  2. END-USER LICENSE AGREEMENT
  3.  
  4. (For Dr.Salman's Windows Power Tools Ver 1.75)
  5.  
  6. If you do not agree to the terms and conditions of this agreement,
  7. then do not install this product.
  8.  
  9. This is a legal agreement between you (either an individual or 
  10. an entity),the end user,and DR.SALMAN ZAFAR regarding use of the 
  11. software accompanying this Agreement("Product").By installing, 
  12. copying, or otherwise using the Product,you agree to be bound by
  13. the terms of this Agreement. If you do not agree to the terms of 
  14. this Agreement, do not install, copy or use the Product.
  15.  
  16. The Term SOFTWARE/SOFTWARE PRODUCT refers to Dr.Salman's Windows Power Tools.
  17. The SOFTWARE PRODUCT is protected by copyright laws and international copyright
  18. treaties, as well as other intellectual property laws and treaties. The SOFTWARE
  19. PRODUCT is licensed, not sold. The term "COMPUTER" as used herein shall mean the
  20. HARDWARE, if the HARDWARE is a single computer system, or shall mean the computer
  21. system with which the HARDWARE operates, if the HARDWARE is a computer system 
  22. component.The Term MANUFACTURER refers to Dr.Salman Zafar and Digital Millenium Inc.
  23. RECIPIENT means the person receiving the License to use the product
  24.  
  25. 1. GRANT OF LICENSE. 
  26. DR.SALMAN ZAFAR grants you ("Recipient") a limited, non-exclusive,
  27. nontransferable,nonrefundable royalty-free license to use one copy
  28. of the Product to be installed on a single CPU residing on Recipient's
  29. premises. Recipient shall not rent, lease, sell, sublicense, assign, or 
  30. otherwise transfer the Product or any accompanying materials
  31. ("Documentation"). Recipient may not reverse engineer, decompile the 
  32. Product DR.SALMAN ZAFAR shall retain title and all ownership rights to 
  33. the product,and this Agreement shall not be broken in any manner as 
  34. transferring any rights of ownership or license to the Product or to the
  35. features or information therein, except as specifically stated herein.

  37. 2. UPGRADES
  38. If the SOFTWARE PRODUCT is labeled as an upgrade, you must be properly 
  39. licensed to use a product identified by Manufacturer, Dr.Salman Zafar
  40. or Digital Millenium Inc. as being eligible for the upgrade in order to 
  41. use the SOFTWARE PRODUCT ("Eligible Product"). For the purpose of 
  42. upgrade products only, "HARDWARE" shall mean the computer system or
  43. computer system component for which you received the Eligible Product. 
  44. You may use the resulting upgraded product only in accordance with the terms 
  45. of this EULA and only with the HARDWARE. If the SOFTWARE PRODUCT is an upgrade of 
  46. a component of a package of software programs that you licensed as a single product, 
  47. the SOFTWARE PRODUCT may be used and transferred only as part of that single product 
  48. package and may not be separated for use on more than one computer except as stated in
  49. section 1 and Section 2 of this EULA.
  50. You are entitled under this agreement for FREE MINOR UPGRADES and 
  51. REVISIONS.However major upgrades have to be licensed separately as
  52. a separate product.

  54. 3. PRODUCT SUPPORT. 
  55. To the maximum extent permitted under applicable law, Manufacturer's 
  56. and its supplier's entire liability and your exclusive remedy under 
  57. the express warranty is, at Manufacturer's option . Product support 
  58. for the SOFTWARE PRODUCT is provided by Digital Millenium Inc. and 
  59. Dr.Salman Zafar.Product support is provided through Email and Email 
  60. Forms on the Website .Support is Provided usually within the next 
  61. 12 working hours of receiving the Email.In case the Support can not be
  62. provided due to some reason the Recipient shall consider Dr.Salman Zafar
  63. ,Digital Millenium Inc. or any of its Employees Harmless.

  66. 4. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS.

  68. (a) Limitations on Reverse Engineering, Decompilation and Disassembly. 
  69. You may not reverse engineer, decompile, or disassemble the 
  70. SOFTWARE PRODUCT or any of its Components.
  71.  
  72. (b) Separation of Components. 
  73. The SOFTWARE PRODUCT is licensed as a single product.
  74. Its component parts may not be separated for use on more 
  75. than one computer.
  76.  
  77. (c) Termination. 
  78. Without prejudice to any other rights, Manufacturer or Dr.Salman Zafar
  79. ( Digital Millenium Inc.) may terminate this EULA if you fail to comply
  80. with the terms and conditions of this EULA. In such event,
  81. you must destroy all copies of the SOFTWARE PRODUCT and all of its
  82. component parts.

  84. (d) Trademarks. 
  85. This EULA does not grant you any rights in connection with any
  86. trademarks or service marks of Manufacturer, Dr.Salman Zafar 
  87. (Digital Millenium Inc.)

