrade from another
  99. product, whether from ASCIT or another supplier, you may
  100. use or transfer the SOFTWARE PRODUCT only in conjunction
  101. with that upgraded product, unless you destroy the upgraded
  102. product.  If the SOFTWARE PRODUCT is an upgrade of a
  103. ThunderStore product, you now may use that upgraded product
  104. only in accordance with this EULA.  If the SOFTWARE PRODUCT
  105. is an upgrade of a component of a package of software
  106. programs which you licensed as a single product, the
  107. SOFTWARE PRODUCT may be used and transferred only as part
  108. of that single product package and may not be separated for
  109. use on more than one computer.

  112. 4. OEM COPYRIGHT.
  113. All title and copyrights in and to the SOFTWARE PRODUCT
  114. (including but not limited to any images, photographs,
  115. animations, video, audio, music, text and "applets,"
  116. incorporated into the SOFTWARE PRODUCT), the accompanying
  117. printed materials, and any copies of the SOFTWARE PRODUCT,
  118. are owned by ASCIT or its ThunderStore Partners.  The
  119. SOFTWARE PRODUCT is protected by copyright laws and
  120. international treaty provisions..  You may not copy the
  121. printed materials accompanying the SOFTWARE PRODUCT.

  124. 5. DUAL-MEDIA SOFTWARE.
  125. You may receive the SOFTWARE PRODUCT in more than one
  126. medium. Regardless of the type or size of medium you
  127. receive, you may use only one medium that is appropriate
  128. for your single computer.  You may not use or install the
  129. other medium on another computer.  You may not loan, rent,
  130. lease, or otherwise transfer the other medium to another
  131. user, except as part of the permanent transfer (as provided
  132. above) of the SOFTWARE PRODUCT.

  135. 6. OEM PRODUCT SUPPORT.
  136. Product support for the SOFTWARE PRODUCT is NOT provided
  137. by ASCIT or its subsidiaries.  For product support, please
  138. refer to ThunderStore Partner's support number provided in
  139. the documentation.  Should you have any questions
  140. concerning this EULA, or if you desire to contact the
  141. ThunderStore Partner for any other reason, please refer to
  142. the address provided in the documentation or SOFTWARE.

  145. 7. OEM U.S. GOVERNMENT RESTRICTED RIGHTS.
  146. The SOFTWARE PRODUCT and documentation are provided with
  147. RESTRICTED RIGHTS.  Use, duplication, or disclosure by the
  148. Government is subject to restrictions as set forth in
  149. subparagraph (c)(1)(ii) of the Rights in Technical Data and
  150. Computer Software clause at DFARS 252.227-7013 or
  151. subparagraphs (c)(1) and (2) of the Commercial Computer
  152. Software-Restricted Rights at 48 CFR 52.227-19, as
  153. applicable. Manufacturer is ASCIT BV/ Ant. van der
  154. Heydenstraat 2/ 5527 BV Hapert, The Netherlands.

  156. THIS SOFTWARE AND THE ACCOMPANYING FILES ARE licensed "AS
  157. IS" AND WITHOUT WARRANTIES AS TO PERFORMANCE OR
  158. MERCHANTABILITY OR ANY OTHER WARRANTIES WHETHER EXPRESSED
  159. OR IMPLIED.  In particular, there is no warranty for the
  160. optional virus scanning feature (SOFTWARE PRODUCT does not
  161. scan for viruses, it simply runs external programs that
  162. claim to perform this function).  Because of the various
  163. hardware and software environments into which SOFTWARE
  164. PRODUCTS may be put, NO WARRANTY OF FITNESS FOR A
  165. PARTICULAR PURPOSE IS OFFERED.

  167. Good data processing procedure dictates that any program
  168. be thoroughly tested with non-critical data before relying
  169. on it. The user must assume the entire risk of using the
  170. program.  ANY LIABILITY OF THE SELLER WILL BE LIMITED
  171. EXCLUSIVELY TO PRODUCT REPLACEMENT OR REFUND OF PURCHASE
  172. PRICE.

  175. 8 - EVALUATION VERSION OF SOFTWARE PRODUCTS
  176. Evaluation and Registration. This is not free software.
  177. Subject to the terms below, you are hereby licensed to use
  178. the SOFTWARE PRODUCT for evaluation purposes without charge
  179. for a period of 30 days.  If you use this software after
  180. the 30 day evaluation period a registration fee of $69 per
  181. End user license is required.  Payments must be in US
  182. dollars drawn on a Dutch bank, and should be sent to ASCIT
  183. BV/ Ant. van der Heydenstraat 2/ 5527 BV Hapert, The
  184. Netherlands.  Credit card ordering and quantity discounts
  185. are available, as described in the section Ordering
  186. Information/Order Form.  When payment is received you will
  187. be sent a registered copy of the latest version of the
  188. SOFTWARE PRODUCT.

  190. ZIP files of the SOFTWARE PRODUCT (distributed as part of
  191. the evaluation package) contain, among other things, a
  192. portion of  copyrighted software, proprietary notices, and
  193. identifying information. You may not alter or modify the
  194. Extraction Software and cannot give anyone else permission
  195. to modify the Extraction Software.

  197. Unregistered use of the SOFTWARE PRODUCT after the 30-day
  198. evaluation period is in violation of U.S. and international
  199. copyright laws.
  200.  
  201. 9- DISTRIBUTION
  202. Provided that you verify that you are distributing the
  203. evaluation version (select About from the SOFTWARE Help
  204. menu to check) you are hereby licensed to make as many
  205. copies of the evaluation version of this software and/or
  206. documentation as you wish; give exact copies of the
  207. original evaluation version to anyone; and distribute the
  208. evaluation version of the software and/or documentation in
  209. its unmodified form via electronic means.  There is no
  210. charge for any of the above. You are specifically
  211. prohibited from charging, or requesting donations, for any
  212. such copies, however made; and from distributing the
  213. software and/or documentation with other products
  214. (commercial or otherwise) without prior written permission
  215. from ASCIT.

  217. If you do not have a valid evaluation version or license
  218. to use the SOFTWARE PRODUCT, you may not use the Software.
  219. Any other use of the Software is prohibited.
  220.  
  221. ThunderStore and its related SOFTWARE PRODUCT(s) and
  222. brandnames are registered trade names protected and
  223. copyright owned by ASCIT BV, The Netherlands.
