  1. IMPORTANT - READ THIS BEFORE INSTALLING: By installing, using, or
  2. reproducing the enclosed materials, you are agreeing to be bound by the
  3. terms of this agreement.  If you do not agree to them, do not install
  4. or use this software.

  6. Intel Indeo(R) video Software License Agreement
  7.  
  8. LICENSE: Subject to the Restrictions below, Intel Corporation ("Intel")
  9. grants to you the following non-exclusive, non-assignable, royalty-free
  10. copyright licenses in the "Materials" below, which are identified
  11. specifically in the enclosed documentation.
  12. End-User Documentation includes textual materials intended for end
  13. users.  You may copy, modify and distribute them.
  14. Licensed Binaries are redistributable code provided in binary form.
  15. You may copy and distribute Licensed Binaries with your product.
  16.  
  17. RESTRICTIONS: You will make reasonable efforts to discontinue
  18. distribution of the enclosed Materials upon Intel's release of an
  19. update, upgrade or new version of the Materials and to make reasonable
  20. efforts to distribute such updates, upgrades or new versions to your
  21. customers who have received the Materials herein.
  22.  
  23. You may not reverse-assemble, reverse-compile, or otherwise
  24. reverse-engineer any software provided solely in binary form.
  25.  
  26. Distribution of the Materials is also subject to the following
  27. limitations you (i) shall be solely responsible to your customers for
  28. any update or support obligation or other liability which may arise
  29. from the distribution, (ii) do not make any statement that your product
  30. is "certified," or that its performance is guaranteed, by Intel, (iii)
  31. do not use Intel's name or trademarks to market your product without
  32. written permission, (iv) shall prohibit disassembly and reverse
  33. engineering, and (v) shall indemnify, hold harmless, and defend Intel
  34. and its suppliers from and against any claims or lawsuits, including
  35. attorney's fees, that arise or result from your distribution of any
  36. product.

  38. COPYRIGHT: Title to the Materials and all copies thereof remain with
  39. Intel or its suppliers.  The Materials are copyrighted and are
  40. protected by United States copyright laws and international treaty
  41. provisions.  You will not remove any copyright notice from the
  42. Materials.  You agree to prevent any unauthorized copying of the
  43. Materials.  Except as expressly provided herein, Intel does not grant
  44. any express or implied right to you under Intel patents, copyrights,
  45. trademarks, or trade secret information.

  47. REPLACEMENTS: The Materials are provided "AS IS" without warranty of
  48. any kind.  If the media on which the Materials are furnished are found
  49. to be defective in material or workmanship under normal use for a
  50. period of ninety (90) days from the date of receipt, Intel's entire
  51. liability and your exclusive remedy shall be the replacement of the
  52. media.  This offer is void if the media defect results from accident,
  53. abuse, or misapplication.

  55. LIMITATION OF LIABILITY: THE ABOVE REPLACEMENT PROVISION IS THE ONLY
  56. WARRANTY OF ANY KIND.  INTEL OFFERS NO OTHER WARRANTY EITHER EXPRESS OR
  57. IMPLIED INCLUDING THOSE OF MERCHANTABILITY, NONINFRINGEMENT OF THIRD-
  58. PARTY INTELLECTUAL PROPERTY OR FITNESS FOR A PARTICULAR PURPOSE.
  59. NEITHER INTEL NOR ITS SUPPLIERS SHALL BE LIABLE FOR ANY DAMAGES
  60. WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS
  61. PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHER
  62. LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN
  63. IF INTEL HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  BECAUSE
  64. SOME JURISDICTIONS PROHIBIT THE EXCLUSION OR LIMITATION OF LIABILITY
  65. FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT
  66. APPLY TO YOU.

  68. TERMINATION OF THIS LICENSE: Intel may terminate this license at any
  69. time if you are in breach of any of its terms and conditions.  Upon
  70. termination, you will immediately destroy the Materials or return all
  71. copies of the Materials to Intel along with any copies you have made.

  73. U.S. GOVERNMENT RESTRICTED RIGHTS: The Materials are provided with
  74. "RESTRICTED RIGHTS."  Use, duplication or disclosure by the Government
  75. is subject to restrictions set forth in FAR52.227-14 and
  76. DFAR252.227-7013 et seq. or its successor.  Use of the Materials by
  77. the Government constitutes acknowledgment of Intel's rights in them.

  79. APPLICABLE LAWS: Any claim arising under or relating to this Agreement
  80. shall be governed by the internal substantive laws of the State of
  81. Delaware or federal courts located in Delaware, without regard to
  82. principles of conflict of laws.  You may not export the Materials in
  83. violation of applicable export laws.
