  7. (individual or a legal entity) and Jouni Vuorio, the author
  8. of the software product "jv16 PowerTools".

  11. AGREEMENT AND THE LIMITATIONS OF YOUR LICENSE
  12. BY INSTALLING, COPYING, DISTRIBUTING OR OTHERWISE

  36. 1. DEFINITIONS
  37.  
  38. "jv16 PowerTools" means the jv16 PowerTools software product
  39.   and everything included in its official distribution
  40.   packages, such as the documentation, all the plug-in
  41.   applications and all the other such modules.
  42.  
  43. "the Author" means the creator and the developer of the
  44.   "jv16 PowerTools" software product, a private individual
  45.   called Jouni Vuorio.
  46.  
  47. "Licensed version" means a version of jv16 PowerTools that has
  48.   been licensed for use in a company or in an organization.
  49.   Licensed version is not free and you are not allowed to
  50.   distribute it in any ways.
  51.  
  52. "Unlicensed version" means the free version of jv16 PowerTools
  53.   that can only be used in personal, non-commercial use.
  54.  
  55. "personal, non-commercial use" means the use of jv16 PowerTools in
  56.   your own home, with your own personal computer by you, your family or
  57.   by your close friends. The computer you use jv16 PowerTools in must
  58.   be owned by you or by a member of your family, you are not allowed
  59.   to use an unlicensed version of jv16 PowerTools in a computer
  60.   owned by the company you work for.

  62. "official distribution package" means a package file, such as .zip or
  63.   .rar archive or a self extracting ("SFX") version of such archive, or
  64.   an installation program containing jv16 PowerTools which can be
  65.   downloaded from the Author's official home page, at the present moment
  66.   "www.vtoy.fi/jv16/" and it's mirror service "www.jv16.org".

  68. "license" means the license you own. If you haven't actually bought a license
  69.   (i.e. the licensed version of the software product) you are bound by the 
  70.   restrictions of the unlicensed version.
  71.  
  72. "license agreement" means this document. This license agreement is a
  73.   legal agreement between you (individual or a legal entity) and
  74.   Jouni Vuorio, the author of jv16 PowerTools.
  75.   You must accept all the terms in this license agreement and the
  76.   limitations of your license if you want to use, run, copy or
  77.   distribute jv16 PowerTools.

  79. "Amount of computers this product can be used with" means all kinds of use,
  80.   such as usage over a network connection or usage from a cd-rom or other
  81.   such media.

  84. 2. WARNING
  85.  
  86. jv16 PowerTools is protected by copyright laws and international
  87. copyright treaties as well as other intellectual property laws and
  88. treaties. Unauthorized reproduction or distribution of the
  89. jv16 PowerTools, or any portion of it, may result in severe criminal
  90. and civil penalties, and will be prosecuted to the maximum extent
  91. possible under law.

  94. 3. GRANT OF LICENSE
  95.  
  96. The Author grants you the following rights provided that you
  97. comply with all terms and conditions of this license agreement:
  98.  
  99.   1. Usage. You may install, use, access, display and run jv16 PowerTools
  100.      in so many computers that the license you own allows you to.
  101.  
  102.      The unlicensed version allows you to use jv16 PowerTools in an
  103.      unlimited amount of computers. If you don't know how many computers
  104.      your license allow you to use you can find out that by starting
  105.      jv16 PowerTools and pressing the F2 key from you keyboard.

  107.  
  108. 4. RESTRICTIONS AND LIMITATIONS OF USE
  109.  
  110. You are NOT allowed to:
  111.  
  112.   1. Modify, reverse engineer, decompile, disassemble or otherwise
  113.      attempt to reconstruct or discover the source code, or any parts
  114.      of it, or discover or reconstruct any mechanism, algorithm or
  115.      a protocol from the binaries of jv16 PowerTools.
  116.  
  117.   2. Create, develop, distribute, use, install or store in your
  118.      computer a program, source code, mechanism, method, protocol or
  119.      algorithm to bypass or to brake jv16 PowerTools' security
  120.      features, license validation, license creation, user account
  121.      validation or user account creation routines, methods or algorithms.
  122.  
  123.   3. Create derivative works based on jv16 PowerTools (e.g. incorporating
  124.      jv16 PowerTools in a commercial product or service without a proper
  125.      license), except that you may create bug fixes.
  126.  
  127.   4. Rent, lease, sublicense, convey, distribute or otherwise
  128.      transfer rights to jv16 PowerTools.
  129.  
  130.   5. Remove any product identification, copyright, proprietary
  131.      notices or labels from jv16 PowerTools.
  132.  
  133.   6. Distribute, re-distribute, rent, lease or sell the licensed
  134.      version of jv16 PowerTools or any portions of it or the license
  135.      itself or any portions of the license without a written permission
  136.      from the Author.
  137.  
  138.   7. Sell, re-sell, rent or lease jv16 PowerTools, any portions
  139.      of it or its license or any portions of a license without
  140.      written permission from the Author.
  141.  
  142.   8. Distribute jv16 PowerTools in any other form than in the
  143.      official distribution packages without a written permission
  144.      from the Author.

