  11. Please read the following terms and conditions before using 
  12. the SOFTWARE. Use of the SOFTWARE indicates you accept the 
  13. terms of this license agreement and warranty.

  16. DEFINITIONS

  18. The term "SOFTWARE" includes all software distributed with 
  19. this License including smallWare Solitaire Free and all 
  20. documentation. The "SOFTWARE" is licensed to you under the 
  21. terms specified in the License Grant below. smallWare 
  22. ("SMALLWARE") owns all copyright, trade secret, patent, 
  23. trademarks and other proprietary rights in the SOFTWARE.

  26. LICENSE GRANT

  28. Any number of copies of the SOFTWARE may be installed on 
  29. any number of Palm OS computers at any time.
  30.  
  31. You are hereby licensed to make as many copies of the 
  32. SOFTWARE as you wish; give exact copies of the SOFTWARE 
  33. to anyone; and distribute the SOFTWARE in its unmodified 
  34. form via electronic means.
  35.  
  36. You are specifically prohibited from charging, or requesting
  37. donations, for any such copies, however made; and from
  38. distributing the software and/or documentation with other 
  39. products (commercial or otherwise) without prior written 
  40. permission.

  43. GOVERNING LAW

  45. This agreement shall be governed by the laws of the State of 
  46. Mississippi.

  49. DISCLAIMER OF WARRANTY

  51. THIS SOFTWARE AND THE ACCOMPANYING FILES ARE SOLD "AS IS" AND
  52. WITHOUT WARRANTIES AS TO PERFORMANCE OR MERCHANTABILITY OR ANY
  53. OTHER WARRANTIES WHETHER EXPRESSED OR IMPLIED. NO WARRANTY OF 
  54. FITNESS FOR A PARTICULAR PURPOSE IS OFFERED.

  56. Good data processing practice dictates that any new program
  57. should be thoroughly tested by the user with non-critical data
  58. before relying on it.  The user must assume the entire risk of
  59. using the program.

  61. SMALLWARE does not warrant that the SOFTWARE will meet your 
  62. requirements or that operation of the SOFTWARE will be without 
  63. interruption, or that the SOFTWARE will be error-free, or that 
  64. defects in the SOFTWARE will be corrected.

  69. IN NO EVENT SHALL SMALLWARE BE LIABLE TO YOU FOR ANY SPECIAL, 
  70. INCIDENTAL, CONSEQUENTIAL, INDIRECT OR SIMILAR DAMAGES INCLUDING 
  71. ANY LOSS OF PROFITS, OR LOSS OF SAVINGS, ARISING OUT OF YOUR USE 
  72. OR INABILITY TO USE THE SOFTWARE, EVEN IF SMALLWARE HAS KNOWLEDGE 
  73. OF THE POTENTIAL LOSS OR DAMAGE. Some states do not allow the 
  74. limitation or exclusion of liability for incidental or 
  75. consequential damages, so the above limitation may not apply to 
  76. you. HOWEVER, IN NO CASE SHALL SMALLWARE'S LIABILITY EXCEED THE 
  77. PURCHASE PRICE OF THE SOFTWARE.

  80. GENERAL

  82. If any part of this agreement is found void and unenforceable, 
  83. it will not affect the validity of the balance of this LICENSE 
  84. AGREEMENT, which shall remain valid and enforceable according to 
  85. its terms. This LICENSE AGREEMENT may only be modified by a 
  86. license addendum which accompanies this license of an upgrade to 
  87. the SOFTWARE, or by a written document that has been signed by 
  88. both you and an officer of SMALLWARE. This license automatically 
  89. terminates if the licensee violates any of the terms of this 
  90. LICENSE AGREEMENT.
