  5. END-USER LICENSE AGREEMENT FOR Sampletank SOFTWARE
  6.  
  7. Please read this document carefully before breaking the seal on the media
  8. package. This agreement licenceses the enclosed software to you and contains
  9. warranty and liability disclaimers.
  10.  
  11. By breaking the seal on the media envelope, you are confirming to have taken
  12. notice of clauses of this agreement and you acknowledge your acceptance of the
  13. software as well as your acceptance of the terms of this agreement. If you do
  14. not wish to do so, do not break the seal. Instead, promptly return the entire
  15. package, including the unopened media package, to the dealer from whom you have
  16. obtained it, for a full refund.
  17.  
  18. 1) DEFINITIONS
  19. "EULA means this end user license agreement"
  20.  
  21. "Sampletank software" means the software program included in the enclosed
  22. package, and all related updates supplied by IK Multimedia Production srl -
  23. Italy .
  24.  
  25. "IK Multimedia Product" means the Sampletank software and the related
  26. documentation and models and multimedia content (such as animation, sound and
  27. graphics) and all related updates supplied by IK Multimedia Production srl -
  28. Italy.
  29.  
  30. "Not for resale (NFR) Version" means a version of IK Multimedia Product", so
  31. identified, intended for review and evaluation purposes, only.
  32.  
  33. 2) LICENSE
  34. The "IK Multimedia Product" is protected by copyright laws and international
  35. copyright treaties, as well as other intellectual property laws and treaties.
  36. The "IK Multimedia Product" is licensed, not sold.
  37.  
  38. This EULA grants you the rights as specified here below, All other actions and
  39. means of usage are reserved to the written permission of the right holder IK
  40. Multimedia Production srl:
  41.  
  42. Applications Software. The "IK Multimedia Product" may be used only by you. You
  43. may install and use one copy of the "IK Multimedia Product", or any prior
  44. version thereof for the same operating system, on a single computer.
  45.  
  46. Storage/Network use. You may also store or install a copy of the "IK Multimedia
  47. Product" on a storage device, such as a network server, used only to install or
  48. run the "IK Multimedia Product" on your other computers over an internal
  49. network; however, you must acquire and dedicate a distinct license for each user
  50. of the "IK Multimedia Product" from the storage device. Any given license for
  51. the "IK Multimedia Product" may not be shared or used concurrently or otherwise
  52. on different computers or by different developers in a given organization.
  53.  
  54. 3) AUTHORIZATION CODE
  55. The "IK Multimedia Product" only functions when you are in the possession of an
  56. authorization code. You will receive an authorization code upon completing the
  57. authorization code request procedure. Once your authorization code is activated,
  58. you may use the product.
  59.  
  60. You agree to follow the authorization code request procedure and will provide
  61. true, accurate and complete information about yourself. If you provide any
  62. information that is untrue, inaccurate, not correct or incomplete, or IK
  63. Multimedia has reasonable grounds to suspect that such information is untrue,
  64. inaccurate, not correct or incomplete, IK Multimedia has the right to suspend or
  65. to revoke the license.
  66.  
  67. The termination of the license shall be without prejudice to any rights,
  68. whatsoever, of IK Multimedia.
  69.  
  70. 4) DESCRIPTION OF OTHER RIGHTS AND LIMITATIONS
  71. Limitations on Reverse Engineering, Decompilation, and Disassembly. You may not
  72. reverse engineer, decompile, or disassemble the "IK Multimedia Product", except
  73. and only to the extent that such activity is expressly permitted by applicable
  74. law notwithstanding this limitation of components. The "IK Multimedia Product"
  75. is licensed as a single product. Its component parts may not be separated for
  76. use on more than one computer.
  77.  
  78. Not for Resale Version. If the "IK Multimedia Product" is labeled "Not for
  79. Resale" or "NFR" or "Evaluation Copy", then, notwithstanding other sections of
  80. this EULA, you may not sell, or otherwise transfer the "IK Multimedia Product";
  81.  