  89. 5. DISCLAIMER OF WARRANTY. 
  90. This PRODUCT is provided "AS IS" WITHOUT WARRANTY OF ANY KIND.
  91. DR.SALMAN ZAFAR FURTHER DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT
  92. LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A
  93. PARTICULAR PURPOSE AND THE ENTIRE RISK ARISING OUT OF THE USE OR 
  94. PERFORMANCE OF THE PRODUCT AND DOCUMENTATION REMAINS WITH RECIPIENT.
  95. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL
  96. DR.SALMAN ZAFAR ,DMI OR HIS SUPPLIERS BE LIABLE FOR ANY CONSEQUENTIAL
  97. INCIDENTAL,DIRECT,INDIRECT,SPECIAL OR OTHER DAMAGES THAT SO EVER 
  98. (INCLUDING, WITHOUT LIMITATION,DAMAGES FOR LOSS OF BUSINESS PROFITS,
  99. BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR OTHERS)ARISING 
  100. OUT OF THE USE OF OR INABILITY TO USE THE PRODUCT OR DOCUMENTATION.

  103. 6. COPYRIGHT
  104. All title and intellectual property rights in and to the SOFTWARE
  105. PRODUCT (including but not limited to any images, photographs, 
  106. animations, text and "applets," incorporated into the SOFTWARE PRODUCT)
  107. , the accompanying printed materials, and any copies of the SOFTWARE 
  108. PRODUCT, are owned by Dr.Salman Zafar . You may not copy the printed 
  109. materials accompanying the SOFTWARE PRODUCT. All title and intellectual
  110. property rights in and to the content which may be accessed through use
  111. of the SOFTWARE PRODUCT is the property of the respective content owner
  112. and may be protected by applicable copyright or other intellectual 
  113. property laws and treaties. This EULA grants you no rights to use 
  114. such content. All rights not expressly granted under this EULA are 
  115. reserved by Dr.Salman Zafar.

  118. 7. EXPORT RESTRICTIONS. 
  119. Recipient confirms that with respect to this Product and Documentation's herein,
  120. recipient will not export or re-export them, directly or indirectly to any country.

  123. 8.LIMITATION OF LIABILITY. 
  124. To the maximum extent permitted by applicable law, any conditions or warranties 
  125. imposed or implied by law are hereby excluded. Consumers may nevertheless have the
  126. benefit of certain rights or remedies pursuant to the Trade Practices Act and similar
  127. state and territory laws in U.S, Australia or the Consumer Guarantees Act in New Zealand,
  128. in respect of which liability may not be excluded. Insofar as such liability may not be 
  129. excluded, then to the maximum extent permitted by law, such liability is limited,
  130. at the exclusive option of Manufacturer, to either (a) replacement of the SOFTWARE
  131. or (b) correction of defects in the SOFTWARE .

  133. 9.EXCLUSION OF LIABILITY/DAMAGES. 
  134. The following is without prejudice to any rights you may have at law which cannot legally
  135. be excluded or restricted. You acknowledge that no promise, representation, warranty or 
  136. undertaking has been made or given by Manufacturer (DR.SALMAN ZAFAR) 
  137. (or related company of either) to any person or company on its behalf in relation to
  138. the profitability of or any other consequences or benefits to be obtained from the delivery 
  139. or use of the SOFTWARE and any accompanying , manuals or written materials. 
  140. You have relied upon your own skill and judgement in deciding to acquire the SOFTWARE 
  141. and any accompanying manuals and written materials for use by you.
  142. Except as and to the extent provided in this agreement, neither Manufacturer or 
  143. Digital Millenium Inc. (or related company of either) will in any circumstances be
  144. liable for any other damages whatsoever (including, without limitation, damages for 
  145. loss of business, business interruption, loss of business information or other indirect 
  146. or consequential loss) arising out of the use or inability to use or supply or non-supply of 
  147. the SOFTWARE and any accompanying hardware and written materials.

  149. If you acquired the SOFTWARE in the United States of America, this Software License Agreement 
  150. and Warranty are governed by the laws of the State of Washington, U.S.A. If you acquired 
  151. the SOFTWARE outside the United States of America, local law may apply.

  153. 10.FREE COPY RESTRICTIONS.
  154. Users are allowed to evaluate unregistered copy of "Dr.Salman's Windows Power Tools"
  155. free of charge for a period of 7 days. It will automatically fail to function after 
  156. the evaluation period is over. Users who are interested in Purchasing the Software may
  157. do so for U.S.$49.95 at http://sensor.hypermart.net/register.htm
  158. Upon registration, You will receive a Serial Number which you will need 
  159. to enter in the registration field of the Expiry Box which will appear when
  160. the 7 days trial period is over.
