  1.     PERSONAL USE:
  2.  
  3.     For personal use (at home and non-commercial), JAR may be freely used
  4.     and shared with others.  There is no REQUIRED registration fee for
  5.     non-commercial, non-business, non-institutional, non-government
  6.     personal use.  Instead, we ask that you share the JAR software with a
  7.     friend.
  8.  
  9.     For personal use, the program REARJ may be freely used only by JAR
  10.     users.  A JAR user is one who uses JAR on a regular basis. Others who
  11.     wish to use REARJ must purchase a registration for the JAR package.
  12.  
  13.     The user who registers receives several benefits:
  14.  
  15.     * Technical support by telephone, fax, email, or mail.  You can get
  16.       help with any questions or problems you encounter in using JAR.
  17.  
  18.     * Full access to all of the features of JAR via a registration serial
  19.       number.
  20.  
  21.     * The use of the JAR-SECURITY envelope for data authentication.
  22.  
  23.     * The satisfaction of knowing that you are supporting the development
  24.       of good, affordable software.
  25.  
  26.  
  27.     BULLETIN BOARD SYSTEM (BBS), WEB SITE, AND FTP SITE USE:
  28.  
  29.     JAR and REARJ may be freely used on commercial and non-commercial
  30.     electronic file distribution sites (computer bulletin board systems,
  31.     WEB sites, FTP sites and so on) for the purpose of distributing *.J
  32.     archive files.  The JAR shareware distribution archive (JARnnn.EXE)
  33.     may be freely distributed by these sites.
  34.  
  35.     JAR and REARJ may be freely used on non-commercial electronic file
  36.     distribution sites where JAR is one of the supported primary archive
  37.     formats.  The use of JAR and/or REARJ on a BBS where JAR is not one of
  38.     the supported primary archive formats requires a registration or site
  39.     license.
  40.  
  41.     Support of JAR involves allowing JAR archives as uploads AND making
  42.     JAR archives available as downloads.

  44.  
  45.     INSTITUTIONAL/COMMERCIAL INTERNAL USE LICENSE/REGISTRATION:
  46.  
  47.     Any corporation, institution, government agency or business wishing to
  48.     use the JAR software in the course of its internal business must
  49.     purchase an JAR registration or SITE LICENSE. Any individual wishing
  50.     to use the JAR software within a corporation, institution, government
  51.     agency or business must purchase an JAR registration or SITE LICENSE.
  52.     The SITE LICENSE is provided for those who want to use JAR on multiple
  53.     computers.  A sample INTERNAL USE LICENSE for the internal use of the
  54.     JAR software is included at the end of this document. Please see the
  55.     ORDERFRM.DOC or write for terms.
  56.  
  57.     Any corporation, institution, government agency or business may use
  58.     the unregistered shareware version of JAR only for evaluation purposes
  59.     and only for a thirty day period.  After the thirty day period, you
  60.     must either register JAR or discontinue its use.  While you are in the
  61.     process of registering JAR, you may continue to use the unregistered
  62.     JAR program until you receive your registration serial number.
  63.  
  64.     This internal license does NOT license the inclusion of the JAR
  65.     software with a hardware/software package that is distributed
  66.     externally.
  67.  
  68.     The unlimited SINGLE LOCATION SITE LICENSE permits JAR internal use
  69.     for an unlimited number of computers/users at one street address. This
  70.     definition of a SINGLE LOCATION SITE is subject to change.  The
  71.     unlimited MULTIPLE LOCATION SITE LICENSE permits JAR internal use for
  72.     an unlimited number of computers/users at all locations.
  73.  
  74.     Each computer that uses JAR in any way requires licensing.  In
  75.     addition, computers that are being backed up with JAR via a file server
  76.     require licensing.  For example, if computer Z's data is copied to a
  77.     file server and that file server uses JAR to archive Z's data, then
  78.     computer Z needs to be licensed for JAR.
  79.  
  80.     Examples of institutional or commercial use of JAR:
  81.  
  82.     1)  Using JAR to backup your business programs and/or data.
  83.     2)  Using JAR to create archives for storing or transporting business
  84.         data.
  85.     3)  Using JAR on a company supplied home computer for company
  86.         business.
  87.     4)  Using JAR to backup your research programs and/or data.
  88.     5)  Using JAR on your home business computer for business purposes.
  89.  
  90.     The above examples should NOT be considered the ONLY types of
  91.     institutional or commercial use of JAR.

