  1. END-USER LICENSE AGREEMENT

  3. IMPORTANT--READ CAREFULLY: This End-User License Agreement (AGREEMENT)
  4. is a legal agreement between you and Custom Technology Corporation
  5. (CTC) for the Cinema Craft Encoder which may include associated media,
  6. printed materials, and on-line or electronic documentation (SOFTWARE
  7. PRODUCT). By installing, copying, or otherwise using the SOFTWARE
  8. PRODUCT, you agree to be bound by the terms of this AGREEMENT. If you
  9. do not agree to terms of this AGREEMENT, do not install, copy or
  10. otherwise use the SOFTWARE PRODUCT.

  12. 1. DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS
  13. You may not reverse engineer, decompile, or disassemble the SOFTWARE
  14. PRODUCT.
  15. You may not rent or lease the SOFTWARE PRODUCT.
  16. You must comply with all applicable laws regarding use of the SOFTWARE
  17. PRODUCT.

  19. 2. TERMINATION
  20. Without prejudice to any other rights, CTC may terminate this
  21. AGREEMENT if you fail to comply with the terms and conditions of this
  22. AGREEMENT. In such event, you must destroy all copies of the SOFTWARE
  23. PRODUCT.

  25. 3. COPYRIGHT
  26. The SOFTWARE PRODUCT is owned by CTC and its suppliers. Copyright
  27. laws and international copyright treaties, as well as other
  28. intellectual properties protect the SOFTWARE PRODUCT. The SOFTWARE
  29. PRODUCT is licensed, not sold.

  31. 4. LIMITATION
  32. This SOFTWARE PRODUCT is a trial version. You may not use any video
  33. and audio files output by the SOFTWARE PRODUCT for commercial use.

  35. 5. NO WARRANTY
  36. CTC expressly disclaims any warranty for the SOFTWARE PRODUCT and
  37. Support Services (if any). The SOFTWARE PRODUCT and any related
  38. documentation is provided without warranty of any kind, either
  39. express or implied, including, without limitation, the implied
  40. warranties or merchantability, fitness for a particular purpose
  41. non-infringement. The entire risk arising out of use or performance
  42. of the SOFTWARE PRODUCT remains with you.

  44. 6. LIMITATION OF LIABILITY
  45. To the maximum extent permitted by applicable law, in no event shall
  46. CTC or its suppliers be liable for any special, incidental, indirect,
  47. or consequential damages whatsoever arising out of user of or
  48. inability to use the SOFTWARE PRODUCT or the provision of or failure
  49. to support Services, even if CTC has been advised of possibility of
  50. such damages.

  52. 7. MISCELLANEOUS
  53. You agree that you will not directly or indirectly export or
  54. re-export the SOFTWARE PRODUCT to any country.
