  28.  SOFTWARE LICENSE
  29.  
  30.  Non-licensed users are granted a limited license to use
  31.  TWinExplorer on a 30-day trial basis for the purpose of
  32.  determining whether TWinExplorer is suitable for their
  33.  needs.  The use of TWinExplorer, except for the initial
  34.  30-day trial, requires registration.  The use of
  35.  unlicensed copies of TWinExplorer, outside of the initial
  36.  30-day trial, by any person, business, corporation,
  37.  government agency or any other entity is strictly
  38.  prohibited.

  40.  A license for personal use that grants
  41.  the user the right to use TWinExplorer on one computer may be purchased.
  42.  A commercial license requires sufficient licensing
  43.  equal to the number of users, or the quantity
  44.  of workstations that access the software, whichever is
  45.  smaller.

  47.  No one may modify or patch the TWinExplorer executable files
  48.  in any way, including but not limited to decompiling,
  49.  disassembling, or otherwise reverse engineering the
  50.  programs.

  52.  A limited license is granted to copy and distribute
  53.  TWinExplorer only for the trial use of others, subject
  54.  to the above limitations, and also the following:
  55.  
  56.   1)    TWinExplorer and all of its release files must be
  57.         copied in unmodified form, complete with the file
  58.         containing this license information.
  59.  
  60.   2)    No fee, charge, or other compensation may be requested
  61.         or accepted, except as authorized below:

  63.         A) Operators of electronic bulletin board systems
  64.            (sysops) may make TWinExplorer available for down-
  65.            loading only as long as the above conditions are
  66.            met.  An overall or time-dependent charge for the
  67.            use of the bulletin board system is permitted as
  68.            long as there is not a specific charge for the
  69.            download of TWinExplorer.

  71.         B) Vendors of user-supported or shareware software
  72.            approved by the ASP may distribute TWinExplorer,
  73.            subject to the above conditions, without specific
  74.            permission.

  76.         C) Non-profit user groups may distribute copies of
  77.            the TWinExplorer diskette to their members,
  78.            subject to the above conditions, without specific
  79.            permission.  Non-profit groups may collect a disk
  80.            duplication fee not to exceed five dollars.

  82.   LIMITED WARRANTY

  84.   PEPSOFTWARE DISCLAIMS ALL WARRANTIES, EITHER EXPRESS OR
  85.   IMPLIED, INCLUDING, BUT NOT LIMITED TO IMPLIED WARRANTIES
  86.   OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE,
  87.   WITH RESPECT TO THE PRODUCT.  SHOULD THE PROGRAM PROVE
  88.   DEFECTIVE, THE PURCHASER ASSUMES THE RISK OF PAYING THE
  89.   ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, OR 
  90.   CORRECTION AND ANY INCIDENTAL OR CONSEQUENTIAL DAMAGES.
  91.   IN NO EVENT WILL PEPSOFTWARE BE LIABLE FOR ANY DAMAGES WHATSOEVER
  92.   (INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF
  93.   BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS
  94.   INFORMATION AND THE LIKE) ARISING OUT OF THE USE OR THE
  95.   INABILITY TO USE THIS PRODUCT EVEN IF PEPSOFTWARE
  96.   HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
