  6. READ THE TERMS OF THIS AGREEMENT AND ANY PROVIDED
  7. SUPPLEMENTAL LICENSE TERMS (COLLECTIVELY "AGREEMENT")
  8. CAREFULLY BEFORE OPENING THE SOFTWARE MEDIA PACKAGE.  BY
  9. OPENING THE SOFTWARE MEDIA PACKAGE, YOU AGREE TO THE TERMS
  10. OF THIS AGREEMENT.  IF YOU ARE ACCESSING THE SOFTWARE
  11. ELECTRONICALLY, INDICATE YOUR ACCEPTANCE OF THESE TERMS BY
  12. SELECTING THE "ACCEPT" BUTTON AT THE END OF THIS AGREEMENT.
  13. IF YOU DO NOT AGREE TO ALL OF THESE TERMS, PROMPTLY RETURN
  14. THE UNUSED SOFTWARE TO YOUR PLACE OF PURCHASE FOR A REFUND
  15. OR, IF THE SOFTWARE IS ACCESSED ELECTRONICALLY, SELECT THE
  16. "DECLINE" BUTTON AT THE END OF THIS AGREEMENT AND THE
  17. INSTALLATION PROCESS WILL NOT CONTINUE.

  19.  
  20. 1.  License to Use.  Sun Microsystems, Inc.  ("Sun") grants
  21. you a non-exclusive and non-transferable license for the
  22. internal use only of the accompanying software,
  23. documentation and any error corrections provided by Sun
  24. (collectively "Software"), by the number of users and the
  25. class of computer hardware for which the corresponding fee
  26. has been paid.
  27.

  29. 2.  Restrictions.  Software is confidential and copyrighted.
  30. Title to Software and all associated intellectual property
  31. rights is retained by Sun and/or its licensors.  Except as
  32. specifically authorized in any Supplemental License Terms,
  33. you may not make copies of Software, other than a single
  34. copy of Software for archival purposes.  Unless enforcement
  35. is prohibited by applicable law, you may not modify,
  36. decompile, or reverse engineer Software.  You acknowledge
  37. that Software is not designed, licensed or intended for use
  38. in the design, construction, operation or maintenance of any
  39. nuclear facility.  Sun disclaims any express or implied
  40. warranty of fitness for such uses.  No right, title or
  41. interest in or to any trademark, service mark, logo or trade
  42. name of Sun or its licensors is granted under this
  43. Agreement.

  46. 3.  Limited Warranty.  Sun warrants to you that for a period
  47. of ninety (90) days from the date of purchase, as evidenced
  48. by a copy of the receipt, the media on which Software is
  49. furnished (if any) will be free of defects in materials and
  50. workmanship under normal use.  Except for the foregoing,
  51. Software is provided "AS IS".  Your exclusive remedy and
  52. Sun's entire liability under this limited warranty will be
  53. at Sun's option to replace Software media or refund the fee
  54. paid for Software.

  57. 4.  DISCLAIMER OF WARRANTY.  UNLESS SPECIFIED IN THIS
  58. AGREEMENT, ALL EXPRESS OR IMPLIED CONDITIONS,
  59. REPRESENTATIONS AND WARRANTIES, INCLUDING ANY IMPLIED
  60. WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR
  61. PURPOSE OR NON-INFRINGEMENT ARE DISCLAIMED, EXCEPT TO THE
  62. EXTENT THAT THESE DISCLAIMERS ARE HELD TO BE LEGALLY
  63. INVALID.

  66. 5.  LIMITATION OF LIABILITY.  TO THE EXTENT NOT PROHIBITED
  67. BY LAW, IN NO EVENT WILL SUN OR ITS LICENSORS BE LIABLE FOR
  68. ANY LOST REVENUE, PROFIT OR DATA, OR FOR SPECIAL, INDIRECT,
  69. CONSEQUENTIAL, INCIDENTAL OR PUNITIVE DAMAGES, HOWEVER
  70. CAUSED REGARDLESS OF THE THEORY OF LIABILITY, ARISING OUT OF
  71. OR RELATED TO THE USE OF OR INABILITY TO USE SOFTWARE, EVEN
  72. IF SUN HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
  73. In no event will Sun's liability to you, whether in
  74. contract, tort (including negligence), or otherwise, exceed
  75. the amount paid by you for Software under this Agreement.
  76. The foregoing limitations will apply even if the above
  77. stated warranty fails of its essential purpose.

