  1.                  MCAFEE, INC. HOME USER LICENSE

  3. NOTICE TO HOME USER:  CAREFULLY READ THE FOLLOWING LEGAL
  4. AGREEMENT.  YOU MUST PROMPTLY REGISTER YOUR USE OF THE SOFTWARE
  5. PROVIDED WITH THIS AGREEMENT (THE "SOFTWARE") BY COMPLETING AND
  6. FORWARDING TO MCAFEE, INC. ("MCAFEE") THE REGISTER.TXT FILE
  7. CONTAINED IN THE SOFTWARE.
  8.  
  9.      1.     LICENSE GRANT.  If you are a home user, McAfee grants
  10. to you, as an individual, a non-exclusive right to use one copy
  11. of the object code version of the SOFTWARE associated with this
  12. license for personal use on your computer.  This license to use
  13. the SOFTWARE is conditioned upon your compliance with the terms
  14. of this Agreement.  You are entitled to evaluate the software on
  15. a royalty free basis for five days.  Use after the five day
  16. evaluation period is further conditioned upon payment of the
  17. license fee specified in this REGISTER.TXT file.  This license is
  18. effective for one year from the date of your first use or receipt
  19. of the REGISTER.TXT file by McAfee, whichever first occurs.  You
  20. agree you will only copy the SOFTWARE as necessary to use it in
  21. accordance with this license.

  23.      2.     COPYRIGHT.  The SOFTWARE is protected by United States
  24. copyright law and international treaty provisions.  You
  25. acknowledge that no title to the intellectual property in the
  26. SOFTWARE is transferred to you.  You further acknowledge that
  27. title and full ownership rights to the SOFTWARE will remain the
  28. exclusive property of McAfee or its suppliers, and you will not
  29. acquire any rights to the SOFTWARE except as expressly set forth
  30. in this license.  You agree that any copies of the SOFTWARE will
  31. contain the same proprietary notices which appear on and in the
  32. SOFTWARE.

  34.      3.     REVERSE ENGINEERING.  You agree that you will not
  35. attempt to reverse compile, modify, translate, or disassemble the
  36. SOFTWARE in whole or in part.

  38.      4.     LIMITED WARRANTY.  McAfee warrants that the SOFTWARE
  39. will perform substantially in accordance with the accompanying
  40. written materials for a period of ninety (90) days from the date
  41. of purchase.  Any implied warranties relating to the SOFTWARE are
  42. limited to ninety (90) days.

  44.      5.     CUSTOMER REMEDIES.  If the SOFTWARE does not conform
  45. to the limited warranty in Section 4 above ("Limited Warranty"),
  46. McAfee's entire liability and your sole and exclusive remedy
  47. shall be, at McAfee's option, either to (a) correct the error or
  48. (b) help you work around or avoid the error.  The Limited
  49. Warranty is void if failure of the SOFTWARE has resulted from
  50. accident, abuse, or misapplication.  Any replacement SOFTWARE
  51. will be warranted for the remainder of the original Limited
  52. Warranty period.

  58.      6.     NO OTHER WARRANTIES.  MCAFEE DOES NOT WARRANT THAT THE
  59. SOFTWARE IS ERROR FREE.  EXCEPT FOR THE EXPRESS LIMITED WARRANTY
  60. IN SECTION 4 ("LIMITED WARRANTY"), MCAFEE DISCLAIMS ALL OTHER
  61. WARRANTIES WITH RESPECT TO THE SOFTWARE, EITHER EXPRESS OR
  62. IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF
  63. MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND
  64. NONINFRINGEMENT OF THIRD PARTY RIGHTS.  SOME JURISDICTIONS DO NOT
  65. ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR LIMITATIONS ON HOW
  66. LONG AN IMPLIED WARRANTY MAY LAST, OR THE EXCLUSION OR LIMITATION
  67. OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS
  68. OR EXCLUSIONS MAY NOT APPLY TO YOU.  THIS WARRANTY GIVES YOU
  69. SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH
  70. VARY FROM JURISDICTION TO JURISDICTION.

  72.      7.     SEVERABILITY.  In the event of invalidity of any
  73. provision of this license, the parties agree that such invalidity
  74. shall not affect the validity of the remaining portions of this
  75. license.

  77.      8.     NO LIABILITY FOR CONSEQUENTIAL DAMAGES.  IN NO EVENT
  78. SHALL MCAFEE OR ITS SUPPLIERS BE LIABLE TO YOU FOR ANY
  79. CONSEQUENTIAL, SPECIAL, INCIDENTAL OR INDIRECT DAMAGES OF ANY
  80. KIND ARISING OUT OF THE DELIVERY, PERFORMANCE OR USE OF THE
  81. SOFTWARE, EVEN IF MCAFEE HAS BEEN ADVISED OF THE POSSIBILITY OF
  82. SUCH DAMAGES.  IN NO EVENT WILL MCAFEE'S LIABILITY FOR ANY CLAIM,
  83. WHETHER IN CONTRACT, TORT OR ANY OTHER THEORY OF LIABILITY,
  84. EXCEED THE LICENSE FEE PAID BY YOU, IF ANY.

  86.      9.     GOVERNING LAW.  This license will be governed by the
  87. laws of the State of California as they are applied to agreements
  88. between California residents entered into and to be performed
  89. entirely within California.  The United Nations Convention on
  90. Contracts for the International Sale of Goods is specifically
  91. disclaimed.

  93.      10.    ENTIRE AGREEMENT.  This is the entire agreement between
  94. you and McAfee which supersedes any prior agreement or
  95. understanding, whether written or oral, relating to the subject
  96. matter of this license.