  82. Rental. You may not rent, lease, or lend the "IK Multimedia Product" to any
  83. party.
  84.  
  85. Software Transfer. You are not allowed to transfer, license or sublicence your
  86. rights as Licensee of the Sampletank software or any IK Multimedia product, as
  87. licensed to you under this agreement. The carrier on which the IK Multimedia
  88. product has been distributed cannot be transferred or otherwise made available
  89. to any third party.
  90.  
  91. 5) UPGRADES
  92. If the "IK Multimedia Product" is labeled or otherwise identified by IK
  93. Multimedia Production srl as an "upgrade", you must be properly licensed to use
  94. a product identified by IK Multimedia Production srl as being eligible for the
  95. upgrade in order to use the "IK Multimedia Product".
  96.  
  97. An "IK Multimedia Product" labeled or otherwise identified by IK Multimedia
  98. Production srl as an upgrade replaces and/or supplements the product that formed
  99. the basis for your eligibility for such upgrade. You may use the resulting
  100. upgraded product only in accordance with the terms of this EULA. If the "IK
  101. Multimedia Product" is an upgrade of a component of a package of software
  102. programs that you licensed as a single product, the "IK Multimedia Product" may
  103. be used and transferred only as part of that single product package and may not
  104. be separated for use on more than one computer.
  105.  
  106. 6) DUAL-MEDIA SOFTWARE.
  107. You may receive the "IK Multimedia Product" in more than one medium. Regardless
  108. of the type or size of the medium you receive, you may use only that one medium
  109. that is appropriate for your single computer. You may not use or install the
  110. other medium on another computer, including but not limited to portable under
  111. the exclusive control of the registered developer. You may not loan, rent,
  112. lease, or otherwise transfer the other medium to another user, except as part of
  113. the permanent transfer (as provided above) of the "IK Multimedia Product"
  114.  
  115. 7) LIMITED WARRANTY
  116. IK Multimedia Production srl warrants to the original purchaser of the computer
  117. software product, for a period of ninety (90) days following the date of
  118. original purchase, that under normal use, the software program and the user
  119. documentation are free from defects that will materially interfere with the
  120. operation of the program as described in the enclosed user documentation.
  121.  
  122. 8) WARRANTY CLAIMS
  123. To make a warranty claim under the above limited warranty, please return the
  124. product to the point of purchase, accompanied by proof of purchase, your name,
  125. your return address and a statement of the defect, or send the CD to us at the
  126. below address within ninety (90) days of purchase. Include a copy of the dated
  127. purchase receipt, your name, your return address and a statement of the defect.
  128. IK Multimedia Production srl or its authorized dealer will use reasonable
  129. commercial efforts to repair or replace the product and return it to you
  130. (postage prepaid) or issue to you a credit equal to the purchase price, at its
  131. option.
  132.  
  133. 9) LIMITATIONS ON WARRANTY
  134. IK Multimedia Production srl warrants only that the program will perform as
  135. described in the user documentation. No other advertising, description or
  136. representation, whether made by a IK Multimedia Production srl dealer,
  137. distributor, agent or employee, shall be binding upon IK Multimedia Production
  138. srl or shall change the terms of this warranty.
  139.  
