  1. BY INSTALLING THE WEBVIDEO SOFTWARE AND PREPARING IT FOR USE YOU ARE
  2. CONSENTING TO BE BOUND BY AND ARE BECOMING A PARTY TO THIS AGREEMENT.
  3. IF YOU DO NOT AGREE TO ALL OF THE TERMS OF THIS AGREEMENT, DELETE THE
  4. SOFTWARE AND DO NOT USE IT.
  5. 1. University of Ulm grants to you a non-exclusive, non-sublicensable
  6. license to use this version of the WebVideo system ('the
  7. software') in binary executable form for evaluation and trial use
  8. purposes.

  10. 2. UNIVERSITY OF ULM MAKES NO REPRESENTATIONS ABOUT THE SUITABILITY OF
  11. THIS SOFTWARE. THE SOFTWARE IS PROVIDED 'AS IS' WITHOUT EXPRESS OR
  12. IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND
  13. FITNESS FOR A PARTICULAR PURPOSE OR NONINFRINGEMENT. UNIVERSITY OF
  14. ULM SHALL NOT BE LIABLE UNDER ANY THEORY OR ANY DAMAGES SUFFERED BY
  15. YOU OR ANY USER OF THE SOFTWARE.

  17. 3. Title, ownership rights, and intellectual property rights in and to
  18. the Software shall remain in University of Ulm and/or its suppliers.
  19. You acknowledge that the Software in source code form remains a
  20. confidential trade secret of University of Ulm and/or its suppliers
  21. and therefore you agree not to modify the Software or attempt to
  22. decipher, decompile, disassemble or reverse engineer the Software,
  23. except to the extent applicable laws specifically prohibit such
  24. restriction.

  26. 4. University of Ulm may terminate this License at any time by
  27. delivering notice to you and you may terminate this License at any
  28. time by destroying or erasing your copy of the Software.  Upon
  29. termination of this License, or in any event within thirty (30) days
  30. following the release of a commercial version of the Software, you
  31. agree to destroy or erase the Software.

  33. 5. UNIVERSITY OF ULM OR ITS SUPPLIERS SHALL NOT BE LIABLE FOR (a)
  34. INCIDENTAL, CONSEQUENTIAL, SPECIAL OR INDIRECT DAMAGES OF ANY SORT,
  35. WHETHER ARISING IN TORT, CONTRACT OR OTHERWISE, EVEN IF UNIVERSITY OF
  36. ULM HAS BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES, OR (b) FOR
  37. ANY CLAIM BY ANY OTHER PARTY.

  39. 6. Without an additional agreement, the software may not be used in public 
  40. presentations without notification to and mentioning of the Distributed 
  41. Systems Department (Abt. Verteilte Systeme), University of Ulm as implementor 
  42. and owner of the enabeling software in a prominent place.

  44. 7. Without an additional agreement, the software or parts of it may not 
  45. be sold alone or as part of a product. The software can be operated
  46. for commercial purposes, if University of Ulm as implementor and owner of 
  47. the enabeling software is mentioned in a prominent place.
