  1. COMPUSERVE INFORMATION SERVICE OPERATING RULES

  3. A.  INTRODUCTION
  4.  
  5. These Operating Rules are provided to help make online 
  6. information usage and communications a positive and secure 
  7. experience for members.  Members agree during the online sign up 
  8. procedure to the terms and conditions outlined in these 
  9. Operating Rules.  These Operating Rules are part of the terms of 
  10. your Service Agreement with CompuServe, and you are bound by 
  11. them. The definitions used in the Service Agreement will also 
  12. apply to these Operating Rules. CompuServe may modify these 
  13. rulexs at any time by publishing the modified rule(s) over the 
  14. Service.

  16. B.  COMPUSERVE COPYRIGHT

  18. The content on the Service is protected as a collective work 
  19. under applicable copyright law. The copying, redistribution, or 
  20. publication by member of any such content or any part of the 
  21. Service is prohibited, except as expressly provided in these 
  22. Operating Rules.

  24. Each member who places information, software or other content, 
  25. in the public areas of the Service grants CompuServe the right 
  26. to edit, copy, publish, distribute, translate, and otherwise use 
  27. in connection with the Service, such information, software or 
  28. other content.  Subject to this grant, each member who places 
  29. information, software or other content on the Service retains 
  30. any rights member may have in such information, software or 
  31. other content.

  33. C.  COPYRIGHTED MATERIAL

  35. Copyrighted material must not be placed on the Service without 
  36. the permission of the owner(s) or person(s) they specifically 
  37. authorize. Only the owner(s) or such authorized person(s) may 
  38. upload copyrighted material to the Service.

  40. Members may download copyrighted material for their own use. 
  41. Except as expressly provided by copyright law, copying, 
  42. redistribution, or publication must be with the express 
  43. permission of CompuServe and the owner(s) or such authorized 
  44. person(s), if other than CompuServe. Permission must be 
  45. specified in the document, on the Service, or must be obtained 
  46. directly from CompuServe and the owner(s) or such authorized 
  47. persons(s), if other than CompuServe. In any copying, 
  48. redistribution, or publication of copyrighted material, any 
  49. changes to or deletion of author attribution or copyright notice 
  50. are prohibited.  Downloaded software may not be reverse 
  51. engineered unless specifically authorized by the owner of the 
  52. software's patent and/or copyright.

  54. D.  PUBLIC DOMAIN MATERIAL

  56. Any member may upload public domain programs to the Service. Any 
  57. member may download public domain programs for their own use or 
  58. non-commercially redistribute a public domain program. Member 
  59. assumes all risks regarding the determination of whether a 
  60. program is in the public domain.

  62. E.  CONTENT & USES OF THE SERVICE

  64. Member agrees not to publish on or over the Service any 
  65. information, software or other content which violates or 
  66. infringes upon the rights of any others or which would be 
  67. abusive, profane or offensive to an average person, or which, 
  68. without the approval of CompuServe, contains any advertising, 
  69. promotion or solicitation of goods or services for 
  70. commercial purposes. This paragraph, however, shall not be 
  71. interpreted to restrict member from utilizing CompuServe mail in 
  72. the conduct of a legitimate business except that member may not, 
  73. without the approval of CompuServe, send unsolicited advertising 
  74. or promotional material.

  76. Member agrees not to use the facilities and capabilities of the 
  77. Service to conduct any business or activity or solicit the 
  78. performance of any activity which is prohibited by law or to 
  79. solicit members to become members of other competitive 
  80. information services.  Member agrees to comply with all 
  81. applicable laws, rules and regulations in connection with the 
  82. Service or the Service Agreement.

  84. F.  EDITING, DELETING AND MANAGING CONTENT

  86. CompuServe reserves the right in its sole discretion to edit or 
  87. delete any information, software or other content appearing on 
  88. the Service, regardless of whether it violates applicable 
  89. standards for content.

  91. G.  SERVICE TERMINATION
  92.  
  93. CompuServe reserves the right in its sole discretion to suspend 
  94. or terminate Service to any member at any time.
  95.  
  96. H.  INDEMNIFICATION
  97.  
  98. Member agrees to indemnify and hold CompuServe harmless from any 
  99. claims and expenses, including reasonable attorney's fees, 
  100. related to member's violation of the Service Agreement, 
  101. including these rules or any information, software or other 
  102. content placed on the Service by the member.

  104. I.  USE OF ACCOUNT
  105.  
  106. Multiple members of the same household may share a single User 
  107. ID number account.  However, only one person is authorized to 
  108. access the Service at any given time on one User ID number 
  109. account.
