  9. This is the shareware edition of our award-winning enotate(tm)
  10. software.
  11.

  18. You can also see our range of other exciting products. The full
  19. version of enotate retails for $49.99, and allows you to also
  20. annotate Microsoft Word and PowerPoint documents.

  24. If you are upgrading, remember to do a fresh install: that is,
  25. uninstall any previous desktop installation of enotate (using
  26. Control Panel/, Add/Remove Programs), and always delete the old
  27. Palm application (enotate.prc).

  32.  Starting enotate
  33. ------------------------------------------------------------------
  34.  
  35. After installation, you can start enotating from the enotate PC 
  36. application.
  37.  
  38.     From the enotate PC app -- run enotate on the PC. Then ensure
  39.     your Palm organizer is connected to its cradle or cable. 
  40.     Start enotate on the Palm organizer. You will see a Red Box 
  41.     appear on the PC display. You are ready to enotate.

  44.  Frequently Asked Questions
  45. ------------------------------------------------------------------
  46.  
  47. 1) HotSync may sometimes fail if started while the Palm enotate
  48.     application is running. If this happens, exit the palm 
  49.     enotate application to restore HotSync capability. Note that
  50.     if the PC enotate application is running and the Palm enotate 
  51.     application is not, HotSync will always fail.
  52.  
  53. 2) enotate may not work correctly with the 3Com "USB" connector.
  54.     Note: Using HyperTerminal first to open up the port will 
  55.     correct the problem.
  56.  
  57. 3) enotate does not currently support the Handspring Visor due
  58.     to its USB connectivity. 
  59.  
  60. 4) enotate does not currently support Windows CE devices or any 
  61.     other handheld organizers that do not use the Palm OS 
  62.     operating system.

  67.  SOFTWARE LICENSE AGREEMENT

  69. THIS IS A LEGAL AGREEMENT BETWEEN YOU, THE END USER, AND INFORMAL
  70. SOFTWARE INC., ITS PARENT AND SUBSIDIARIES ("INFORMAL"). BY USING
  71. THIS ENOTATE-FE SOFTWARE YOU ACCEPT ALL TERMS AND CONDITIONS OF
  72. THIS AGREEMENT. THIS AGREEMENT WILL GOVERN YOUR USE OF THE SOFTWARE.
  73. IF YOU DO NOT AGREE TO THE TERMS OF THIS AGREEMENT YOU SHOULD NOT
  74. USE THIS SOFTWARE. BY USING THE ENCLOSED SOFTWARE YOU ARE
  75. ACKNOWLEDGING THAT YOU HAVE READ AND UNDERSTOOD THIS LICENSE AND
  76. LIMITED WARRANTY AND AGREE TO BE BOUND BY THEIR TERMS AND
  77. CONDITIONS. YOU ALSO AGREE THAT THE LICENSE AND LIMITED WARRANTY
  78. ARE THE COMPLETE AND EXCLUSIVE STATEMENT OF AGREEMENT BETWEEN YOU
  79. AND INFORMAL AND SUPERCEDE ALL PROPOSALS OR PRIOR AGREEMENTS.

  81. 1. GRANT OF LICENSE.
  82.  
  83. This SOFTWARE is SHAREWARE. By that is meant that you may freely
  84. distribute copies of the SOFTWARE to others, but not for sale or
  85. for any other compensation. You may only distribute the original
  86. installation program or programs of the SOFTWARE. You may use this
  87. SOFTWARE for a trial period of thirty (30) days. If, after that
  88. time, you wish to continue to use the SOFTWARE you must register
  89. the usage of the SOFTWARE with Informal and pay the registration
  90. fee of $9.95 (nine US dollars and ninety five cents).

  92. 2. COPYRIGHT.
  93.  
  94. This software is protected by International copyright provisions.
  95. Therefore, you must treat this software just like a book, except
  96. that you may copy it on to a computer to be used, and you may make
  97. archival copies of the software for the sole purpose of protecting
  98. your investment from loss.

  100. 3. OTHER RESTRICTIONS.

  102. You may not rent or lease the SOFTWARE, but you may transfer the
  103. SOFTWARE on a permanent basis provided you retain no copies and
  104. the recipient agrees to the terms of this Agreement. You may not
  105. reverse engineer, decompile or disassemble the SOFTWARE.

  107. 4. LIMITED WARRANTY. 
  108.  
  109. Informal warrants that the SOFTWARE will perform substantially
  110. in accordance with the associated specifications for a period of
  111. 90 days from the receipt. Any implied warranties on the SOFTWARE
  112. are limited to 90 days. Some US states do not allow limitations
  113. on duration of an implied warranty, so the above limitation may
  114. not apply to you.

  116. 5. CUSTOMER REMEDIES. 
  117.  
  118. InformalÆs entire liability and your exclusive remedy shall be,
  119. at InformalÆs option either (a) return of the price paid or
  120. (b) repair or replacement of the SOFTWARE that does not meet
  121. Informal's Limited Warranty and which is returned to Informal
  122. with a copy of your receipt. This Limited Warranty is void if
  123. failure of the SOFTWARE has resulted from accident, abuse, or
  124. misapplication. Any replacement SOFTWARE will be warranted for
  125. the remainder of the original warranty period or 30 days,
  126. whichever is longer. THESE REMEDIES ARE NOT AVAILABLE OUTSIDE
  127. OF THE UNITED STATES OF AMERICA.

  129. 6. NO OTHER WARRANTIES.

  131. INFORMAL DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED,
  132. INCLUDING BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF
  133. MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WITH RESPECT
  134. TO THIS SOFTWARE.

  136. 7. NO LIABILITIES FOR CONSEQUENTIAL DAMAGES.

  138. In no event shall Informal or its suppliers be liable for any
  139. damages whatsoever (including, without limitation, damages for loss
  140. of business profits, business interruption, loss of business
  141. information, or other pecuniary loss) arising out of the use of
  142. or inability to use this Informal product, even if Informal has
  143. been advised of the possibility of such damages. Because some
  144. US states do not allow the exclusion or limitation of liability
  145. for consequential or incidental damages, the above limitation
  146. may not apply to you.

  148. 8. GOVERNING LAW.

  150. This agreement is governed by the laws of the State of California.