  140. EXCEPT AS STATED ABOVE, IK MULTIMEDIA PRODUCTION SRL MAKES NO OTHER WARRANTY,
  141. EXPRESS OR IMPLIED, REGARDING THIS PRODUCT. IK MULTIMEDIA PRODUCTION SRL
  142. DISCLAIMS ANY WARRANTY THAT THE SOFTWARE IS FIT FOR A PARTICULAR PURPOSE, AND
  143. ANY IMPLIED WARRANTY OF MERCHANTABILITY SHALL BE LIMITED TO A NINETY (90) DAY
  144. DURATION OF THIS LIMITED EXPRESS WARRANTY AND IS OTHERWISE EXPRESSLY AND
  145. SPECIFICALLY DISCLAIMED. IK MULTIMEDIA PRODUCTION SRL SHALL NOT BE LIABLE FOR
  146. SPECIAL, INCIDENTAL, CONSEQUENTIAL OR OTHER DAMAGES, EVEN IF IK MULTIMEDIA IS
  147. ADVISED OF OR AWARE OF THE POSSIBILITY OF SUCH DAMAGES. THIS MEANS THAT IK
  148. MULTIMEDIA PRODUCTION SRL SHALL NOT BE RESPONSABLE OR LIABLE FOR THE LOST OF
  149. PROFITS OR REVENUES, OR FOR DAMAGES OR COSTS AS A RESULT OF LOSS OF TIME, DATA
  150. OR USE OF THE SOFTWARE, OR FROM ANY OTHER CAUSE EXCEPT THE ACTUAL COST OF THE
  151. PRODUCT. IN NO EVENT SHALL IK MULTIMEDIA PRODUCTION SRL LIABILITY EXCEED THE
  152. PURCHASE PRICE OF THIS PRODUCT.
  153.  
  154. GENERAL
  155. This Agreement shall be governed by the internal laws of Italy. This Agreement
  156. contains the complete agreement between the parties with respect to the subject
  157. matter hereof, and supersedes all prior or contemporaneous agreements or
  158. understandings, whether oral or written. All questions concerning this Agreement
  159. shall be directed to:

  179. DO NOT USE THIS PRODUCT UNTIL YOU HAVE READ THIS LICENSE AGREEMENT. BY USING
  180. THIS PRODUCT (OR AUTHORIZING ANY OTHER PERSON TO DO SO) YOU ACCEPT THIS LICENSE
  181. AGREEMENT.

  183. LICENSE AGREEMENT
  184.  
  185. 1. License grant. IK Multimedia Production grants to you, subject to the
  186. following terms and conditions, a nonexclusive, nontrasferable right to use each
  187. authorized copy of the enclosed product. The enclosed product is the property of
  188. IK Multimedia Production and is licensed to you only for use as part of musical
  189. performance live or recorded. This license expressly forbids resale or other
  190. distribution of these Sounds or their derivatives, either as they exist on disc,
  191. reformatted for use in another digital sampler, or mixed, combined, filtered,
  192. resynthesized or otherwhise edited, for use as sounds, multisounds, samples,
  193. multisamples, wavetables, programs or patches in a sampler, microchip or any
  194. hardware or software sample playback device. You cannott sell them or give them
  195. away for use by others in their sampling or sample playback devices. In the
  196. event IK Multimedia Production terminates this Agreement due to a breach on your
  197. part, you agree to return the original and all other copies of the software and
  198. documentation to IK Multimedia Production. IK Multimedia Production reserves all
  199. rights not expressly granted to you.
  200.  
  201. 2. Protection of Software. You agree to take all reasonable steps to protect
  202. this product and any accompanying documentation from unauthorized copying or
  203. use. You agree not to modify the enclosed product to circumvent any method or
  204. means adopted or implemented by IK Multimedia Production to protect against or
  205. discourage the unlicensed use or copying of the enclosed product.
  206.  
  207. 3. Ownership. As between you and IK Multimedia Production, ownership of, and
  208. title to, the enclosed digitally recorded sounds (including any copies) will be
  209. held by IK Multimedia Production. Copies are provided to you only to enable you
  210. to exercise your right under the license. Only this license is purchased by you.
  211.  
  212. 4. Term. This Agreement is effective from the date you open this package, and
  213. will remain in full force until termination. This Agreement will terminate if
  214. you break any of the terms and conditions of this Agreement. Upon termination
  215. you agree to destroy and return to IK Multimedia Production all copies of this
  216. product and accompanying documentation.
  217.  
  218. 5. Restriction. Except as expressly authorized by this agreement, you may not
  219. rent, sell, lease, sublicense, distribute, transfer, copy, reproduce, display,
  220. modify or time share the enclosed product and documentation.
