  83. Definitions.
  84. ~~~~~~~~~~~
  85. 'Software' or 'Program' means the ChaoSoft software product
  86. File Manager StepUp (FM StepUp), including both the software and the
  87. associated documentation and other materials;
  88.  
  89. 'Unregistered Copy' means a copy of the Program you obtained from
  90. us or other source for evaluation purposes and which is described
  91. as "Unregistered copy" in the 'About' screen. An Unregistered Copy
  92. may be converted to registered one by supplying a name of a
  93. registered user or institution and a correct Registration Code,
  94. which may be obtained from ChaoSoft.
  95.  
  96. 'Registered Copy' means a copy of the Program registered with
  97. ChaoSoft or with its authorized dealer, and which is described as
  98. "Registered to: <user name>" in the 'About' screen. A Registered
  99. Copy may be unregistered by copying it to another disk or
  100. computer, or by removing the registration information from an
  101. initialization file.
  102.  
  103. 'Registration Package' means all the materials you are obtaining
  104. from us after sending us your registration fee. In particular,
  105. Registration Package contains your personal Registration Code,
  106. allowing you to remove the registration reminder message and put
  107. your name in the 'About' screen.

  109. 'we' or 'us' means ChaoSoft, a company based in Old Town, Maine, USA;
  110.  
  111. and
  112.  
  113. 'you' means the end user or distributor of the Software.

  115. Legal Agreement.

  117. This is a legal agreement between you and ChaoSoft. By using or
  118. distributing the software you are agreeing to be bound by the
  119. terms of this agreement.

  123. ChaoSoft grants to you the right to use or distribute the Software
  124. under the terms of this agreement. The software is in "use" on a
  125. computer when it is loaded into the temporary memory (i.e., RAM)

  130. The software is NOT a public domain or free program. It is owned
  131. by ChaoSoft and is protected by United States copyright laws and
  132. international treaty provisions. Therefore, you must treat the
  133. Software like any other copyrighted material except that a limited
  134. right to make copies of the Software, subject to conditions of
  135. this license agreement, is granted to you. You may not copy any
  136. written or printed materials from your Registration Package and
  137. you may not rent or lease a Registered Copy of the Software.

  139. TRIAL USE LICENSE

  141. ChaoSoft grants to you a limited license to use an Unregistered
  142. Copy of this software for evaluation purposes for a period not to
  143. exceed 14 days.

  145. This period may be not a contiguous sequence of days. However, you
  146. should count a day as an evaluation day if you used the Program
  147. during that day at least once. The purpose of this evaluation
  148. period is to allow you to determine whether the program meets your
  149. needs before purchasing it.

  151. Once the evaluation period has ended, you MUST either purchase
  152. your copy of the Program through registration, or stop using it.
  153. Use of an Unregistered Copy beyond the end of the evaluation

  161. Registering the Program.

  164. correct amount of registration fee to us or one of our
  165. registration sites. You may use various registration forms
  166. supplied with the documentation to the Software. After getting
  167. your Registration Package from us, containing the Registration
  168. Code assigned to you,  you may use that code to convert your
  169. Unregistered Copy of the Software into Registered one.

  171. You agree to keep the Registration Code for your own use only and
  172. not to share it with anybody else.

  174. REGISTERED COPY USE LICENSE

  176. ChaoSoft grants to you the right to use a Registered Copy of the
  177. software, if you registered it with us and obtained your
  178. Registration Code.

  180. You may install a Registered copy of the software on more than one
  181. computer (for example, desktop system and portable notebook),
  182. provided that you are the only user of those computers and there
  183. is no possibility to use the Registered Copy by anybody else.

  185. You may not network a Registered Copy or otherwise use it on more
  186. than one computer or computer terminal at the same time unless you
  187. have obtained a site license from ChaoSoft.
  188.  
  189. If the Registered Copy you are using is registered to anybody
  190. else, you MUST either unregister it by removing the registration
  191. information, or stop using it. Use of a Registered Copy,
  192. registered to anybody else except you (or, for site license
  193. arrangements, to your organization), is in violation of federal
  194. copyright laws.

  196. Multi-User and Network Use.

  198. If you registered the Software for use by multiple users,  you
  199. agree not to use the Program on more computers than the number
  200. specified in your site license. You may install the Program on
  201. computers attached to a network, or remove it from one computer
  202. and install it on a different one, provided there is NO
  203. POSSIBILITY that your copy will be installed or used on more
  204. computers than it is licensed for.  If you have a network, you
  205. don't need to include every computer attached to the network in
  206. your license, but you must include every computer on which the
  207. Program is installed or used, regardless of whether the user of
  208. the computer happens to know that the Program is in use on their
  209. system.  If you have single computers which allow multiple users
  210. to use the Program simultaneously, you must count each keyboard or
  211. terminal separately when determining how many computers are using
  212. the Program.

  214. LIMITED DISTRIBUTION LICENSE

  271. Software. You are not allowed to make any modifications to, or to
  272. create derivative works from any of the files that are used in
  273. this software. This includes all the executable, help,
  274. installation, and documentation files, as well as graphics images.
  275. Any such unauthorized use shall result in immediate and automatic
  276. termination of this license.

  278. LIMITED WARRANTY

  280. The following limited warranty applies to Registered Copies of the
  281. Program. This warranty does NOT apply to Unregistered Copies of
  282. the Program.

  284. Satisfaction Guarantee.  If you are dissatisfied with any product
  285. you buy from us under this Agreement for any reason, you may
  286. return it at any time up to 30 days after purchase and we will
  287. give you a refund. Refunds will be based on the price you paid,
  288. with shipping costs excluded.  You must contact us before
  289. returning any product for a refund. This satisfaction guarantee
  290. does not apply to multi-system licenses for more than 10
  291. computers, or to purchases of more than 10 individual copies at a
  292. time.
  293.  
  294. Physical Defects.  We pledge that the disks, if any, and any
  295. printed material we send you will arrive free of physical defects
  296. which interfere with normal use. If you find such a defect and
  297. report it to us within 30 days after you get your Registration
  298. Package, we agree to replace the defective item(s) at no charge to
  299. you as long as the defect was not caused by misuse or abuse.

  301. Bugs and Program Errors.  We don't promise that the Software will
  302. be free of bugs or program errors, and you agree that bugs or
  303. program errors will not be considered as "physical defects" in the
  304. program. We agree that if you report a program error or bug to us,
  305. we will use our best efforts to correct it.

  353. Maine. The parties hereby consent to in personal jurisdiction of
  354. said courts.
