  9.   Thank you very much for purchasing NSClean! If you wish,
  10.  please take a moment when you're online to email the author at

  12.  upgrades and bugfixes if any should be required. To do this,
  13.  please use the word "REGISTER" on the subject: line.

  15.   We do not keep a "mailing list" nor will we send you junk
  16.  email. We know you are concerned with your privacy and we will
  17.  respect it. You may choose not to drop us your email address,
  18.  and that's up to you.  We also have a web address if you
  19.  aren't aware of it where you can check on improvements
  20.  yourself without emailing us:

  24.   There are no "cookies," "scripts" or other types of attempts
  25.  to monitor our web page. We don't even count hits. You can be
  26.  sure of your privacy when visiting the above URL.

  29.  NSCLEAN END USER LICENSE AGREEMENT:
  30.  --------------------------------------------------------------

  32.   Kevin McAleavey (author of the software) retains all rights
  33.  and ownership of the intellectual property provided to you the
  34.  user as compiled object code. This means that you are entitled
  35.  to use the software as you see fit but all of the work that
  36.  went into creating this software remains the property of the
  37.  author at all times. It is a violation of this license to
  38.  disassemble, reverse engineer or to incorporate any portion of
  39.  the code into any other product you or anyone else may
  40.  generate. NSClean Privacy Software (Nancy McAleavey) is the
  41.  official grantor of these license rights.
  42.  
  43.   In addition, it is a violation of the license to make copies
  44.  of the software for anyone else but yourself for your own use.
  45.  Backup copies are permissible as desired by the licensee, but
  46.  any and all such backups shall remain in licensee's possession
  47.  and control at all times and may not be given to anyone else.
  48.  Please be aware that the software contains a signature within
  49.  which will make us aware of where pirated copies came from so
  50.  please don't entertain the thought of handing copies to your
  51.  friends.

  53.   You are granted the right to install the NSClean files on any
  54.  and all personal machines that YOU purchased and own. This
  55.  grant is provided SOLELY to individuals for home use. In
  56.  addition, individuals may also install NSClean on ONE SINGLE
  57.  MACHINE at their place of work under the terms of this license
  58.  if permitted to do so by licensee's employer.
  59.  
  60.   BUSINESS users of NSClean are bound by a different
  61.  arrangement. In any business use of NSClean, the licensee has
  62.  the right to install NSClean on ONE SINGLE MACHINE. This
  63.  limitation exists because business purchasers of NSClean are
  64.  entitled to site license discounting based on bulk purchase of
  65.  the product in quantity.
  66.  
  67.   U.S. GOVERNMENT RESTRICTED RIGHTS: If this product is
  68.  acquired under the terms of a (i) Civilian Agency Contract -
  69.  use, reproduction or disclosure is subject to FAR 52.227-19(a)
  70.  through (d) and restrictions set forth in the accompanying end
  71.  user agreement; and (ii) DoD Contract - use, duplication or
  72.  disclosure by the Government is subject to the terms of this
  73.  license unless superseded by 252.227-7013(c)(1)(ii). The
  74.  address of the manufacturer of record can be found at the
  75.  bottom of this document.

  77.   EXPORTS AND RESALE OF THIS PRODUCT ARE CONTROLLED. You may
  78.  not export or reexport the NSClean Software or any underlying
  79.  information or technology except in full compliance with all
  80.  United States and other applicable laws and regulations.  In
  81.  particular, but without limitation, none of this Software or
  82.  underlying information or technology may be exported or
  83.  reexported (i) into (or to a national or resident of) Cuba,
  84.  Haiti, Iraq, Libya, Yugoslavia, North Korea, Iran, or Syria or
  85.  (ii) to anyone on the US Treasury Department's list of
  86.  Specially Designated Nationals or the US Commerce Department's
  87.  Table of Deny Orders. You are agreeing to the foregoing and
  88.  you are representing and warranting that you are not located
  89.  in, under control of, or a national or resident of any such
  90.  country or on any such list. Any such violations must and will
  91.  be reported to the Commerce Department.