  80. 6.  Termination.  This Agreement is effective until
  81. terminated.  You may terminate this Agreement at any time by
  82. destroying all copies of Software.  This Agreement will
  83. terminate immediately without notice from Sun if you fail to
  84. comply with any provision of this Agreement.  Upon
  85. Termination, you must destroy all copies of Software.

  88. 7.  Export Regulations.  All Software and any technical data
  89. delivered under this Agreement are subject to US export
  90. control laws and may be subject to export or import
  91. regulations in other countries.  You agree to comply
  92. strictly with all such laws and regulations and acknowledge
  93. that you have the responsibility to obtain such licenses to
  94. export, re-export, or import as may be required after
  95. delivery to you.

  98. 8.  U.S.  Government Restricted Rights.  If Software is
  99. being acquired by or on behalf of the U.S.  Government or by
  100. a U.S.  Government prime contractor or subcontractor (at any
  101. tier), then the Government's rights in Software and
  102. accompanying documentation will be only as set forth in this
  103. Agreement; this is in accordance with 48 C.F.R.  227.7202-4
  104. (for Department of Defense (DOD) acquisitions) and with 48
  105. C.F.R.  2.101 and 12.212 (for non-DOD acquisitions).

  108. 9.  Governing Law.  Any action related to this Agreement
  109. will be governed by California law and controlling U.S.
  110. federal law.  No choice of law rules of any jurisdiction
  111. will apply.

  113.  
  114. 10.  Severability.  If any provision of this Agreement is
  115. held to be unenforceable, this Agreement will remain in
  116. effect with the provision omitted, unless omission would
  117. frustrate the intent of the parties, in which case this
  118. Agreement will immediately terminate.

  120.  
  121. 11.  Integration.  This Agreement is the entire agreement
  122. between you and Sun relating to its subject matter.  It
  123. supersedes all prior or contemporaneous oral or written
  124. communications, proposals, representations and warranties
  125. and prevails over any conflicting or additional terms of any
  126. quote, order, acknowledgment, or other communication between
  127. the parties relating to its subject matter during the term
  128. of this Agreement.  No modification of this Agreement will
  129. be binding, unless in writing and signed by an authorized
  130. representative of each party.

  139. SUPPLEMENTAL LICENSE TERMS
  140.  
  141.  
  142. These supplemental license terms ("Supplemental Terms") add
  143. to or modify the terms of the Binary Code License Agreement
  144. (collectively, the "Agreement").  Capitalized terms not
  145. defined in these Supplemental Terms shall have the same
  146. meanings ascribed to them in the Agreement.  These
  147. Supplemental Terms shall supersede any inconsistent or
  148. conflicting terms in the Agreement, or in any license
  149. contained within the Software.
  150.  
  151. 1.  Software Internal Use and Development License Grant.
  152. Subject to the terms and conditions of this Agreement,
  153. including, but not limited to Section 4 (Java(TM) Technology
  154. Restrictions) of these Supplemental Terms, Sun grants you a
  155. non-exclusive, non-transferable, limited license to
  156. reproduce internally and use internally the binary form of
  157. the Software complete and unmodified for the sole purpose of
  158. designing, developing and testing your Java applets and
  159. applications intended to run on the Java platform
  160. ("Programs").

