  5. YOUR USE OF THE TRIAL EDITION SOFTWARE DISTRIBUTED WITH THIS
  6. LICENSE IS SUBJECT TO ALL OF THE TERMS AND CONDITIONS OF
  7. THIS LICENSE STATEMENT. IF YOU DO NOT AGREE TO ALL OF THE
  8. TERMS AND CONDITIONS OF THIS STATEMENT, DO NOT USE THE
  9. SOFTWARE.

  11.   1. This Software is protected by copyright law and international copyright
  12.      treaty. Therefore, you must treat this Software just like a book,
  13.      except that you may copy it onto a computer to be used and you may make
  14.      archive copies of the Software for the sole purpose of backing up our
  15.      Software and protecting your investment from loss. Your use of this
  16.      Software is limited to evaluation and trial use purposes only.

  18.      FURTHER, THIS SOFTWARE CONTAINS A TIME-OUT FEATURE THAT
  19.      DISABLES ITS OPERATION AFTER A CERTAIN PERIOD OF TIME.
  20.      A TEXT FILE DELIVERED WITH THE SOFTWARE WILL STATE THE
  21.      TIME PERIOD AND/OR SPECIFIC DATE ("EVALUATION PERIOD")
  22.      ON WHICH THE SOFTWARE WILL EXPIRE. Though Borland does
  23.      not offer technical support for the Software, we
  24.      welcome your feedback.

  26.      If the Software is a Borland development tool, you can write and
  27.      compile applications for your own personal use on the computer on which
  28.      you have installed the Software, but you do not have a right to
  29.      distribute or otherwise share those applications or any files of the
  30.      Software which may be required to support those applications.
  31.      APPLICATIONS THAT YOU CREATE MAY REQUIRE THE SOFTWARE
  32.      IN ORDER TO RUN.  UPON EXPIRATION OF THE EVALUATION
  33.      PERIOD, THOSE APPLICATIONS WILL NO LONGER RUN. You should therefore
  34.      take precautions to avoid any loss of data that might result.

  36.   2. BORLAND MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY
  37.      OF THIS SOFTWARE OR ABOUT ANY CONTENT OR INFORMATION
  38.      MADE ACCESSIBLE BY THE SOFTWARE, FOR ANY PURPOSE. THE
  39.      SOFTWARE IS PROVIDED 'AS IS' WITHOUT EXPRESS OR IMPLIED
  40.      WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND
  41.      FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT.
  42.      THIS SOFTWARE IS PROVIDED GRATUITOUSLY AND,
  43.      ACCORDINGLY, BORLAND SHALL NOT BE LIABLE UNDER ANY
  44.      THEORY FOR ANY DAMAGES SUFFERED BY YOU OR ANY USER OF
  45.      THE SOFTWARE. BORLAND WILL NOT SUPPORT THIS SOFTWARE
  46.      AND IS UNDER NO OBLIGATION TO ISSUE UPDATES TO THIS
  47.      SOFTWARE.

  49.   3. While Borland intends to distribute (or may have already distributed) a
  50.      commercial release of the Software, Borland reserves the right at any
  51.      time to not release a commercial release of the Software or, if
  52.      released, to alter prices, features, specifications, capabilities,
  53.      functions, licensing terms, release dates, general availability or
  54.      other characteristics of the commercial release.

  56.   4. Title, ownership rights, and intellectual property rights in and to the
  57.      Software shall remain in Borland and/or its suppliers. You agree to
  58.      abide by the copyright law and all other applicable laws of the United
  59.      States including, but not limited to, export control laws. You
  60.      acknowledge that the Software in source code form remains a
  61.      confidential trade secret of Borland and/or its suppliers and therefore
  62.      you agree not to modify the Software or attempt to decipher, decompile,
  63.      disassemble or reverse engineer the Software, except to the extent
  64.      applicable laws specifically prohibit such restriction.

  66.   5. Upon expiration of the Evaluation Period, you agree to destroy or erase
  67.      the Software, and to not re-install a new copy of the Software. This
  68.      statement shall be governed by and construed in accordance with the
  69.      laws of the State of California and, as to matters affecting
  70.      copyrights, trademarks and patents, by U.S. federal law. This statement
  71.      sets forth the entire agreement between you and Borland.

  73.   6. Use, duplication or disclosure by the Government is subject to
  74.      restrictions set forth in subparagraphs (a) through (d) of the
  75.      Commercial Computer-Restricted Rights clause at FAR 52.227-19 when
  76.      applicable, or in subparagraph (c) (1) (ii) of the Rights in Technical
  77.      Data and Computer Software clause at DFARS 252.227-7013, and in similar
  78.      clauses in the NASA AR Supplement. Contractor/manufacturer is Borland
  79.      International, Inc., 100 Borland Way, Scotts Valley, CA 95066.

  81.   7. You may not download or otherwise export or reexport the Software or
  82.      any underlying information or technology except in full compliance with
  83.      all United States and other applicable laws and regulations. In
  84.      particular, but without limitation, none of the Software or underlying
  85.      information or technology may be downloaded or otherwise exported or
  86.      reexported (i) into (or to a national or resident of) Cuba, Haiti,
  87.      Iraq, Libya, Yugoslavia, North Korea, Iran, or Syria or (ii) to anyone
  88.      on the US Treasury Department's list of Specially Designated Nationals
  89.      or the US Commerce Department's Table of Deny Orders. By downloading
  90.      the Software, you are agreeing to the foregoing and you are
  91.      representing and warranting that you are not located in, under control
  92.      of, or a national or resident of any such country or on any such list.

  94.   8. BORLAND OR ITS SUPPLIERS SHALL NOT BE LIABLE FOR (a)
  95.      INCIDENTAL, CONSEQUENTIAL, SPECIAL OR INDIRECT DAMAGES
  96.      OF ANY SORT, WHETHER ARISING IN TORT, CONTRACT OR
  97.      OTHERWISE, EVEN IF BORLAND HAS BEEN INFORMED OF THE
  98.      POSSIBILITY OF SUCH DAMAGES, OR (b) FOR ANY CLAIM BY
  99.      ANY OTHER PARTY. THIS LIMITATION OF LIABILITY SHALL NOT
  100.      APPLY TO LIABILITY FOR DEATH OR PERSONAL INJURY TO THE
  101.      EXTENT APPLICABLE LAW PROHIBITS SUCH LIMITATION.
  102.      FURTHERMORE, SOME STATES DO NOT ALLOW THE EXCLUSION OR
  103.      LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO
  104.      THIS LIMITATION AND EXCLUSION MAY NOT APPLY TO YOU.

  106.   9. HIGH RISK ACTIVITIES. The Software is not fault-tolerant and is not
  107.      designed, manufactured or intended for use or resale as on-line control
  108.      equipment in hazardous environments requiring fail-safe performance,
  109.      such as in the operation of nuclear facilities, aircraft navigation or
  110.      communication systems, air traffic control, direct life support
  111.      machines, or weapons systems, in which the failure of the Software
  112.      could lead directly to death, personal injury, or severe physical or
  113.      environmental damage ("High Risk Activities"). Borland and its
  114.      suppliers specifically disclaim any express or implied warranty of
  115.      fitness for High Risk Activities.
