  3. Symantec licenses the accompanying software to you only upon the condition that 
  4. you accept all of the terms contained in this license agreement.  Please read 
  5. the terms carefully before installing or using the software, as pressing the 
  6. "accept" button will indicate your assent to them.  If you do not agree to these 
  7. terms, Symantec is unwilling to license the software to you, in which event you 
  8. should press the "cancel" button to exit install and delete the Software from 
  9. your system.

  11. LICENSE AND WARRANTY:

  13. The software which accompanies this license (the "Software") is the property of 
  14. Symantec or its licensers and is protected by copyright law.  While Symantec 
  15. continues to own the Software, you will have certain limited rights to use the 
  16. Software after your acceptance of this license.  Except as may be modified by a 
  17. license addendum which accompanies this license, your rights and obligations 
  18. with respect to the use of this Software are as follows:

  20. YOU MAY: 
  21.  
  22. (i) use one copy of the Software on a single computer for a period of 30 days 
  23. for the purpose of evaluating whether to purchase an ongoing license to the 
  24. Software;
  25.  
  26. (ii) make one copy of the Software for archival purposes, or copy the software 
  27. onto the hard disk of your computer and retain the original for archival 
  28. purposes; and
  29.  
  30. (iii) make an unlimited number of copies of the Software and give copies to 
  31. other persons or entities as long as (a) the copies contain this Agreement and 
  32. the same copyright and other proprietary notices that appear on or in the 
  33. Software, (b) such copies of the software are distributed only in the complete, 
  34. original form, without any modification, (c) each user installing the Software 
  35. after such distribution is informed that the Software is a non-registered 
  36. version of Visual Page for which a registered license must be purchased if used 
  37. beyond 30 days, and (d) if you have a publically available web site, you include 
  38. an active link to the Visual Page home page at the Symantec web site.

  40. YOU MAY NOT:
  41.  
  42. (i) reverse engineer, decompile, disassemble, modify, translate, make any 
  43. attempt to discover the source code of the Software, or create derivative works 
  44. from the Software;
  45.  
  46. (ii) continue using the Software after the 30-day evaluation period unless you 
  47. have purchased a license for the Software;
  48.  
  49. (iii) represent or otherwise indicate that you are an agent of Symantec or make 
  50. any representations, warranties or other agreements on behalf of Symantec;
  51.  
  52. (iv) bundle the Software or otherwise distribute it (a) in connection with any 
  53. product or service that contains information, statements, representations, etc. 
  54. that are legally objectionable, or items that are scandalous, offensive or 
  55. otherwise in poor taste.

  57. Warranty Disclaimer:
  58.  
  59. SYMANTEC MAKES NO REPRESENTATIONS OR WARRANTIES ABOUT THE SUITABILITY OF THIS 
  60. SOFTWARE FOR ANY PURPOSE. THE SOFTWARE IS PROVIDED "AS IS" WITHOUT EXPRESS OR 
  61. IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A 
  62. PARTICULAR PURPOSE OR NONINFRINGEMENT. THIS SOFTWARE IS PROVIDED GRATUITOUSLY 
  63. AND, ACCORDINGLY, SYMANTEC SHALL NOT BE LIABLE UNDER ANY THEORY OR ANY DAMAGES 
  64. SUFFERED BY YOU OR ANY USER OF THE SOFTWARE. SYMANTEC WILL NOT SUPPORT THIS 
  65. SOFTWARE AND WILL NOT ISSUE UPDATES TO THIS SOFTWARE.

  67. Disclaimer of Damages:

  69. REGARDLESS OF WHETHER ANY REMEDY SET FORTH HEREIN FAILS OF ITS ESSENTIAL 
  70. PURPOSE, IN NO EVENT WILL SYMANTEC BE LIABLE TO YOU FOR ANY SPECIAL, 
  71. CONSEQUENTIAL, INDIRECT OR SIMILAR DAMAGES, INCLUDING ANY LOST PROFITS OR LOST 
  72. DATA ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE EVEN IF SYMANTEC 
  73. HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

  75. Compliance With Applicable Law:

  77. You agree to abide by the copyright law and all other applicable laws of the 
  78. United States and every other jurisdiction where the Software may be 
  79. distributed, including, but not limited to, export control laws.  You 
  80. specifically acknowledge that the Software may not be exported to Cuba, Iran, 
  81. Iraq, Libya, North Korea, Sudan or Syria, or any other countries that may be so 
  82. designated under United States law.  You acknowledge that the Software in source 
  83. code form remains a confidential trade secret of Symantec and/or its suppliers 
  84. and therefore you agree not to modify the Software or attempt to decipher, 
  85. decompile, disassemble or reverse engineer the Software, except to the extent 
  86. applicable laws specifically prohibit such restriction.

  88. U.S. GOVERNMENT RESTRICTED RIGHTS:

  90. Restricted rights legend.  Use, duplication, or disclosure by the Government is 
  91. subject to restrictions as set forth in subparagraph (c) (1) (ii) of the Rights 
  92. in Technical Data and Computer Software clause at DFARS 252.227-7013 or 
  93. subparagraphs (c) (1) and (2) of the Commercial Computer Software-Restricted 
  94. Rights clause at 48 CFR 52.227-19, as applicable, Symantec Corporation, 10201 
  95. Torre Avenue, Cupertino, CA 95014.

  97. Indemnity:

  99. If you distribute copies of the Software, you unconditionally agree to indemnify 
  100. Symantec and its affiliates for any claims, expenses, losses, damages of any 
  101. kind arising directly or indirectly from your distribution of the Software.

  103. Termination:

  105. Symantec may terminate the right to use and/or distribute the Software upon 
  106. notice to you (which may be delivered by any means, including electronically by 
  107. the same means as this Software is distributed by Symantec), and you may 
  108. terminate this license at any time by destroying or erasing your copy of the 
  109. Software.  Upon termination of this license, you must discontinue all use and 
  110. distribution of the Software, remove the Software from your system and destroy 
  111. any copies of the Software in your possession or control.

  113. GENERAL:

  115. This Agreement will be governed by the laws of the State of California, United 
  116. States.  This Agreement may only be modified by a license addendum which 
  117. accompanies this license or by a written document which has been signed by both