  162. 2.  License to Distribute Software.  Subject to the terms
  163. and conditions of this Agreement, including, but not limited
  164. to Section 4 (Java (TM) Technology Restrictions) of these
  165. Supplemental Terms, Sun grants you a non-exclusive,
  166. non-transferable, limited license to reproduce and
  167. distribute the Software in binary code form only, provided
  168. that (i) you distribute the Software complete and unmodified
  169. and only bundled as part of, and for the sole purpose of
  170. running, your Programs, (ii) the Programs add significant
  171. and primary functionality to the Software, (iii) you do not
  172. distribute additional software intended to replace any
  173. component(s) of the Software, (iv) you do not remove or
  174. alter any proprietary legends or notices contained in the
  175. Software, (v) you only distribute the Software subject to a
  176. license agreement that protects Sun's interests consistent
  177. with the terms contained in this Agreement, and (vi) you
  178. agree to defend and indemnify Sun and its licensors from and
  179. against any damages, costs, liabilities, settlement amounts
  180. and/or expenses (including attorneys' fees) incurred in
  181. connection with any claim, lawsuit or action by any third
  182. party that arises or results from the use or distribution of
  183. any and all Programs and/or Software.
  184.  
  185. 3.  License to Distribute Redistributables.  Subject to the
  186. terms and conditions of this Agreement, including but not
  187. limited to Section 4 (Java Technology Restrictions) of these
  188. Supplemental Terms, Sun grants you a non-exclusive,
  189. non-transferable, limited license to reproduce and
  190. distribute the binary form of those files specifically
  191. identified as redistributable in the Software "README" file
  192. ("Redistributables") provided that:  (i) you distribute the
  193. Redistributables complete and unmodified (unless otherwise
  194. specified in the applicable README file), and only bundled
  195. as part of Programs, (ii) you do not distribute additional
  196. software intended to supersede any component(s) of the
  197. Redistributables, (iii) you do not remove or alter any
  198. proprietary legends or notices contained in or on the
  199. Redistributables, (iv) you only distribute the
  200. Redistributables pursuant to a license agreement that
  201. protects Sun's interests consistent with the terms contained
  202. in the Agreement, and (v) you agree to defend and indemnify
  203. Sun and its licensors from and against any damages, costs,
  204. liabilities, settlement amounts and/or expenses (including
  205. attorneys' fees) incurred in connection with any claim,
  206. lawsuit or action by any third party that arises or results
  207. from the use or distribution of any and all Programs and/or
  208. Software.
  209.  
  210. 4.  Java Technology Restrictions.  You may not modify the
  211. Java Platform Interface ("JPI", identified as classes
  212. contained within the "java" package or any subpackages of
  213. the "java" package), by creating additional classes within
  214. the JPI or otherwise causing the addition to or modification
  215. of the classes in the JPI.  In the event that you create an
  216. additional class and associated API(s) which (i) extends the
  217. functionality of the Java platform, and (ii) is exposed to
  218. third party software developers for the purpose of
  219. developing additional software which invokes such additional
  220. API, you must promptly publish broadly an accurate
  221. specification for such API for free use by all developers.
  222. You may not create, or authorize your licensees to create,
  223. additional classes, interfaces, or subpackages that are in
  224. any way identified as "java", "javax", "sun" or similar
  225. convention as specified by Sun in any naming convention
  226. designation.
  227.  
  228. 5.  Trademarks and Logos.  You acknowledge and agree as
  229. between you and Sun that Sun owns the SUN, SOLARIS, JAVA,
  230. JINI, FORTE, and iPLANET trademarks and all SUN, SOLARIS,
  231. JAVA, JINI, FORTE, and iPLANET-related trademarks, service
  232. marks, logos and other brand designations ("Sun Marks"), and
  233. you agree to comply with the Sun Trademark and Logo Usage
  234. Requirements currently located at
  235. http://www.sun.com/policies/trademarks.  Any use you make of
  236. the Sun Marks inures to Sun's benefit.

  238. 6.  Source Code.  Software may contain source code that is
  239. provided solely for reference purposes pursuant to the terms
  240. of this Agreement.  Source code may not be redistributed
  241. unless expressly provided for in this Agreement.
  242.  
  243. 7.  Termination for Infringement.  Either party may
  244. terminate this Agreement immediately should any Software
  245. become, or in either party's opinion be likely to become,
  246. the subject of a claim of infringement of any intellectual
  247. property right.