  93.  
  94.     SHAREWARE DISTRIBUTION USE BY INDIVIDUALS:
  95.  
  96.     The use of JAR to create an JAR format archive (*.J) for the purpose
  97.     of distributing shareware or freeware to computer bulletin board
  98.     systems IS NOT considered commercial use.  However, any other use of
  99.     JAR in connection with a shareware product is commercial use.  For
  100.     example, using JAR to backup shareware source code is commercial use.

  103.     DISTRIBUTION LICENSE:
  104.  
  105.     Standard JAR format archives (*.J) may be distributed without a
  106.     license.
  107.  
  108.     Any corporation, institution, government agency or business wishing to
  109.     include JAR16, JAR32, JAR_C.COM, or JAR_C.DLL, or REARJ as an integral
  110.     part of a software and/or hardware package to be distributed externally
  111.     must purchase a DISTRIBUTION LICENSE. The use of JAR on one computer to
  112.     build the software and/or hardware package is included in the
  113.     DISTRIBUTION LICENSE.
  114.  
  115.     The above requirement does NOT apply to those who did NOT initiate
  116.     the inclusion of the JAR software with the software and/or hardware
  117.     package.
  118.  
  119.     Please write for terms providing your distribution details:
  120.  
  121.     1)  Expected distribution numbers in total.
  122.     2)  The approximate value/price of the package.
  123.     3)  A brief description of the software/hardware.
  124.     4)  A description of how JAR will be used in the distribution.

  126.     If you wish to use the archiver JAR or the conversion program REARJ
  127.     in your application software, the pricing is similar to the INTERNAL
  128.     LICENSE price schedule.  Please write for terms.

  131.     RELIGIOUS ORGANIZATIONAL USE:
  132.  
  133.     To obtain the donation of a SITE LICENSE and/or DISTRIBUTION LICENSE,
  134.     please write providing details of your organization's religious and
  135.     charitable activities and the intended use for JAR.  A free license
  136.     will be provided to qualifying organizations.  Qualifications will be
  137.     determined on a purely subjective basis.  Non-qualifying organizations
  138.     can always obtain licenses by purchase.
  139.  
  140.     Non-religious non-profit organizations promoting causes that do not
  141.     conflict with our personal faith and ethics may also qualify for a
  142.     free license.

  144.  
  145.     COMMERCIAL SALE:
  146.  
  147.     Any software dealer or library may distribute the entire JAR package
  148.     in an unmodified form for a fee as long as the price charged for the
  149.     disk containing JAR does not exceed US $10.00.  You may NOT distribute
  150.     any registered version of JAR.
  151.  
  152.     Any software dealer or library may distribute the entire JAR package
  153.     in an unmodified form when included in a CD-ROM shareware collection.
  154.     Moreover, permission is freely given for the use of the JAR software
  155.     to view and/or install CD-ROM shareware collections where the entire
  156.     JAR package is included.  No special license is required nor will a
  157.     special license be granted.

  159.     With these exceptions, the sale of JAR or its parts for profit,
  160.     either alone or together with other software or hardware, requires a
  161.     licensing agreement possibly providing for royalty payments.  Please
  162.     write for terms.

  165.     UPGRADE POLICY FOR JAR:
  166.  
  167.     Registered/licensed users of JAR may upgrade JAR to the next DOT
  168.     release (1.1 to 1.2, etc) for a small diskette fee.  See the
  169.     ORDERFRM.DOC for details.  UNLIMITED MULTIPLE SITE LICENSE holders
  170.     will get unlimited free JAR upgrades.

