  9. LICENSE AGREEMENT

  11. Please read the following terms and conditions before using 
  12. the SOFTWARE. Use of the SOFTWARE indicates you accept the 
  13. terms of this license agreement.
  14.  
  15. DEFINITIONS
  16.  
  17. The term "SOFTWARE" includes all software distributed with 
  18. this License including smallWare Tangrams Free and all 
  19. documentation. The "SOFTWARE" is licensed to you under
  20. the terms specified in the License Grant below. 
  21. smallWare ("SMALLWARE") owns all copyright, trade secret, 
  22. patent, trademarks and other proprietary rights in the SOFTWARE. 
  23.  
  24. LICENSE GRANT
  25.  
  26. Any number of copies of the SOFTWARE may be installed on 
  27. any number of PalmPilot computers at any time.
  28.  
  29. You are hereby licensed to make as many copies of the 
  30. SOFTWARE as you wish; give exact copies of the SOFTWARE 
  31. to anyone; and distribute the SOFTWARE in its unmodified 
  32. form via electronic means.
  33.  
  34. You are specifically prohibited from charging, or requesting
  35. donations, for any such copies, however made; and from
  36. distributing the software and/or documentation with other 
  37. products (commercial or otherwise) without prior written 
  38. permission.
  39.  
  40. GOVERNING LAW
  41.  
  42. This agreement shall be governed by the laws of the State of 
  43. Mississippi.
  44.  
  45. DISCLAIMER OF WARRANTY
  46.  
  47. THIS SOFTWARE AND THE ACCOMPANYING FILES ARE SOLD "AS IS" AND
  48. WITHOUT WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY OR ANY
  49. OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED. NO WARRANTY OF 
  50. FITNESS FOR A PARTICULAR PURPOSE IS OFFERED.

  52. Good data processing practice dictates that any new program
  53. should be thoroughly tested by the user with non-critical data
  54. before relying on it.  The user must assume the entire risk of
  55. using the program.

  57. SMALLWARE does not warrant that the SOFTWARE will meet your 
  58. requirements or that operation of the SOFTWARE will be without 
  59. interruption, or that the SOFTWARE will be error-free, or that 
  60. defects in the SOFTWARE will be corrected.

  62. DISCLAIMER OF LIABILITY

  64. IN NO EVENT SHALL SMALLWARE BE LIABLE TO YOU FOR ANY SPECIAL, 
  65. INCIDENTAL, CONSEQUENTIAL, INDIRECT OR SIMILAR DAMAGES INCLUDING 
  66. ANY LOSS OF PROFITS, OR LOSS OF SAVINGS, ARISING OUT OF YOUR USE 
  67. OR INABILITY TO USE THE SOFTWARE, EVEN IF SMALLWARE HAS KNOWLEDGE 
  68. OF THE POTENTIAL LOSS OR DAMAGE. Some states do not allow the 
  69. limitation or exclusion of liability for incidental or 
  70. consequential damages, so the above limitation may not apply to 
  71. you. HOWEVER, IN NO CASE SHALL SMALLWARE'S LIABILITY EXCEED THE 
  72. PURCHASE PRICE OF THE SOFTWARE.

  74. GENERAL

  76. If any part of this agreement is found void and unenforceable, 
  77. it will not affect the validity of the balance of this LICENSE 
  78. AGREEMENT, which shall remain valid and enforceable according to 
  79. its terms. This LICENSE AGREEMENT may only be modified by a 
  80. license addendum which accompanies this license of an upgrade to 
  81. the SOFTWARE, or by a written document that has been signed by 
  82. both you and an officer of SMALLWARE. This license automatically 
  83. terminates if the licensee violates any of the terms of this 
  84. LICENSE AGREEMENT.