  146.   9. Use the licensed version of jv16 PowerTools if you do not
  147.      have a valid license or if you do not know who has bought the 
  148.      license.
  149.  
  150.   10. Use the licensed version of jv16 PowerTools if you know that
  151.       the copy you are using is illegal or the license itself is illegal
  152.       or a fake.
  153.  
  154.   11. Use, run, copy, distribute or store jv16 PowerTools in your computer
  155.       if this license agreement is violated in any ways.

  157.   12. Use the unlicensed version of jv16 PowerTools as a professional tool.
  158.       E.g. If you work as a technical support you are not allowed to use
  159.       the unlicensed version in your work. If you wish to use jv16 PowerTools
  160.       you must buy the licensed version.

  164. 5. TERMINATION OF LICENSE
  165.  
  166. The Author has the right to terminate this license if you do
  167. not abide by the terms and conditions of this license,
  168. in which case you must destroy all copies of jv16 PowerTools
  169. and all of its component parts.

  172. 6. MAINTENANCE, SUPPORT AND UPDATES
  173.  
  174. the Author is under no obligation to maintain, support or
  175. update jv16 PowerTools in any way, or to provide updates or error
  176. corrections.

  179. 7. CONFIDENTIALITY
  180.  
  181. Licensed version of jv16 PowerTools and any license authorization
  182. codes (such as the "license.dat" file) are confidential. You agree to take
  183. adequate steps to protect jv16 PowerTools and any license authorization
  184. codes and "license.dat" file from unauthorized disclosure or use.
  185. You agree that you will not disclose the licensed version of
  186. jv16 PowerTools, any parts of it, its license or any parts of the
  187. license to any third party.

  190. 8. DISCLAIMER
  191.  
  192. The Author expressly disclaims all warranties, whether express, implied
  193. or statutory, including, without limitation, the implied warranties of
  194. merchantability, of fitness for a particular purpose, noninfringement
  195. of third party intellectual property rights, and any warranty that may
  196. arise by reason of trade usage, custom, or course of dealing. Without
  197. limiting the foregoing, you acknowledge that jv16 PowerTools is provided
  198. "as is" and that the Author does not warrant that jv16 PowerTools will run
  199. uninterrupted or error free nor that jv16 PowerTools will operate with
  200. hardware and/or software not provided by the Author. This disclaimer
  201. of warranty constitutes an essential part of the agreement. Some states
  202. do not allow the exclusion of implied  warranties, so the above exclusion
  203. may not apply to you, and you may have other rights, which vary from
  204. state to state.

  207. 9. LIMITED LIABILITY
  208.  
  209. The entire risk as to results and performance of jv16 PowerTools is assumed
  210. by you. Under no circumstances will the Author or his licensors be liable
  211. for any direct or special, indirect, incidental, exemplary or consequential
  212. damages of any kind or nature whatsoever, whether based on contract,
  213. warranty, tort (including negligence), strict liability or otherwise,
  214. arising out of or in any way related to jv16 PowerTools or this agreement,
  215. even if the Author or his licensors have been advised of the possibility
  216. of such damage or if such damage could have been reasonably foreseen,
  217. and notwithstanding any failure of essential purpose of any exclusive
  218. remedy provided in this agreement. Such limitation on damages includes,
  219. but is not limited to, damages for loss of goodwill, lost profits, loss
  220. of data or software, work stoppage, computer failure or malfunction or
  221. impairment of other goods. In no event will the Author or his licensors
  222. be liable for the costs of procurement of substitute Software or services.
  223. in addition, in no event will the total liability of the Author in connection
  224. with this agreement or jv16 PowerTools exceed the actual amount paid to the
  225. author, if any, for jv16 PowerTools giving rise to the claim. You acknowledge
  226. that jv16 PowerTools is not designed or licensed for use in on-line equipment
  227. in hazardous environments such as operation of nuclear facilities, aircraft
  228. navigation or control, or life-critical applications. The Author expressly
  229. disclaims any liability resulting from use of jv16 PowerTools in any such
  230. on-line equipment in hazardous environments and accepts no liability in
  231. respect of any actions or claims based on the use of jv16 PowerTools in any
  232. such on-line equipment in hazardous environments by you. For purposes of
  233. this paragraph, the term "life-critical application" means an application
  234. in which the functioning or malfunctioning of jv16 PowerTools may result directly
  235. or indirectly in physical injury or loss of human life.

  238. 10. DISTRIBUTING
  239.  
  240. Unlicensed version of jv16 PowerTools may be freely distributed provided
  241. that it is not modified in any ways and that the original distribution packages
  242. remain intact with all accompanying files, and provided that no fee is
  243. charged (except for any reasonable fees necessary to cover costs of
  244. distribution media), and that this license agreement is not violated
  245. in any ways. You are not allowed to include jv16 PowerTools to any
  246. commercial CD-ROM or DVD software collection without a written permission
  247. from the Author. The Author reserves the right to deny you from distributing
  248. jv16 PowerTools even if you haven't violated this license agreement.

  251. 11. RESERVATION OF RIGHTS
  252.  
  253. The Author reserves all rights not expressly granted to you in this license agreement.

  256. YOU AGREE TO BE BOUND BY THE TERMS OF THIS LICENSE