  172.     Current ARJ licensees who purchase JAR licenses of EQUAL or LESSER
  173.     value get a fifty percent discount off the JAR license fee.  When
  174.     purchasing a JAR license of greater value, ARJ licensees will get a
  175.     fifty percent discount based upon an equivalent JAR license fee.  For
  176.     example, if a user has a five PC ARJ license and then purchases a 15 PC
  177.     JAR license, that user will receive a discount calculated by taking
  178.     fifty percent of the five PC JAR license fee.  Please note that the
  179.     licensee's ARJ license is still valid.  Please note that we consider
  180.     the older $2000 unlimited use site license equivalent to the new $2500
  181.     unlimited use single site license.

  184.     JAR-SECURITY ENVELOPE USE:
  185.  
  186.     This feature is intended for but not limited to software developers
  187.     who wish to distribute archived software with some assurance that the
  188.     archived software in a validated JAR-SECURED archive will be secure.
  189.  
  190.     All JAR registrations include a free JAR-SECURITY envelope.
  191.  
  192.  
  193.     DISCLAIMER:

  195.     This software (JAR16, JAR32, JAR_C.COM, JAR_C.DLL, REARJ, and
  196.     JAR-SECURITY) is provided on an "as is" basis without warranty of any
  197.     kind, expressed or implied, including but not limited to the implied
  198.     warranties of merchantability and fitness for a particular purpose.
  199.     The person using the software bears all risk as to the quality and
  200.     performance of the software.  ARJ Software, Inc. will not be liable for
  201.     any special, incidental, consequential, indirect or similar damages due
  202.     to loss of data or any other reason, even if ARJ Software, Inc. or an
  203.     agent of ARJ Software, Inc. has been advised of the possibility of such
  204.     damages.  In no event shall the liability of ARJ Software, Inc. for any
  205.     damages ever exceed the price paid for the license to use the software,
  206.     regardless of the form of the claim.

  232.     This is a perpetual license for the use of the software within
  233.     LICENSEE's organization, and is not transferable.  You are not
  234.     obtaining title to the software or any copyright rights.  This license
  235.     allows the internal use and copying of the software by LICENSEE on as
  236.     many computers as contracted for.  You may make as many copies of this
  237.     software as you need for backup purposes.  Distribution, repackaging,
  238.     or reselling of the software to third parties is not allowed under
  239.     this agreement.

  241.     The LICENSOR warrants that it is sole owner of the software and has
  242.     full power and authority to grant this license herein without consent
  243.     of any other party.

  245.     THE LICENSOR HEREBY DISCLAIMS ALL WARRANTIES RELATING TO THIS
  246.     SOFTWARE, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO ANY
  247.     IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR
  248.     PURPOSE, AND ALL SUCH WARRANTIES ARE EXPRESSLY AND SPECIFICALLY
  249.     DISCLAIMED.  THE PERSON USING THE SOFTWARE BEARS ALL RISK AS TO THE
  250.     QUALITY AND PERFORMANCE OF THE SOFTWARE.  NEITHER THE LICENSOR OR
  251.     ANYONE ELSE WHO HAS BEEN INVOLVED IN THE CREATION, PRODUCTION, OR
  252.     DELIVERY OF THIS SOFTWARE SHALL NOT BE LIABLE FOR ANY SPECIAL,
  253.     INCIDENTAL, CONSEQUENTIAL, INDIRECT OR SIMILAR DAMAGES DUE TO LOSS OF

  260.     Some states do not allow the exclusion of the limit of liability for
  261.     consequential damages, so the above limitation may not apply to you.

  263.     This agreement shall be construed and enforced in accordance with the
  264.     laws of the STATE OF MASSACHUSETTS and shall inure to the benefit of
  265.     ARJ Software, Inc. and any successors, administrators, heirs and
  266.     assigns. Any action or proceeding brought by either party against the
  267.     other arising out of or related to this agreement shall be brought
  268.     only in a STATE or FEDERAL COURT of competent jurisdiction located in
  269.     MASSACHUSETTS.  The parties hereby consent to in personam jurisdiction
  270.     of said courts.