  94.  NSCLEAN UPGRADE AND "BUG" POLICY:
  95.  --------------------------------------------------------------
  96.  
  97.   It is NSClean's policy to provide bug fixes for our products
  98.  at no charge to our customers by return email or for $5.00 if
  99.  mailing out a disk is required should a problem occur due to
  100.  mistakes or omissions in our code that causes problems. We
  101.  cannot however assure that our code will work with browsers
  102.  which are released after this version has been released. This
  103.  version covers all versions of Netscape up to and including
  104.  Communicator 4.01 release. Any future releases of Netscape
  105.  are not covered by our "bug fix" free replacement policy as
  106.  they do not exist at the time this version has been released.
  107.  
  108.   This applies as well to any "security updates" that might be
  109.  released by Netscape for Communicator in the future. It is
  110.  not likely that any such changes by Netscape will affect the
  111.  operability of this product but we want to be clear with you
  112.  that in the event future releases by Netscape make their new
  113.  releases incompatible with this product, it is NOT our fault.
  114.  
  115.   NSClean will provide upgrades to our software in the future
  116.  at half the regular price to our customers if the need for
  117.  the upgrade is not under our control. Such occurances involve
  118.  future new versions of the browsers which render them no
  119.  longer compatible with the existing designs for which the
  120.  NSClean software was designed. Users who choose to upgrade to
  121.  a new future version of their browser make these choices on
  122.  their own and existing users of NSClean are not in need of
  123.  upgrading unless they do so.
  124.  
  125.   NSClean cannot guarantee performance during browser beta
  126.  test releases as these are not general releases of the
  127.  browser products and are fraught with bugs and unstable
  128.  behavior. While NSClean may make upgrade products available
  129.  for browsers during their beta releases, we cannot
  130.  guarantee that our product will perform on a long term basis
  131.  until the "official" releases of upcoming browsers.
  132.  
  133.   Therefore we strongly urge customers not to participate in
  134.  browser beta test programs owing to this risk. We will make
  135.  every possible effort to support future browsers as soon as
  136.  possible but we cannot guarantee compatibility with future
  137.  products we have not been able to examine for compatibility.
  138.  
  139.   NSClean is sold only through authorized distributors. Please
  140.  contact the place of purchase for information on upgrade
  141.  pricing and delivery information. Site license customers
  142.  should contact NSClean Privacy Software directly. No retail
  143.  sales are provided through NSClean Privacy Software and
  144.  orders from individuals must be declined. Please visit our
  145.  web site at http://www.nsclean.com for further details.

  148.  NSCLEAN LIMITED WARRANTEE:
  149.  --------------------------------------------------------------
  150.  
  151.   NSClean is sold with the understanding that NSClean only
  152.  adjusts files on an individual's computer where normal copies
  153.  of Netscape are installed. The NSClean product cannot control
  154.  nor warn of interception of your data while you are on the
  155.  internet. NSClean therefore cannot be expected to secure your
  156.  online connection under any circumstances. Employers and
  157.  others have the capability of recording all sites you visit
  158.  and actions you take while on the internet without ever
  159.  obtaining information from within your machine.
  160.  
  161.   If NSClean fails to work with your copy of Netscape (up to
  162.  and including Communicator) you are entitled to a refund of 
  163.  the total amount submitted if you return the NSClean install 
  164.  disk to the original place of purchase. Bug fixes if required 
  165.  for the NSClean product will be provided directly to you
  166.  exclusively by email for FREE if you have registered with us
  167.  as provided for at the beginning of this file, or will be
  168.  offered for a fee of $5.00 if we have to mail a disk to you.
  169.  We recommend you avail yourself of the email option since it
  170.  is free. If you don't wish to register, it merely makes the
  171.  job of verifying that you are a customer a bit more work and
  172.  no customer will be refused service if they don't register.
  173.  
  174.   Your email address will not be abused by us in any way and
  175.  NSClean does not ever give out customer information to ANYONE.
  176.  If you ordered online from one of our dealers, they too are
  177.  bound by this agreement not to give out your information to
  178.  ANYONE. Our web site similarly gathers no information at all
  179.  when you visit. We're in the business of enhancing privacy
  180.  and any such tactics would be highly counterproductive.
  181.  
  182.   In order to comply with general business law and to keep our
  183.  attorneys happy, the following terms and conditions apply if
  184.  the licensee is not willing to abide by the terms and
  185.  conditions set forth above:

  187.  LIMITED WARRANTY. Kevin McAleavey, the author, warrants that
  188.  (a) the NSCLEAN SOFTWARE PRODUCT will perform substantially in
  189.  accordance with the accompanying written materials for a
  190.  period of ninety (90) days from the date of receipt, and (b)
  191.  the magnetic media accompanying the NSCLEAN SOFTWARE PRODUCT
  192.  will be free from defects in materials and workmanship under
  193.  normal use and service for a period of ninety (90) days from
  194.  the date of receipt.  Some states and jurisdictions do not
  195.  allow limitations on duration of an implied warranty, and thus
  196.  the above limitation might not apply to you.  To the extent
  197.  allowed by applicable law, implied warranties on the NSCLEAN
  198.  SOFTWARE PRODUCT and media, if any, are limited to ninety (90)
  199.  days.
  200.  
  201.  CUSTOMER REMEDIES. Kevin McAleavey, the author's entire
  202.  liability and your exclusive remedy shall be, at the author's
  203.  option, either (a) return of the price paid, or (b) repair or
  204.  replacement of the NSCLEAN SOFTWARE PRODUCT or media that does
  205.  not meet the author's Limited Warranty and which is returned
  206.  to the author. This Limited Warranty is void if failure of the
  207.  NSCLEAN SOFTWARE PRODUCT or media has resulted from accident
  208.  or abuse. Replacement media will be warranted for the
  209.  remainder of the original warranty period or thirty (30) days,
  210.  whichever is longer.
  211.  
  212.  NO LIABILITY FOR CONSEQUENTIAL DAMAGES. To the maximum extent
  213.  permitted by applicable law, in no event shall Kevin McAleavey
  214.  be liable for any incidental, indirect, or consequential
  215.  damages whatsoever (including, without limitation, damages for
  216.  loss of business profits, business interruption, loss of
  217.  business information, or any other pecuniary loss) arising out
  218.  of the use of or inability to use the software product, even
  219.  if Kevin McAleavey has been advised of the possibility of such
  220.  damages. Since some states and jurisdictions do not allow the
  221.  exclusion or limitation of liability for consequential or
  222.  incidental damages, the above limitation might not apply to
  223.  you.
  224.  
  225.  NO OTHER WARRANTIES. To the maximum extent permitted by
  226.  applicable law, Kevin McAleavey disclaims all other
  227.  warrantees, either express or implied, including, but not
  228.  limited to, implied warranties of merchantability and fitness
  229.  for a particular purpose, with regard to the software product
  230.  and accompanying magnetic media. This LIMITED WARRANTEE gives
  231.  you specific legal rights. You may have others which vary from
  232.  jurisdiction to jurisdiction.
  233.  
  234.  GOVERNING LAW. This license will be governed by the laws of
  235.  the State of New York, United States of America as they are
  236.  applied to agreements between New York residents entered into
  237.  and to be performed entirely within New York. The United
  238.  Nations Convention on Contracts for the International Sale of
  239.  Goods is SPECIFICALLY DISCLAIMED.
  240.  
  241.  SEVERABILITY. In the event of invalidity of any provision of
  242.  this license, the parties agree that such invalidity shall not
  243.  affect the validity of the remaining portions of this license.
  244.  
  245.  ENTIRE AGREEMENT. This is the entire agreement between you and
  246.  Kevin McAleavey which supersedes any prior agreement or
  247.  understanding, whether written or oral, relating to the
  248.  subject matter of this license.
  249.  
  250.   The author is NOT an authorized developer for Netscape
  251.  Communications Corp. and this product is in no way connected
  252.  with the Netscape Browser software or its copyright, trademark
  253.  or patent holders. This product was generated without
  254.  knowledge of any Netscape trade secrets nor involvement with
  255.  anyone who was a party to a Netscape non-disclosure agreement
  256.  in a clean-room engineering environment. Algorithms and
  257.  operations of NSClean are the intellectual property and
  258.  exclusive trade secrets of its author. Any infringements or
  259.  replications of the functions of the NSClean product in any
  260.  manner will be prosecuted vigorously.
